Nakalyuzhna și alții împotriva Ucrainei

CINTIMEA SECȚIUNE DECIZIE Nr. 2614/04 Iryna Vlasivna NAKALYUZHNA împotriva Ucrainei și 71 alte cereri (a se vedea lista anexată) Curtea Europeană a Drepturilor Omului (Cincimea Secțiunea), ședința la 3 decembrie 2013 în calitate de comitet compus din: Boštjan M. Zupančič, președinte, Ann Power-Forde, Helena Jäderblom, judecători și Stephen Phillips, secretar adjunct al secțiunii, Având în vedere cererile depuse mai sus la diferitele date prevăzute în tabelul anexat, având în vedere decizia de a aplica procedura de judecată-pilot luată în cazul Yuriy Nikolayevich Ivanov c. Ucraina , nr. 40450/04, 15 octombrie 2009, având în vedere deliberarea, hotărăsește după cum urmează: FACTE Reclamanții sunt cetățeni ucraineni, cu excepția reclamanților în cererile nr. 17631/07 și 50344/07, respectiv resortisanți moldoveni și ruși.

Reclamanții în cererile nr. 17516/04 și 8062/09 sunt entități juridice înregistrate în Ucraina. Detalii personale ale tuturor reclamanților sunt prezentate în tabelul anexat. Guvernul ucrainean („ Guvernul”) a fost reprezentat de agentul lor, dl Nazar Kulchytskyy, al Ministerului Justiției. Faptele cazului, astfel cum au fost prezentate de părți, pot fi rezumate după cum urmează. La datele prevăzute în tabelul din anexa de mai jos, instanțele naționale deținute pentru solicitanți și au ordonat inculpaților în temeiul acestor hotărâri (angajatori) să ia anumite măsuri sau să plătească diverse sume reclamanților. Hotărârile au devenit obligatorii, dar autoritățile au întârziat executarea lor. Solicitațiile au fost comunicate guvernului ucrainean în cadrul hotărârii pilot în cazul Iuriy Nikolayevich Ivanov citat mai sus.

COMPLAINTE Reclamanții se plâng în principal în legătură cu lungul neexecuție a hotărârilor în favoarea lor. HOTĂRÂREA Tribunalului consideră în primul rând că, în conformitate cu art. 42 § 1 din Regulamentul Curții, cererile enumerate în tabelul adăugat ar trebui să fie alăturate, având în vedere contextul lor juridic comun. Guvernul contestat a informat Curtea că cererile nu respectă criteriile de admisibilitate ale Convenției și a invitat astfel Curtea să le declare inadmisibilă. Curtea a examinat cu atenție cererile și a remarcat că, în fiecare caz, plângerile comunicate de neexecuție sunt inadmisibile din motivele prevăzute în tabelul anexat (a se vedea ultima coloană).

Curtea remarcă, de asemenea, că, având în vedere tot materialul în posesia sa, și în măsura în care chestiunea reclamată este în competența sa, toate celelalte plângeri ale reclamanților nu dezvăluie nicio apariție a unei încălcări a drepturilor și libertăților prevăzute în Convenția sau în Protocolurile sale. În consecință, toate cererile enumerate în tabelul anexat sunt evident nefondate și trebuie respinse în conformitate cu articolul §§ 1, 3 și 4 din Convenție. Din aceste motive, Curtea decide în unanimitate să se alăture cererilor; declara cererile inadmisibile.

Zupančič, President, Ann Power-Forde, Helena Jäderblom, judges, and Stephen Phillips, Deputy Section Registrar, Having regard to the above applications lodged on the various dates stated in the annexed table, Having regard to the decision to apply the pilot-judgment procedure taken in the case of Yuriy Nikolayevich Ivanov v. Ukraine , no. 40450/04, 15 October 2009, Having deliberated, decides as follows: THE FACTS The applicants are Ukrainian nationals, except for the applicants in applications nos.

17631/07 and 50344/07, who are respectively Moldovan and Russian nationals. Applicants in the applications nos. 17516/04 and 8062/09 are legal entities registered in Ukraine. Personal details of all the applicants are set out in the annexed table. The Ukrainian Government (“the Government”) were represented by their Agent, Mr Nazar Kulchytskyy, of the Ministry of Justice. The facts of the case, as submitted by the parties, may be summarised as follows. On the dates set out in the annexed table below the national courts held for the applicants and ordered the defendants under these judgments (debtors) to take certain measures or to pay various amounts to the applicants. The judgments became binding but the authorities delayed their enforcement.

The applications were communicated to the Ukrainian Government within the pilot judgment in the case of Yuriy Nikolayevich Ivanov cited above. COMPLAINTS The applicants complained principally about the lengthy non ‑ enforcement of judgments in their favour. THE LAW The Court first considers that in accordance with Rule 42 § 1 of the Rules of Court, the applications listed in in the appended table should be joined, given their common legal background. The respondent Government informed the Court that the applications did not comply with the admissibility criteria of the Convention and thus invited the Court to declare them inadmissible. The applicants disagreed. The Court has carefully examined the applications and notes that in each case the communicated non-enforcement complaints are inadmissible on the grounds set out in the annexed table (see last column).

The Court further notes that, in the light of all the material in its possession, and in so far as the matter complained of is within its competence, all the other complaints of the applicants do not disclose any appearance of a violation of the rights and freedoms set out in the Convention or its Protocols. It follows that all the applications listed in the annexed table are manifestly ill-founded and must be rejected in accordance with Article 35 §§ 1, 3 and 4 of the Convention. For these reasons, the Court unanimously Decides to join the applications; Declares the applications inadmissible.
