Publicat la 26 august 2024 PRIMEA SECȚIUNE Cerere nr. 56930/21 Paweł BANDURSKI împotriva Poloniei și a altor 25 de cereri (a se vedea lista anexată) comunicată la 15 iulie 2024 OBJETORUL CAUZULUI Reclamanții erau părți la diferite proceduri (civil, penal, administrativ și privind detenția prealabilă [1] ). Toate cu excepția celor 2 solicitanți [2] au fost examinate de instanțe de primă sau de a doua instanță într-o formare, inclusiv judecători detașați la aceste instanțe în conformitate cu hotărârea Ministrului Justiției în temeiul articolului 77 din Lege privind organizarea instanțelor obișnuite (ustawa o z dnia 27 lipca 2001- Prawo o ustroju sadów powszechnych În plus, patru reclamanți au fost examinați de instanțe de primă instanță, fie într-o formație de un singur judecător compusă dintr-un evaluator al instanței [3] (adică un judecător de stagiu) fie într-un grup de trei judecători, inclusiv un evaluator al instanței [4]. În conformitate cu regulamentele relevante, evaluatorii din instanță sunt desemnați judecători de către Președintele Republicii Polone, după recomandarea Consiliului Național al Judiciarului (Krajowa Rada Sādownictwa, „CNJ”), astfel cum se stabilește în temeiul Legii de modificare a NCJ și a anumitor alte statute din 8 decembrie 2017 (ustawa o zmianie ustawy o Krajowej Radzie Sādownictwa oraz niektórych innych ustaw; „Actul 2017”).
Reclamanții se plâng că cauzele lor au fost examinate de formații judiciare ale instanțelor obișnuite și ale Curții administrative regionale din Varșovia, inclusiv 1) judecători detașați la aceste instanțe prin hotărâre a Ministrului pentru Justiție 2) și/sau evaluatori de instanță a căror viitoare numire în calitate de judecători erau dependenți de recomandarea NCJ care a dat naștere la o încălcare a dreptului lor la un „cort independent și imparțial”, în încălcarea articolului 6 § 1 din Convenție. Întrebarea părților a fost instanța care a tratat cazurile reclamanților (cu excepția cazului reclamantului Nieckarz (a se vedea întrebarea 2 de mai jos)) un „procediment independent și imparțial instituit prin lege”, conform articolului 6 § 1 din Convenție?
Se face referire la faptul că cazurile reclamanților au fost examinate de instanțe în formații, inclusiv 1) judecători care au fost detașați la aceste instanțe în conformitate cu o decizie a Ministrului pentru Justiție 2) și/sau evaluatori de instanță a căror viitoare numire în calitate de judecători erau dependente de recomandarea NCJ. Procedura în care Curtea Regională de Varșovia, la 14 martie 2022, a prelungit detenția anterioară a reclamantului (Nieckarz , nr. 47791/22) (cazul nr. VIII Kp 278/22) în conformitate cu art. 5 § 4 din Convenție? În special, organismul care a examinat cazul în prima instanță a fost un „cort” în sensul prezentei dispoziții? Se referă la faptul că cauza reclamantului a fost examinată de Curtea Regională de Varșovia, într-o singură formare judecător compusă dintr-un judecător care a fost detașat la această instanță în conformitate cu o decizie a Ministrului Justiției.
A fost durata procedurii civile în acest caz în încălcarea cerinței de „tempo rațional” de la art. 6 § 1 din Convenție (a se vedea Rutkowski și alții c. Polonia , nr. 72287/10 și altele 2 altele, 7 iulie 2015)? QUESTIONS ADIȚIONALE ÎN Nieckarz v. Polonia (nr. 47791/22) Procedura în care Curtea Regională de Varșovia, la 14 martie 2022, a prelungit detenția anterioară a reclamantului (cazul nr. VIII Kp 278/22) în conformitate cu art. 5 § 4 din Convenție? În special, a fost principiul egalității de arme între solicitant și acuzarea respectată în acest caz, în special în ceea ce privește accesul la dosarul? Prelungirea procedurii inițiate de recursul solicitant împotriva ordinului de prelungire din 14 martie 2022 și încheiată prin hotărârea Curții de Apel din Varșovia din 13 mai 2022 (cazul nr. II AKz 433/22), respectarea cerinței de „velocitate” de la art. 5 § 4 din Convenție (a se vedea Frasik v. Polonia , nr. 22933/02, §§ 64-66, CEHR 2010 (extracte))?
(n. 16585/23) A fost înființarea Camerei Penale a Curții Supreme care a abordat cazul reclamantului un „procediment independent și imparțial instituit prin lege”, conform art. 6 § 1 din Convenție? Se face trimitere la hotărârile Curții în Advance Pharma sp.
z o.o v. Polonia , nr. 1469/20, §§ 294-351, 3 februarie 2022; Dolińska-Ficek și Ozimek v. Polonia , nr. 49868/19 și 57511/19, §§ 283-359, 8 noiembrie 2021, și Guðmundur Andri Ástráðsson c. Islanda [GC], nr. 26374/18, § 205-290, 1 decembrie 2020. QUESTIONS ADDIȚIONALE ÎN NAWROT v. Polonia (n. 36567/23) A fost aplicabilă art. 6 § 1 din Convenția în temeiul șefului său civil în fața procedurii instituite de solicitant în temeiul legii 2004? Dacă da, a fost instanța care a tratat plângerea reclamantului în temeiul legii din 17 iunie 2004 privind o încălcare a dreptului de a examina un caz într-o anchetă efectuată sau supravegheată de un procuror și în proceduri judiciare fără întârziere nejustificată ( ustawa o skardze na naruszenie prawa strony do rozpoznania sprawy w postępowaniu przygotowawczym prowadzonym lub nadzorowanym przez prokuratora i postępowaniu sÜdowym bez nieuzasadnionej zwłoki – „Legea 2004” și judecătorul judecător al Curții de Apel Szczecin, care au examinat recursul reclamantului împotriva hotărârii aceleiași instanțe din 31 mai 2023, un „curte independent și imparțial instituit prin lege”, conform articolului 6 § 1 din Convenție?
Se face referire la faptul că cauza reclamantului a fost examinată printr-o formare a instanțelor ordinare compuse de judecători desemnați în procedura stabilită prin Legea din 8 decembrie 2017 de modificare a Actului privind Consiliul Național al Judiciarității. În răspunsurile lor, părțile sunt invitate să se refere la hotărârile Curții în Advance Pharma sp. z o.o v. Polonia , nr. 1469/20, 3 februarie 2022 și Guðmundur Andri Ástráðsson c. Islanda [GC], nr. 26374/18, §§ 205-290, 1 decembrie 2020. Reclamantul a avut acces la o instanță pentru determinarea drepturilor și obligațiilor sale civile, în conformitate cu art. 6 § 1 din Convenție? Se face trimitere la faptul că recursul său împotriva hotărârii din 10 februarie 2023 a fost lăsat neexaminat pe motivul că nu a fost elaborat de un avocat.

El a stat într-o formație unică judecător, compusă de dl Marek Äukaszek – un evaluator de instanță ( Asesor sādowy ), numit la instanța respectivă la 04/12/2017. La 09/09/2021, Curtea Regională Rybnik a respins recursul reclamantului împotriva acestei hotărâri (cazul nr. II Ca 474/20). Așezată într-o formație de un singur judecător, compusă de dl Piotr Pukowiec, care a fost detașată la această instanță în conformitate cu hotărârea ministrului Justiției. 10042/22 Nawrot c. Polonia 09/02/2022 Krzysztof NAWROT 1981 Siewierz polonez Pe data de 02/03/2015, reclamantul a depus o acțiune civilă împotriva unui editor de ziar, cerând compensații pentru presupusa difamare.
La 30/10/2018, Curtea Regională de Varșovia a permis parțial cererea reclamantului și i-a acordat 50.000 de złoty polonez (PLN; aproximativ 11.550 euro (EUR) plus dobânzi. La 17/06/2020, Curtea de Apel din Varșovia a anulat hotărârea de primă instanță și a respins în întregime cererea reclamantului (cazul I ACa 167/19). Așezată într-un comitet de trei judecători, inclusiv dna Agnieszka Wachowicz-Mazur, care a fost detașată în instanță în conformitate cu hotărârea ministrului justiției. A stat într-o formație de un singur judecător, compusă de doamna Dobromira Myszakowska, care a fost detașată în instanță în conformitate cu hotărârea ministrului justiției. La 10/06/2020 Curtea de Apel Wrocław a modificat ușor caracterizarea juridică a infracțiunilor reclamantei și a susținut sentința. La 15/09/2021 Curtea Supremă a anulat partea hotărârii de apel majorând suma de daune compensatorii ( nawiāzka ) care urmează să fie plătită familiei victimei și a respins restul recursului reclamantului. 16501/22 Rețeaua sp. z o.o. w upadłości c. La 12/03/2021 Curtea regională Siedlce a susținut hotărârea de primă instanță (cazul II Ka 5/21). Așezat într-un comitet de trei judecători, inclusiv dl Paweł Mādry, care a fost detașat în instanță în conformitate cu hotărârea ministrului Justiției. La 05/10/2021, Curtea Supremă a respins recursul de cassare al reclamantului împotriva acestei hotărâri vădit nefondat. 19669/22 Wydra c. Polonia 07/04/2022 Bartłomiej WYDRA 1996 Lipa polonez Krzysztof BENDARZ La 08/06/2021, Curtea de district Stalowa Wola a condamnat reclamantul pentru a provoca prejudicii corporale pentru o altă persoană și i-a amenzionat 1,500 PLN (aproximativ 350 EUR).
La 14/12/2021 Curtea Regională Tarnobrzeg a schimbat condamnarea la un an suspendată pentru o perioadă de 3 ani (cazul II Ka 237/21). Așezată într-o formație de un singur judecător, compusă de dl Tomasz Turbak, care a fost detașată la această instanță în conformitate cu hotărârea ministrului Justiției. 30230/22 Cudziło c. Polonia 06/06/2022 Mariusz CUDZIČO 1977 Gostynin polonez La 01/07/2021 Curtea Regională Tarnobrzeg a ordonat confiscarea anumitor obiecte utilizate de reclamant pentru a comite o infracțiune pentru care a fost condamnat. La 07/09/2021 Curtea de Apel Rzeszów a anulat parțial această decizie și a remis cazul. La 21/10/2021 Curtea Regională Tarnobrzeg a ordonat returnarea obiectelor specifice la reclamant (cazul nr. II K 70/17).
La 02/12/2021, Curtea de Apel Rzeszów a respins recursul reclamantului împotriva acestei decizii (servită la 07/12/2021). 31079/22 Kandybowicz c. Polonia 08/07/2022 Kamil KANDYBOWICZ 1988 Biskupiec polonez La 10/12/2021, Curtea de District Olsztyn a respins o cerere civilă depusă de reclamant împotriva Trezoreriei de Stat (cazul I C 1666/21). Așezată într-o formație unică judecător, compusă de dl Michał Kacprzak – un evaluator de instanță desemnat în instanța respectivă la 04/12/2017. Dl Kacprzak a fost numit judecător regulat la 17/01/2022, la recomandarea noului NCJ din 7/09/2021. La 02/06/2022, Curtea Regională Olsztyn a modificat hotărârea din prima instanță privind costurile și cheltuielile care urmează să fie suportate de reclamant și a susținut restul acestei hotărâri.
La 06/08/2021, Curtea de District Wejherowo a condamnat reclamantul unei autovehicule închiriate, a condamnat-o la un an de închisoare, a suspendat pentru o perioadă de 2 ani de probă și a amendat 4000 PLN (aproximativ 940 EUR; cazul nr. II K 28/21). Așezat într-o formare de un singur judecător, compusă de dna Marta Jaroszewska-Potrykus – un evaluator de instanță numit în instanță la 21/09/2017. La 10/03/2022, Curtea Regională Gdańsk a susținut hotărârea de primă instanță. 11. 38324/22 Gęsiak c. Polonia 25/07/2022 Anna Maria GפSIAK 1965 Warszawa polonez Mateusz Janusz LENART Pe 28/04/1998 reclamantul a fost arestat pentru acuzații de fraudă. Pe 15/07/1999 serviciul de urmărire penală a depus o declarație de inculpare împotriva ei.
La 28/01/2014 Curtea de Apel din Varșovia și-a respins plângerea în temeiul legii din 2004 (cazul II S 1/14). La 23/06/2015, Curtea Regională din Varșovia a condamnat reclamantul pentru mai multe infracțiuni, inclusiv fraudă, a condamnat-o la 3 ani de închisoare și a amendat-o 15.000 PLN (aproximativ 3,500 EUR; cauza nr. VIII K 436/03). Așezată într-un comitet compus dintr-un judecător, dl Sławomir Machnio, care a fost desemnat în judecată între 03/02/2004 și 22/06/2006, în conformitate cu hotărârea ministrului Justiției și a doi judecători laici. La 20/07/2018, Curtea de Apel din Varșovia a modificat caracterizarea juridică a infracțiunii reclamantului, a redus condamnarea la închisoare la un an de închisoare și a redus amenzile la 10.000 PLN (aproximativ 2,350 EUR; cauza nr. II AKa 358/16).
La 30/03/2022, Curtea Supremă a respins apelul de casare al reclamantului ca fiind evident nefondat. 12. 38529/22 Tyl c. Polonia 26/07/2022 Ryszard TYL 1952 Wiskitki polonez La 23/06/2015, Curtea Regională de Varșovia a condamnat reclamantul pentru mai multe infracțiuni, inclusiv fraudă, l-a condamnat la 8 ani de închisoare și l-a amendat 40.000 PLN (aproximativ 9.400 EUR; caz nr. VIII K 436/03). Așezată într-un comitet compus dintr-un judecător, dl Sławomir Machnio, care a fost desemnat în judecată între 03/02/2004 și 22/06/2006, în conformitate cu hotărârea ministrului Justiției și a doi judecători laici. La 20/07/2018, Curtea de Apel din Varșovia a modificat caracterizarea juridică a anumitor infracțiuni, a achitat reclamantul unei acuzații, a redus condamnarea la închisoare la 3 ani de închisoare și a redus amenzile la 36,000 PLN (aproximativ 8,450 EUR; caz nr. II AKa 358/16).
La 30/03/2022, Curtea Supremă a respins apelul de casare al reclamantului ca fiind evident nefondat. 13. 42128/22 Kuchniewski c. Polonia 27/07/2022 Andrzej KUCHNIEWSKI 1969 Warszawa polonez La 23/06/2015 Curtea Regională de Varșovia a condamnat reclamantul pentru mai multe infracțiuni, inclusiv fraudă, l-a condamnat la șase ani de închisoare și i-a amendat 30.000 PLN (aproximativ 7.050 EUR; caz nr. VIII K 436/03). Așezată într-un comitet compus dintr-un judecător, dl Sławomir Machnio, care a fost desemnat în judecată între 03/02/2004 și 22/06/2006, în conformitate cu hotărârea ministrului Justiției și a doi judecători laici. La 20/07/2018, Curtea de Apel din Varșovia a modificat caracterizarea juridică a anumitor infracțiuni, a achitat reclamantul anumitor acuzații, a redus condamnarea la 2 ani de închisoare și a redus amenzile la 25 000 PLN (aproximativ 5 850 EUR; caz nr. II AKa 358/16).
La 30/03/2022, Curtea Supremă a respins apelul de casare al reclamantului ca fiind evident nefondat. 14. 42537/22 Wilczyński c. Polonia 29/08/2022 Roman WILCZY La 23/01/2020 Guvernatorul Lubuskie a emis o decizie de autorizare a unui proiect rutier. Printre altele, s-a decis să exproprieze două parcele de terenuri la care reclamantul avea drepturi de utilizare perpetuă ( użytkowanie wieczyste ). Pe 26/04/2021 Ministrul Dezvoltării, Muncii și Tehnologiei a susținut această decizie până în prezent în ceea ce privește ploturile de teren ale reclamantului. La 05/10/2021, Curtea Administrativă Regională de Varșovia a respins apelul reclamantului (cazul VII SA/Wa 1479/21). Așezată într-un comitet de trei judecători, incluzând dna Elżbieta Granatowska – un consilier de judecată desemnat în instanța respectivă la 27/04/2021.
La 26/04/222, Curtea Administrativă Supremă a respins recursul de casare al reclamantului (servit la 12/05/202). 15. 47791/22 Nieckarz c. Polonia 13/09/2022 Jakub NIECKARZ 1982 Warszawa polonez Paweł Wojciech OSIK La 15/12/2021 reclamantul a fost arestat pe diferite acuzații, inclusiv fraudă. La 17/12/2021 Curtea de district din Varșovia-Mokotów l-a retras în custodie. Avocatul reclamantului a apelat împotriva ordinului de detenție. El a susținut, printre altele La 02/02/2022, Curtea Regională de Varșovia a respins recursul. La 14/03/2022 Curtea Regională de Varșovia a prelungit detenția reclamantului până la 14/05/2022 (cazul VIII Kp 278/22). Acesta stătea într-o formă de un singur judecător, compusă de dl Marcin Waszkiewicz, care a fost detașat la această instanță în conformitate cu o decizie a Ministrului Justiției.
Printre altele, el se plângea că cazul său a fost examinat de către un judecător delegat la o instanță superioră de către ministrul Justiției și că nici el, nici avocatul său, nu au avut timp suficient pentru a examina documentele pe care se bazează prelungirea detenției sale. La 10/05/2022, Curtea Regională a prelungit în continuare detenția reclamantului până la 13/06/2022. La 13/05/2022 Curtea de Apel din Varșovia a respins recursul reclamantului împotriva ordinului de prelungire a anexei 14/03/2022 (cazul II AKz 433/22, a servit la 19/05/2022). La 01/06/2022, reclamantul a fost eliberat pe cauțiune și plasat sub supravegherea poliției. 16. 51528/22 Ryś c. Polonia 20/10/2022 Piotr RYש 1982 Bysina polonez Paweł Robert KUSAK La 14/04/2021 Curtea Regională Częstochowa a condamnat reclamantul infracțiunilor legate de droguri, l-a condamnat la 4 ani de închisoare și l-a amendă pe 25 000 PLN (aproximativ 5,900 EUR; cauzele II K 22/20).
La 27/10/2021, Curtea de Apel Katowice a redus condamnarea la 3 ani și 6 luni de închisoare și amenda la 22.000 PLN (aproximativ 5,200 EUR; cauzele II La 15/06/2022, Curtea Supremă a respins recursul de casă al reclamantului împotriva acestei hotărâri în mod manifest nefondat (stăpânit la 23/06/2022). 17. 10464/23 Płodzień c. Polonia 27/02/2023 Čukasz Påndodzie 1989 Nowy Borek Polaică Pe 30/07/2020 Curtea de district Rzeszów a condamnat reclamantul de amenințare penală și de a distruge proprietatea și l-a condamnat la 10 luni de închisoare. La 29/10/2021, Curtea Regională Rzeszów a modificat caracterizarea juridică a infracțiunii reclamantei, a ordonat să compenseze prejudiciile materiale suferite de victimă și a susținut condamnarea la închisoare (cazul III Ka 525/20).
La 14/09/2022, Curtea Supremă a respins recursul de cassare al reclamantului ca fiind evident nefondat (servit la 07/11/2022). 18. 11460/23 Nizioł c. Polonia 27/02/2023 Zygmunt Adam NIZIOć 1953 Surrey Polonez Piotr KARDAS La 20/08/2018, Curtea Regională de Varșovia a condamnat reclamantul pentru mai multe infracțiuni de colar alb, l-a condamnat la 4 ani de închisoare și l-a amendat pe 400.000 PLN (aproximativ 94,000 EUR). La 26/02/20, Curtea de Apel din Varșovia a modificat caracterizarea juridică a una dintre infracțiunile reclamantei și a crescut condamnarea la 7 ani (cazul II AKa 243/19). Așezată într-un comitet de trei judecători, inclusiv dna Anna Kalbarczyk, care a fost detașată în instanță în conformitate cu hotărârea ministrului Justiției.
La 27/10/2022, Curtea Supremă a respins recursul de cassare al reclamantului ca fiind evident nefondat (semnat la 28/11/2022). 19. 13289/23 Jankowski c. Polonia 10/03/2023 Jerzy JANKOWSKI 1964 Gdynia poloneză Beata ZGLI La 10/11/2015, Curtea Regională Gdańsk a susținut această hotărâre în ceea ce privește reclamantul. La 16/02/2017 Curtea Supremă a anulat hotărârea de a doua instanță și a remis cazul. La 18/10/2017 Curtea Regională Gdańsk a anulat hotărârea din 30/12/2013 și a remis cazul de reexaminare. La 10/11/2020, Curtea Regională Gdańsk a condamnat reclamantul pentru apropiere greșită de fonduri, condamnat la 1 anul și 4 luni de închisoare, suspendate pentru o perioadă de 2 ani de probă, și i-a amendat 200.000 PLN (aproximativ 47,000 EUR; cazul nr. IV K 205/18).
Așezată într-o formație de un singur judecător, compusă de dl Damian Dampc, care a fost detașat în instanța respectivă în conformitate cu hotărârea ministrului justiției. La 25/05/2022, Curtea de Apel din Gdańsk a susținut hotărârea de primă instanță. La 14/11/2022, Curtea Supremă a respins recursul de casă al reclamantului ca fiind evident nefondat (stăpânit la 21/11/2022). 20. 14338/23 Mleczko c. Polonia 13/03/2023 Feliksa MLECZKO 1941 Gdańsk polonez Paulina POLAK La 30/12/2013 Curtea de district Gdańsk-Południe a achita reclamantul de trei crime de colă alb. La 10/11/2015, Curtea Regională Gdańsk a susținut această hotărâre în ceea ce privește reclamantul. La 16/02/2017, Curtea Supremă a anulat hotărârea de a doua instanție și a remis cazul.
La 18/10/2017, Curtea Regională Gdańsk a anulat hotărârea din 30/12/2013 și a remis cazul de examinare proaspătă. La 10/11/2020, Curtea Regională Gdańsk a condamnat reclamantul de ajutor și a suferit deficiturile de fonduri, a condamnat-o la un an și 10 luni de închisoare, suspendată pentru o perioadă de 2 ani de probă, și a amendat 10.000 PLN (aproximativ 2300 EUR; cazul IV K 205/18). La 25/05/2022, Curtea de Apel din Gdańsk a susținut hotărârea de primă instanță. La 14/11/2022, Curtea Supremă a respins recursul de casă al reclamantului ca fiind evident nefondat (stăpânit la 24/11/202). 21. 15585/23 Szymula c. Polonia 03/04/2023 Michał SZYMULA 1979 Wojkowice Polonez Dobrosława Anna TOMZIK La 22/07/2020 Curtea Regională de Katowice a condamnat reclamantul infracțiunilor legate de droguri și l-a condamnat la 6 ani de închisoare.

The applicants were parties to various proceedings (civil, criminal, administrative and concerning pre-trial detention [1] ). All except for 2 applicants [2] had their cases examined by courts of first or second instance in a formation including judges seconded to those courts in accordance with a decision of the Minister for Justice pursuant to Article 77 of the Law on the organisation of the ordinary courts ( ustawa o z dnia 27 lipca 2001- Prawo o ustroju sadów powszechnych ). In addition, four applicants had their cases examined by courts of first instance sitting either in a single-judge formation composed of a court assessor [3] (i.e.
a trainee judge) or in a panel of three judges including a court assessor [4] . According to the relevant regulations, the court assessors are appointed judges by the President of the Republic of Poland upon recommendation of the National Council of the Judiciary (Krajowa Rada Sądownictwa, “the NCJ”) as established under the Amending Act on the NCJ and certain other statutes of 8 December 2017 (ustawa o zmianie ustawy o Krajowej Radzie Sądownictwa oraz niektórych innych ustaw; “the 2017 Act”). The applicants complain that their cases were examined by judicial formations of the ordinary courts and of the Warsaw Regional Administrative Court including 1) judges seconded to those courts by decision of the Minister for Justice 2) and/or court assessors whose upcoming appointments as judges were dependant on the recommendation of the NCJ which gave rise to a violation of their right to an “independent and impartial tribunal”, in breach of Article 6 § 1 of the Convention.
1. Was the court which dealt with the applicants’ cases (with the exception of the case of the applicant Nieckarz (see question 2 below)) an “independent and impartial tribunal established by law” as required by Article 6 § 1 of the Convention? Reference is made to the fact that the applicants’ cases were examined by courts in formations including 1) judges who were seconded to those courts in accordance with a decision of the Minister for Justice 2) and/or court assessors whose upcoming appointments as judges were dependent on the recommendation of the NCJ.
2.Was the procedure in which the Warsaw Regional Court, on 14 March 2022, extended the applicant’s ( Nieckarz , no. 47791/22) pre-trial detention (case no. VIII Kp 278/22) in conformity with Article 5 § 4 of the Convention? In particular, was the body which examined the case at first instance a “court” within the meaning of this provision? Reference is made to the fact that the applicant’s case was examined by the Warsaw Regional Court sitting in a single judge formation composed of a judge who was seconded to this court in accordance with a decision of the Minister for Justice.

On 07/09/2021 the Rzeszów Court of Appeal partly quashed that decision and remitted the case. On 21/10/2021 the Tarnobrzeg Regional Court ordered that specific objects be returned to the applicant (case no. II K 70/17). Mr Kacprzak was appointed a regular judge on 17/01/2022, on recommendation of the new NCJ of 7/09/2021. On 15/07/1999 the prosecution service lodged a bill of indictment against her. On 28/01/2014 the Warsaw Court of Appeal dismissed her length of proceedings complaint under the 2004 Act (case no. II S 1/14). On 23/06/2015 the Warsaw Regional Court convicted the applicant of several offences, including fraud, sentenced her to 3 years’ imprisonment and fined her PLN 15,000 (approximately EUR 3,500; case no. VIII K 436/03).
It sat in a panel composed of one judge, Mr Sławomir Machnio, who had been seconded to that court between 03/02/2004 and 22/06/2006 in accordance with a decision of the Minister of Justice, and two lay judges. Among other things, it was decided to expropriate two plots of land to which the applicant had perpetual use rights ( użytkowanie wieczyste ). On 26/04/2021 the Minister of Development, Labour and Technology upheld that decision in so far it concerned the applicant’s plots of land. On 05/10/2021 the Warsaw Regional Administrative Court dismissed the applicant’s further appeal (case no. VII SA/Wa 1479/21). It sat in a panel of three judges, including Ms Elżbieta Granatowska – a court assessor appointed to that court on 27/04/2021. On 17/12/2021 the Warsaw-Mokotów District Court remanded him in custody. The applicant’s lawyer appealed against the detention order. He argued, inter alia , that he had not had access to the documents based on which the applicant was detained. On 02/02/2022 the Warsaw Regional Court dismissed the appeal. On 14/03/2022 the Warsaw Regional Court extended the applicant’s detention until 14/05/2022 (case no. VIII Kp 278/22). It sat in a single-judge formation, composed of Mr Marcin Waszkiewicz, who had been seconded to that court in accordance with a decision of the Minister of Justice. The applicant appealed. Among other things, he complained that his case had been examined by a judge delegated to a higher court by the Minister of Justice and that neither he nor his lawyer had had sufficient time to examine the documents on which the extension of his detention was based.
On 10/05/2022 the Regional Court further extended the applicant’s detention until 13/06/2022. On 13/05/2022 the Warsaw Court of Appeal dismissed the applicant’s appeal against the extension order of 14/03/2022 (case no. II AKz 433/22, served on 19/05/2022). II K 22/20). On 27/10/2021 the Katowice Court of Appeal reduced the sentence to 3 years and 6 months in prison and the fine to PLN 22,000 (approximately EUR 5,200; case no. II AKa 331/21).

On 26/02/2020 the Warsaw Court of Appeal amended the legal characterisation of one of the applicant’s offences and increased the prison sentence to 7 years (case no. II AKa 243/19).
It sat in a panel of three judges, including Ms Anna Kalbarczyk, who had been seconded to that court in accordance with a decision of the Minister of Justice. On 10/11/2015 the Gdańsk Regional Court upheld that judgment in so far as it concerned the applicant. On 16/02/2017 the Supreme Court quashed the second-instance judgment and remitted the case. On 18/10/2017 the Gdańsk Regional Court quashed the judgment of 30/12/2013 and remitted the case for re-examination.
On 10/11/2020 the Gdańsk Regional Court convicted the applicant of misappropriation of funds, sentenced him to 1 year and 4 months’ imprisonment, suspended for a probationary period of 2 years, and fined him PLN 200,000 (approximately EUR 47,000; case no. IV K 205/18). It sat in a single-judge formation, composed of Mr Damian Dampc, who had been seconded to that court in accordance with a decision of the Minister for Justice. On 10/11/2015 the Gdańsk Regional Court upheld that judgment in so far as it concerned the applicant. On 16/02/2017 the Supreme Court quashed the second-instance judgment and remitted the case. On 18/10/2017 the Gdańsk Regional Court quashed the judgment of 30/12/2013 and remitted the case for fresh examination. On 10/11/2020 the Gdańsk Regional Court convicted the applicant of aiding and abetting the misappropriation of funds, sentenced her to 1 year and 10 months’ imprisonment, suspended for a probationary period of 2 years, and fined her PLN 10,000 (approximately EUR 2,300; case no. Poland 03/04/2023 Michał SZYMULA 1979 Wojkowice Polish Dobrosława Anna TOMZIK On 22/07/2020 the Katowice Regional Court convicted the applicant of drug-related offences and sentenced him to 6 years’ imprisonment. On 08/04/2021 the Katowice Court of Appeal slightly amended that judgment but upheld the prison sentence (case no. II AKa 450/20). It sat in a panel of three judges, including Mr Rafał Doros, who had been seconded to that court in accordance with a decision of the Minister for Justice.
On 08/12/2022 the Supreme Court dismissed the applicant’s cassation appeal as manifestly ill-founded. 22. 16585/23 G.T.v. Poland 05/04/2023 G. T. 1976 Ksawerów Polish Małgorzata MĄCZKA-PACHOLAK On 07/02/2020 the Piotrków Trybunalski Regional Court convicted the applicant of membership of a criminal group and several tax-related offences and sentenced him to 1 year and 6 months’ imprisonment. On 30/12/2020 the Łódź Court of Appeal upheld the first-instance judgment (case no. II AKa 214/20). It sat in a panel of three judges, including Mr Paweł Urbaniak, who had been seconded to that court in accordance with a decision of the Minister for Justice. On 08/12/2022 the Supreme Court dismissed the applicant’s cassation appeal as manifestly ill-founded (case no. II KK 404/21).

Poland 18/04/2023 Stanisław BROŻYNA 1957 Głuszyca Polish Joanna KOWALIK On 23/02/2022 the Wałbrzych Regional Disciplinary Court for Hunters ( Okręgowy Sąd Łowiecki ) found the applicant guilty of shooting wild boars in the proximity of residential areas and excluded him from the Polish Hunting Association ( Polski Związek Łowiecki ), effectively barring him from hunting.
On 28/06/2022 the Main Disciplinary Court for Hunters ( Główny Sąd Łowiecki ) amended the characterisation of the applicant’s disciplinary offence but upheld the imposed penalty. On 21/12/2022 the Świdnica Regional Court dismissed the applicant’s appeal against that judgment (case no. IV Ko 146/22, served on 11/01/2023). It sat in a single-judge formation, composed of Mr Sebastian Kowalski, who had been seconded to that court in accordance with a decision of the Minister for Justice. 24. 26149/23 Orzechowski v. On 4/10/2022 the Lublin Court of Appeal upheld that judgment (case no. II AKa 227/21).
It sat in a panel of three judges, including Mr Stanisław Olchowy, who had been seconded to that court in accordance with a decision of the Minister for Justice. Poland 03/01/2024 Łukasz GIEDROJĆ 1986 Wronki Polish On 08/09/2021 the Węgrów District Court convicted the applicant of multiple instances of fraud and sentenced him to 4 years’ imprisonment. On 29/04/2022 the Siedlce Regional Court amended certain parts of the first-instance judgment and upheld the prison sentence (case no. II Ka 840/21). It sat in a panel of three judges, including Mr Paweł Mądry, who had been seconded to that court in accordance with a decision of the Minister for Justice.

Poland 14/09/2023 Krzysztof NAWROT 1981 Siewierz Polish On 30/06/2021 the applicant lodged an action for damages for allegedly unlawful arrest against the State Treasury with the Koszalin Regional Court. The case was initially assigned to Mr Ireneusz Łysiak, who – at the time – was seconded to that court in accordance with a decision of the Minister for Justice. On 2/03/2022 the Szczecin Court of Appeal dismissed the applicant’s length of proceedings complaint under the 2004 Act (case no. II S 2/22). It sat in a panel of three judges, including Mr Jacek Szreder, appointed to that court by the President of Poland on 06/05/2021, on recommendation of the National Council of the Judiciary (resolution no. 169/2021 of 18/02/2021).
On 10/02/2023 the Koszalin Regional Court dismissed the applicant’s claim for damages (case no. II Ko 91/21). It sat in a single-judge formation, composed of Judge Łysiak. On 24/03/2023 the applicant appealed against this judgment. On the same day, the Regional Court ordered him to submit an appeal prepared and signed by a lawyer, as required by the relevant procedural rules. The applicant submitted another appeal on 30/03/2023. On 31/05/2023 the Court of Appeal left the applicant’s appeal unexamined. It determined that the second appeal was also prepared by the applicant and only signed by his lawyer afterwards. On 26/07/2023 the Court of Appeal dismissed the applicant’s appeal against the decision of 31/05/2023 (case no. II AKa 99/23).
