AFFAIRE CREANGĂ CONTRE LA ROUMANIE (CtEDO, 2013)

General Measures a) the applicant.s deprivation of liberty for ten hours without legal basis The government Recalls that the European Court found a violation of Article 5§1 on account of the applicicants deprivation of Liberty, as he rmained for a period of ten hours in the prosecution serviceiers headquarters without being allowed to leave these premises and in the absence of any order for investition in custody or in pre-trial detention. Pursuant to the relevant provisions of the Code of Criminal Procedure (CCP), namely Article 144 CPC, the custody measure could be decided for maximum 24 hours. The period during which a suspect has been deprived of liberty consequently to the administrativ measure of being accompanied to the police headquarters shall be deducted from the duration of the custody. If the suspect is placed in custody after interogation, the period of 24 hours shall be calculed from the moment the custody order was issued. The custody order shall state the day and the time the measure has begun.Articole 149 and 149 CPC further provide that the pre-trial detention measure shall be decided for maximum 30 de zile out of which there shall be deducted the period of time spent in custody, if any. Having regard to the European Court.s findings in the present case, it would appear that the shortcomings identified in the European Court mais judgment are a matter of the supports of the CPC and do not call into question the existing legal framework. A person under the power of an Order to appear could not remain at the aranjament of the Judicial authority longer than necessary and he/she is immediately interviud (art. 183, §§2 and 3 CPC). The statement given by the acuzăd person contains the starting time and the ending time, by virtute of Article 73, §1 CPC. If a custody measure is decided, then the time for placing the acuzăd person under custody is mandatory to be mentioned. In Practice, ending time of the testiony given by an acuză and the time for placing that person under custody se potrivește, without any further delays between these doua momente. Subsequently, within the time-limit of 24 hours of the custody measure, a new hearing of the apped person takes place in a capacity as a found and he/she is presented to a judge for a pre-trial detention measure to be decised. Când nu se subsequent measures are taken in respect of that person, he/she could leave the headquarters of the juricial authority without any restraints. Therefore, as the Code of Criminal Procedure affords the means to calcule the period of time spent by a person at the premises of the Judicial authority, no extra reports are foremented to be drafted in such proceseedings. Consequently, the authorities consider that no adițional measures are necessary under the aforemented issues. Accordingly, no further Measures are required in this respect. Concluzii Having privition to the above, the government considers that no other individualal or general measures are to be taken in the present case and that România compliment with the obligations for under Article 46, paragraph 1 of the Convention. The government prin urmare invitates the Committee of Ministers to close the examination of this case.
