AGATONOVIĆ AND OTHERS v. SERBIA

Decizia nr. 59893/11 Stojan AGATONOVII împotriva Serbiei și a altor 101 de cereri (a se vedea lista anexată) Curtea Europeană a Drepturilor Omului (A doua secțiune), ședința la 17 decembrie 2013 în calitate de comitet compus din: Paulo Pinto de Albuquerque, președintele Dragoljub Popović, Helen Keller, judecători și Stanley Naismith, grefierul secțiunii Având în vedere cererile depuse la 12 septembrie 2011, având în vedere declarațiile oficiale care acceptă o soluționare prietenoasă a cazurilor, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIU O listă a reclamanților este prezentată în apendice. Toate acestea au fost reprezentate de același avocat, dl M. Moskovljević, un avocat practicant în Kruševac.

Guvernul sârb („Guvernul”) a fost reprezentat de agentul lor, dl S. Carić. Toate reclamanții sunt foști angajați ai aceleiași societăți social-deținute -Grație Evinsko preduzeće Jastrebac - de la Kruševac (denumit în continuare: debitorul). În cursul procedurii de insolvență împotriva debitorului la 11 Iulie 2003 Curtea Comercială Kraljevo a adoptat hotărâri (cazul intern nr. Sf.2505/02) conform căruia debitorul a fost ordonat să plătească reclamanților anumite sume. Reclamanții s-au plâns de neîndeplinirea acestor decizii în favoarea lor. Septembrie 2013 Guvernul a informat Curtea că a propus să facă o declarație în vederea rezolvării chestiunilor legate de cerere. Declarația prevăzută după cum urmează: „Declar că Guvernul Republicii Serbia este pregătit să accepte că a existat o încălcare a dreptului reclamantului în temeiul articolului 6 alineatul (1) din Convenție și al articolului 1 din Protocolul nr. 1 la Convenție.

Declar, în continuare, că în termen de trei luni, guvernul propune să plătească reclamanților enumerați mai jos, sumele atribuite în deciziile interne examinate în acest caz, mai puține sume care ar fi putut fi deja plătite pe baza acestor decizii. Aceste sume sunt plătite în termen de trei luni de la data depunerii deciziei Curții. Această plată va constitui rezoluția finală a cauzei. Guvernul regretă apariția acțiunilor care au dus la adoptarea prezentelor cereri.” La 15 octombrie 2013, Curtea a primit o scrisoare de către reprezentantul reclamantului informand Curții că au fost de acord cu termenii declarației guvernamentale. HOTĂRÂREA Curții consideră că, în conformitate cu art. 42 § 1 din Regulamentul Curții, cererile ar trebui să fie aderate, având în vedere situația lor de fapt și juridică similară.

Curtea constată că, în urma acordului expres al reclamanților cu termenii declarației formulate de Guvern, acest caz ar trebui considerat ca o soluție prietenoasă între părți. Curtea ia act de soluționarea prietenoasă atinsă între părți. Este satisfăcut că soluționarea se bazează pe respectarea drepturilor omului astfel cum este definită în Convenția și în Protocolurile sale și nu găsește motive pentru a justifica examinarea continuă a cererilor. Având în vedere cele de mai sus, este necesar să se scoată cazul din listă. Din aceste motive, Curtea decide în unanimitate pentru a se alătura cererilor; hotărăște să scoată cererile din lista sa de cazuri în conformitate cu art. 39 din Convenție.

DECISION Application no. 59893/11 Stojan AGATONOVIĆ against Serbia and 101 other applications (see list appended) The European Court of Human Rights (Second Section), sitting on 17 December 2013 as a Committee composed of: Paulo Pinto de Albuquerque, President , Dragoljub Popović, Helen Keller, judges , and Stanley Naismith, Section Registrar . Having regard to the above applications lodged on 12 September 2011, Having regard to the formal declarations accepting a friendly settlement of the cases, Having deliberated, decides as follows:

FACTS AND PROCEDURE

A list of the applicants is set out in the appendix. They were all represented by the same attorney, Mr M. Moskovljević, a lawyer practising in Kruševac. The Serbian Government (“the Government”) were represented by their Agent, Mr S. Carić. All applicants are former employees of the same socially-owned company - Građevinsko preduzeće Jastrebac - from Kruševac (hereinafter: the debtor). In the course of insolvency proceedings against the debtor on 11 July 2003 the Kraljevo Commercial Court adopted decisions (domestic case no. St.2505/02) according to which the debtor was ordered to pay the applicants certain sums. The applicants complained about the respondent State’s failure to enforce the said decisions rendered in their favour.

After unsuccessful friendly settlement negotiations, by letter dated 9 September 2013 the Government informed the Court that they proposed to make a declaration with a view to resolving the issues raised by the application. The declaration provided as follows: “I declare that the Government of the Republic of Serbia is ready to accept that there had been a violation of the applicants’ right under Article 6 paragraph 1 of the Convention and Article 1 of Protocol No. 1 to the Convention. I further declare that within three-month period the Government offer to pay to the applicants listed below, the sums awarded in the domestic decisions under consideration in this case, less any amounts which may have already been paid on the basis of the said decisions.

These sums shall be payable within three months from the date of delivery of the decision of the Court. This payment will constitute the final resolution of the case. The Government regret the occurrence of the actions which have led to the bringing of the present applications.” On 15 October 2013, the Court received a letter from the applicants’ representative informing the Court that they had agreed to the terms of the Government’s declaration. THE LAW The Court considers that, in accordance with Rule 42 § 1 of the Rules of Court, the applications should be joined, given their similar factual and legal background. The Court finds that following the applicants’ express agreement to the terms of the declaration made by the Government the case should be treated as a friendly settlement between the parties.

The Court takes note of the friendly settlement reached between the parties. It is satisfied that the settlement is based on respect for human rights as defined in the Convention and its Protocols and finds no reasons to justify a continued examination of the applications. In view of the above, it is appropriate to strike the case out of the list. For these reasons, the Court unanimously Decides to join the applications; Decides to strike the applications out of its list of cases in accordance with Article 39 of the Convention.
