Mai multe informații privind reclamanții și reprezentanții acestora (dacă există) pot fi găsite în apendicele de mai jos. Faptele cazurilor, astfel cum au fost prezentate de reclamanți, pot fi rezumate după cum urmează. Cererea nr. 37810/13 Prin hotărârea din 13 septembrie 2012 (care a devenit finală în absența recursului), Tribunalul Vaslui a condamnat reclamantul la cinci ani și cinci luni de închisoare. La 23 noiembrie 2011, reclamantul a fost arestat și reținut în Penitenciarul Bacău. Reclamantul a împărtășit o celulă cu o lățime de cinci metri și o lungime de șase metri cu zece deținuți. Erau 18 paturi în celulă. Saltelele au fost distruse, iar pereții erau murdari și plini de paturi de la bucăți uciși. Două zile după încarcerarea reclamantului, nouă deținuți au fost aduse în celulă și a treia zi patru deținuți au fost plasate. Reclamantul a trebuit să împărtășească patul cu un alt deținut. Au fost douăzeci și patru de deținuți în celulă, dintre care douăzeci erau fumatori. A fost o toaletă pentru douăzeci și patru deținuți. Alimentația era ineditabilă și a avut un miros rău. Începând cu 21 decembrie 2011, reclamantul a fost reținut în Penitenciarul Vaslui. Reclamantul a împărtășit o celulă cu o lungime de cinci metri și o lățime de trei metri cu cincizeci de deținuți, dintre care unii erau fumatori. Au fost douăsprezece paturi în celulă. Toaleta a măsurat 40 centimetri de lățime și 40 centimetri de lățime și mirosul a intrat în celulă. Raturi iese din toaletă și mănâncă provizii alimentare deținute. Saltelele au fost distruse și reclamantul a dormit direct pe structura de fier. Alimentația era incomdibilă și plină de nisip sau pietrișe. Reclamantul a fost mutat ulterior la noul Penitenciar Vaslui, unde a împărtășit o celulă pentru două persoane cu șase șapte deținuți. Reclamantul a ocupat un pat atât de aproape de tavan că a avut dificultăți de transformare. Pastă de denti, perie de dinti și săpun au fost furnizate la fiecare patru-cinci luni. Apa a fost furnizată în porții și a fost de calitate slabă. Reclamantul a căzut bolnav cu bronchitis și a început să aibă probleme din spate din cauza patului și a târcoalei în cameră. Reclamantul afirmă că el a fost abuzat în fiecare zi fizic și moral de către gardienii de închisoare. Ei a blestemat mama lui mort. Reclamantul s-a plâns de jurământ, dar i s-a spus să-și țină gura închisă altfel ar fi pedepsit și transferat în regim de detenție închis. Gardienii au numit, de asemenea, reclamantul "desactivat" și "stupid" și l-au lovit cu mâna pe spate sau cap. Reclamantul a avut frica de a raporta acest lucru, pentru a nu fi mutat din penitenciarul. De asemenea, reclamantul se plânge de transport cu vehiculele penitenciare în care deținuții au fost suprapopulați, trebuie să stea sau să stea pe o bancă de lemn pe coridorul mașinii. La 30 august 2013, reclamantul a fost interzis în Spitalul-Penitenciar Târgu-Ocna. Pe 13 septembrie 2013, reclamantul a fost concediat și transferat la penitenciarul Vaslui unde își îndeplinește în prezent condamnarea la închisoare. Reclamantul se plânge de degradarea starei sale de sănătate. Abia poate respira în seara. De la octombrie până în decembrie 2013, el a împărtășit patul cu un alt deținut. A pierdut un dinte din cauza unei pietre în alimentele sale și alți trei dinți riscă să cadă în curând. Aplicația nr. 56837/13 10. Reclamantul este în prezent reținut în Penitenciarul Miercurea Ciuc. Reclamantul se plânge de mărimea celulei (opt metri x cinci metri împărțițiți de 18 de deținuți). Din cele patruzeci de metri pătrați, opt metri pătrați sunt ocupați de baie și o toaletă. Paturile ocupă o altă suprafață de opt metri pătrați. Alimente inadecvate (poor în nutrienți) sunt servite deținuților. Nu există suficientă ventilație în celulă și temperaturi de până la 40 de grade Celsius în vara. Aplicația nr. 60992/13 11. La 11 martie 2013, reclamantul a fost arestat. 12. De la 11 martie 2013 la 14 aprilie 2013, reclamantul a fost reținut în Inspectorarea Poliției Galați. Reclamantul a ocupat celula nr. 12 din opt Pătrat de metri împreună cu alte cinci deținuți. Dușul a fost instalat pe partea de sus a scaunului de toaletă. Șobolanii ieseau din scaunul de toaletă. Celula a avut lumină naturală insuficientă. Ferestrele mici erau situate aproape de tavan și au fost blocate de două seturi de plasă. Lumina artificială era insuficientă, fiind furnizată de un bulb de intensitate redusă și comutatorul era în afara celulei. 13. Începând cu 14 aprilie 2013, reclamantul a fost reținut în Penitenciarul Galați într-o celulă de 15 metri pătrați împreună cu alte 15 deținute. Apa caldă este furnizată de două ori pe săptămână și apa rece de trei ori pe săptămână. Timpuri pe zi pentru o oră. Calitatea apei este slabă, și este umplută cu clor. Există un duș pentru toți oamenii deținuți într-o celulă. Există bucăți în cameră. Ferestrele care sunt destul de mici sunt blocate de două seturi de bare care reduce lumina naturală. COMPLAINT 14. Reclamanții se plâng în temeiul articolului 3 din Convenția privind tratamentul inuman sau degradant cauzat de condițiile de detenție în diferitele penitenciare românești. Întrebări Reclamanții au fost supuși, în încălcarea articolului 3 din Convenție, la tratamente inumane sau degradante în timpul încarcerării în diferite penitenciare din România? Guvernul este invitat să furnizeze informații cu privire la condițiile de detenție ale reclamanților în diferitele penitenciare românești, în special în ceea ce privește: (a) condițiile materiale ale celulelor reclamanților (dimensiunea acestora, numărul de paturi și numărul de persoane reținute în aceeași celulă cu reclamanții); (b) ventilația disponibilă în celule (numărul de ferestre, dimensiunea acestora, existența și dimensiunea plaselor și/sau a barelor metalice); (c) instalația sanitară disponibilă în celule; (d) măsurile luate pentru a asigura igiena în celule; (e) calitatea și cantitatea de alimente și apă puse la dispoziția reclamanților. În ceea ce privește cererea nr. 37810/13, Guvernul României este, de asemenea, invitat să furnizeze informații privind transportul reclamantului cu vehiculele penitenciare. The circumstances of the cases

The facts of the cases, as submitted by the applicants, may be summarised as follows.

By judgment of 13 September 2012 (which became final in the absence of appeal), the Vaslui Court of First Instance sentenced the applicant to five years and five months’ imprisonment.

On 23 November 2011, the applicant was arrested and detained in the Bacău Penitentiary. The applicant shared a cell having a width of five metres and a length of six metres with ten inmates. There were eighteen beds in the cell. The mattresses were destroyed, and the walls were dirty and full of stains from killed bedbugs. Two days after the applicant’s incarceration, nine more inmates were brought in the cell and the third day four inmates were placed. The applicant had to share the bed with another inmate. There were twenty four detainees in the cell, out of whom twenty were smokers. There was one toilet for twenty four detainees. The food was inedible and had a bad smell.

As of 21 December 2011, the applicant was detained in the Vaslui Penitentiary. The applicant shared a cell having a length of five metres and a width of three metres with fifteen detainees, of whom some were smokers. There were twelve beds in the cell. The toilet measured forty centimetres width and forty centimetres length and the smell was entering the cell. Rats were coming out of the toilet and eating the detainees’ food supplies. There were bedbugs. The mattresses were ruined and the applicant slept directly on the iron structure. The food was inedible and full of sand or pebbles. The applicant was subsequently moved to the new Vaslui Penitentiary, where he shared a cell for two persons with six-seven inmates. The applicant occupied a bed so close to the ceiling that he had difficulties turning. Tooth paste, tooth brush and soap were provided every four-five months. The water was supplied in portions and was of poor quality. The applicant fell ill with bronchitis and started having back problems because of the bed and the draught in the room.

The applicant states that he was abused every day physically and morally by the prison guards. They cursed his dead mother. The applicant complained about the swearing, but he was told to keep his mouth shut otherwise he would be disciplinarily punished and transferred to closed detention regime. The guards also called the applicant “disabled” and “stupid” and hit him with the hand on the back or the head. The applicant was afraid to report this, in order not to be moved from the penitentiary.

The applicant also complains of the transportation with the penitentiary vehicles in which the detainees were overcrowded, having to stand or to sit on a wooden bench on the corridor of the car.

On 30 August 2013, the applicant was interned in the Târgu-Ocna Hospital-Penitentiary.

On 13 September 2013, the applicant was discharged and transferred to the Vaslui Penitentiary where he is currently serving his imprisonment sentence. The applicant complains of the degradation of his health condition. He can barely breathe in the evening. From October to December 2013, he shared the bed with another detainee. He lost one tooth due to a pebble in his food and three other teeth risk to fall soon.

The applicant is currently detained in the Miercurea Ciuc Penitentiary. The applicant complains of the size of the cell (eight metres x five metres shared by eighteen inmates). Out of the forty square metres, eight square metres are occupied by the bathroom and a toilet. The beds occupy another surface of eight square metres. Inadequate food (poor in nutrients) is served to the prisoners. There is no sufficient ventilation in the cell and temperatures rise up to 40 degrees Celsius in summer.

On 11 March 2013, the applicant was arrested.

From 11 March 2013 to 14 April 2013, the applicant was detained in
the Police Inspectorate Galați. The applicant occupied cell no.
12 of eight
square metres together with other five detainees. The shower was installed on top of the toilet seat. Rats were coming out of the toilet seat. The cell had insufficient natural light. The small windows were located close to the ceiling and were blocked by two sets of net. The artificial light was insufficient, being supplied by a low intensity bulb and the switch was outside the cell.

Since 14 April 2013, the applicant has been detained in the Galați Penitentiary in a cell of fifteen square metres together with other fifteen
detainees. Hot water is provided twice a week and cold water three
times per day for an hour. The water quality is poor, and is filled with chlorine. There is one shower for all people detained in a cell. There are bedbugs in the room. The windows which are quite small are blocked by two sets of bars which reduce the natural light.

The applicants complain under Article 3 of the Convention of the inhuman or degrading treatment caused by the conditions of their detention in the different Romanian penitentiaries.
Have the applicants been subjected, in breach of Article
3 of the Convention, to inhuman or degrading treatment during their imprisonment in the different penitentiaries in Romania?
The Government are invited to provide information on the applicants’ conditions of detention in the different Romanian penitentiaries, in particular in connection with:
(a)
the material conditions of the applicants’ cells (their size, the number of beds and the number of persons being detained in the same cell with the applicants);
(b)
the ventilation available in the cells (number of windows, their size, the existence and size of nets and/or metal bars);
(c)
the sanitary installation available in the cells;
(d)
the measures taken to ensure the hygiene in the cells;
(e)
the quality and quantity of food and water made available to the applicants.
As regards application no. 37810/13, the Romanian Government are also invited to provide information on the applicant’s transportation with the penitentiary vehicles.
