ORTSUYEVA AND OTHERS v. RUSSIA (CtEDO, 2015)

Comunicat la 4 martie 2015 PRIMEA SECȚIUNE Cereri nr. 3340/08 și 24689/10 Zulay ORTSUYEVA și alții împotriva Rusiei și Khatimat MAGOMEDOVA și alții împotriva Rusiei depuse la 28 decembrie 2007 și, respectiv, 31 martie 2010 DECLARAREA FACTELOR Reclamanților sunt cincizeci de două resortisanți ruși enumerați în apendice. Ei locuiesc în satul Mesker-Yurt și Grozny, Chechenia. Reclamanții din cererea nr. 3340/08 sunt reprezentați în fața Curții de avocați din Stichting Russian Justice Initiative (SRJI), o ONG bazată în Țările de Jos cu un birou reprezentativ în Rusia (în parteneriat cu ONG-ul Astreya). Primul reclamant din cererea nr. 24689/10 este reprezentat de avocați din ONG-ul Dagestan „Borets za Spravedlivost”. Ceilalți trei solicitanți nu sunt reprezentați legal. Reclamanții în ambele cereri sunt rude apropiate de 17 oameni care au fost prinși între sfârșitul lunii mai și începutul lunii iunie 2002 de servitori din diferite părți ale satului Mesker-Yurt în timpul unei operații speciale a forțelor federale. Circumstanțele cererilor prezentate de solicitanți pot fi rezumate după cum urmează. Informații generale referitoare la ambele cereri Deducerea rudelor reclamanților La momentul material, satul Mesker-Yurt a fost sub noaptea de securitate. Pozițiile de verificare ale forțelor federale funcționau pe drumurile care conduceau la și de la decontare. Potrivit depunerii reclamanților, între 21 mai și 11 iunie 2002, servitorii forțelor federale au efectuat o operațiune de măcinare în Mesker-Yurt. Ei au blocat satul și au înființat o tabără temporară de filtrare la periferia așezării. Majoritatea rudelor reclamanților au fost prinse între 21 mai și 5 iunie 2002 fie din casele lor, fie din moscheea locală, unde s-au ascuns noaptea, credend că era un loc sigur. Unii dintre oamenii răpiți au fost luati din alte locații din sat. Toți bărbații reținuți în timpul operației speciale au fost duși la tabăra de filtrare și unele dintre ele au fost eliberate în următoarele zile. Circumstanțele răpirii rudelor reclamantului sunt similare și pot fi rezumate după cum urmează. Potrivit reclamanților, la sau în jurul valorii de 21 mai 2002, un grup mare de oameni înarmați mascați în uniformi de camuflaj și veste antiglonț a sosit în Mesker-Yurt în mai multe vehicule de personal blindat (APC) și alte vehicule militare, cum ar fi minivane UAZ și camione URAL și a intrat în casele reclamanților și moscheea. Unul dintre rudele reclamantului, dl Shaip (denumit, de asemenea, „Shoip”) Makhmudov, a fost răpit din câmpul din apropiere, unde a avut grijă de vaci. Vorbind rusesc neprezentat, servitorii au verificat documentele de identitate ale rezidenților și apoi au luat rudele reclamanților departe sub pretextul unei alte verificări de identitate. Ei au spus reclamanților că rudele lor vor fi eliberate după finalizarea cecului. Reclamanții au vizitat tabăra de filtrare în mai multe ocazii și au trecut mâncare rudelor lor prin intermediul servitorilor. Câteva zile mai târziu, potrivit reclamanților, organismul dlui Adam Temersultanov care a fost reținut în timpul operațiunii speciale a fost aruncat din vehiculul militar UAZ la periferia satului și găsit de colegii săteni. Celelalte șaisprezece oameni au fost transferate într-o locație necunoscută și reclamanții nu au avut nici o veste despre rudele lor dispărute după aceea. Ancheta oficială cu privire la răpirea rudelor reclamanților Reclamanții se plângeau de fiecare răpire la agențiile de aplicare a legii. În legătură cu plângerile lor, între iunie și iulie 2002, biroul procurorului din districtul Shali a deschis cazurile penale. 59114, 59125, 59126, 59127, 59128, 59129, 59133, 59134, 59135, 59136, 59168, 59164, 599166 și 59171 în temeiul articolului 126 din Codul Penal (aducție). Reclamanții nos. 11, 19, 24, 30 și 40 în cererea Ortsuyeva și alții și reclamantul nr. 3 în cererea Magomedova și alții au fost acordate dreptul de victimă în cadrul procedurii penale. La 6 august 2002, toate cazurile penale au fost aderate în cadrul cauzei comune nr. 59113. Procedura în acest caz, după suspendarea și reluarea în mai multe ocazii, s-a așteptat de câțiva ani fără a obține rezultate tangibile. Principalul motiv determinat de autoritățile de investigare pentru suspendarea cazului a fost faptul că nu s-a identificat infractorii. Reclamanții au solicitat, în numeroase ocazii, informații de la autoritățile de investigare cu privire la progresele înregistrate în cadrul procedurii. În răspuns, au primit scrisori formale care declară că ancheta a fost în curs de desfășurare. Potrivit reclamanților, nu au fost luate măsuri semnificative de către autoritățile pentru a investiga incidentul; anchetatorii nu au reușit să ia măsurile cele mai de bază, cum ar fi interogarea martorilor la răpirile și la serviciile implicate în operațiunea militară. Rezumatele faptelor pentru fiecare răpire sunt descrise mai jos. Fiecare dintre ele a fost perpetrat de la fiecare casă de familie în diferite străzi din Mesker-Yurt sau din moscheea satului, cu excepția răpirii domnului Shaip Makhmudov, care a fost luat de pe câmpul din apropiere în timp ce a avut grijă de bovine. După răpirea toți oamenii răpiți au fost dus la tabăra de filtrare temporară. Cererea nr. 3340/08 Ortsuyeva și alții c. Reclamanții sunt rude apropiate ale dlui Adam Gachayev: dna Petimat Gachayeva, care s-a născut în 2002, fiica; dna Radima Gachayeva, care s-a născut în 2000, fiica; Dna Zara Gachayeva, care s-a născut în 1964, sora Zulay Gachayeva, care s-a născut în 1939, mama; Sila Umkhayeva, care s-a născut în 1982, soția. Reclamanții trăiesc în Mesker-Yurt, Chechenya. Dl Adam Gachayev a fost răpit din casa sa (fără un număr) în strada Vishnevaya la 21 mai 2002. (c) Abducția dlui Aslan Israelov, care s-a născut în 1981, și dl Anzor Israelov, care s-a născut în 1984. Reclamanții sunt rude apropiate ale dlui Aslan și Anzor Istralov: 10. Frații dl Aslan Istralov și dl Anzor Istralov, au fost răpiți din casa lor în 71 Street Lenina, la 21 mai 2002. (d) Abducția dlui Ibragim Askhabov, care s-a născut în 1983. Reclamanții sunt rude apropiate ale dlui Ibragim Ashabov: 14. Dl Ayub Ashabov, care s-a născut în 1992; 15. Dl Elbek Ashabov, care s-a născut în 1985, frate; 16. Dl Mayrbek Askhabov, care s-a născut în 1987, fratele; 17. dna Aminat Askhabova, care s-a născut în 1963, mătușa; 18. dna Khava Ashabova, care s-a născut în 1989, sora. Sora reclamanților locuiesc în Mesker-Yurt, Chechenia. Dl Ibragim Ashabov a fost răpit din casa sa în 8 strada Checkhova la 22 mai 2002. Potrivit reclamantului nr. 17 (Ms Aminat Askhabova), în iunie 2002 a aflat că dl Askhabov a fost reținut în sediul departamentului Shali din interiorul (RoVD). Când a sosit la ROVD pentru a confirma aceste informații, i s-a spus că câteva zile înainte de vizita dlui Ibragim Askhabov a fost transferat într-o locație necunoscută. Nu este clar dacă reclamantul a furnizat aceste informații anchetei interne. Dna Larisa Temirkhanova, care s-a născut în 1969, sora. Reclamanții locuiesc în Mesker-Yurt, Chechenia. Dl Shaip Makhmudov a fost prins la 23 mai 2002 în timp ce a avut grijă de vacile de lângă sat. (f) Abducția dlui Sayd-Magomed Abubakarov, care s-a născut în 1982 Reclamanții sunt rude apropiate ale dlui Sayd-Magomed Abubakarov: 23. Elbek Abubakarov, născut în 1992 și locuiește în Mesker Yurt, fratele; 24. dna Elisa Abubakarova, născut în 1973 și trăiește în Grozny, sora; 25. dna Khedi Abubakarova, născut în 1975 și locuiește în Mesker Yurt, sora; Potrivit reclamantului nr. 24 (Ms Elisa Abubakarova), care a asistat la răpire, criminalii au sosit la casa lor în strada Lenina la 21 mai 2002 în două APC cu numere de înregistrare 588 și 466 și au luat dl Sayd-Magomed Abubakarov. (g) Abducția dlui Lechi Temirkhanov, care s-a născut în 1980 26. Reclamantul, Larisa Temirkhanova, s-a născut în 1969 și trăiește în Mesker-Yurt, Checnya. Ea este sora domnului Lechi Temirkahnov. Dl Lechi Temirkahnov a fost răpit din casa unchiului său (numărul este necunoscut) în strada Moskovskaya la 21 mai 2002. (h) Abducția domnului Apti Dedishov, care s-a născut în 1965, dl Abu Dedishov, care s-a născut în 1968, și dl Adam Dedishov, care s-a născut în 1971. Reclamanții sunt rude apropiate ale celor trei frați răpiți: 27. Dl Ali Dedishov, născut în 1991, fiul dlui Apti Dedishov; 28. Dna Luiza Dedishova, născut în 1973, soția dlui Apti Dedishov; 29. Dna Madina Dedishova, născut în 1975, sora lor; 30. dna Malika Dedishova, născut în 1938, mama lor; 31. Dna Zukhra Dedishova, născut în 1992, fiica dlui Apti Dedishov; 32. Dna Rozan Gaziyeva, născut în 1961, sora lor; 33. Dna Ayzan Makhmudkhadzhiyeva, născut în 1963, sora lor. Reclamanții locuiesc în Mesker-Yurt, Chechnya. Frații Apti, Abu și Adam Dedishov au fost răpiți simultan din casa lor în strada 6 Shkolnaya, la 22 mai 2002. (i) Suprafața dlui Suliman Magomadov, născut în 1978 și a dlui Salambek Magomadov, născut în 1980 Reclamanții sunt rude apropiate ale fraților răpiți: 34. dl Khazh-Murad Magomadov, născut în 2003 și locuiește în Mesker-Yurt, fiul dlui Salambek Magomadov; 35. dna Ayna Magomadova, născut în 1950 și trăiește în Mesker Yurt, mama lor; 36. Dna Raisa Magomadova, care s-a născut în 1973 și locuiește în Grozny, sora lor. Frații Suliman și Salambek Magomadov, au fost scoși din casa lor în strada 19 Shkolnaya la 25 mai 2002. (j) Abducția dlui Vakha Ibragimov, care s-a născut în 1975. Reclamanții sunt rude apropiate ale dlui Vakha Ibragimov: 37. Dl Khalid Ibragimov, care s-a născut în 1971, fratele; 38. Dl Vaid Ibragimov, care s-a născut în 1979, fratele; 39. Dl Valid Ibragimov, care s-a născut în 1969, fratele; 40. Dl Izhan Ibragimova, care s-a născut în 1949, mama; 41. Dl Milana Ibragimova, care s-a născut în 1983, sora. Reclamanții locuiesc în Mesker-Yurt, Chechenya. Dl Vakha Ibragimov a fost răpit din moscheea satului la 1 iunie 2002. (k) Abducerea dlui Abu Dudagov, care s-a născut în 1981 Reclamanții sunt rude apropiate ale dlui Abu Dudagov: 42. Doamna Petimat Molayeva, care s-a născut în 1935 și locuiește în Mesker Yurt, bunica; 43, doamna Rozan Molayeva, care s-a născut în 1959 și locuiește în Grozny, mama. Dl Abu Dudagov a fost luat de la moscheea satului la 5 iunie 2002. (l) Selectarea dlui Adam Temersultanov, care s-a născut în 1976, și descoperirea ulterioară a organismului său Reclamanții sunt rude apropiate ale dlui Adam Temersultanov: 44. Dna Malika Amkhadova, care s-a născut în 1947, mama; 45. Dna Marem Temersultanova, care s-a născut în 1982, sora. Ambele solicitanți locuiesc în Mesker-Yurt, Chechnya. La 25 mai 2002, dl Adam Temersultanov s-a dus la moscheea satului, unde a stat câteva zile în timpul operațiunii speciale care credeau că era un loc sigur. La 30 mai 2002, dl Temersultanov a fost dus pentru verificarea identitatii de către servitorii la punctul de control pe podul din vecinătatea moscheei și reținut. La 4 iunie 2002, colegii de satnici ai reclamanților au văzut unul dintre vehiculele militare UAZ cu corpul dlui Temersultanov în ea și serviciile aruncând corpul din vehicul. Reclamantul nr. 44 (Ms Malika Amkhadova) a susținut că atunci când a văzut ulterior corpul fiului său Adam Temersultanov, lipsea degetul mic pe mâna stângă. Cererea nr. 24689/10 Magomedova și alții c. Rusia Reclamanții nr. 1, 2, 3 și 4 sunt rude apropiate ale dlui Magomedrasul Magomedov: dna Khatimat Magomedova, care s-a născut în 1974, fiica; dna Madinat Magomedova, care s-a născut în 1977, fiica; dna Zukhra Dengayeva, care s-a născut în 1950, soția; dna Gadzidibir Magomedov, care s-a născut în 1972, fiul. Reclamanții locuiesc în Komsomolskoye, Dagestan. La 23 mai 2002, dl Magomedrasul Magomedov s-a dus la casa surorii sale din Mesker-Yurt, Chechenia cu prietenul său Dl Kh. M. A doua zi, când voiau să părăsească așezarea, au observat că Mesker Yurt a fost înconjurat de militari și toate drumurile care duceau la și din sat au fost blocate. La începutul lunii iunie (data exactă este necunoscută) Dl. Magomedov și domnul Kh. M. au fost spuse de servitori să meargă la moscheea satului și să se alăture celorlalți rezidenți care s-au adunat acolo. Dl Magomedov a fost luat de la moschea în aceeași zi și, cel mai probabil, dus la tabăra de filtrare temporară. Locul său rămâne necunoscut de atunci. În ceea ce privește domnul Kh. M., câteva zile mai târziu a fost permis să părăsească satul. COMPLAINTS În baza articolului 2 din Convenție, reclamanții susțin că agenții de stat au fost responsabili pentru răpirea și dispariția rudelor lor (denumite „persoanele absorbite” în apendicele , și în ceea ce privește dl Adam Temersultanov, pentru răpirea și uciderea ulterioară. Referindu-se la art. 3 din Convenție, reclamanții, în ambele cazuri, se plâng de durerea mentală severă pe care o suferă datorită indiferenței demonstrate de autoritățile naționale în legătură cu dispariția rudelor lor apropiate și a faptului că statul nu a efectuat o anchetă eficace asupra acestei chestiuni. Reclamanții, în ambele cazuri, susțin că detenția necunoscută a rudelor lor numită „persoanele îndepărtate” în apendice încălcă toate garanțiile prevăzute la art. 5 din convenție. Reclamanții, în ambele cazuri, se plâng în temeiul articolului 13 din convenție că nu au avut un remediu eficace în ceea ce privește plângerile în temeiul articolului 2 din convenție. Întrebarea către părți are dreptul la viață, astfel cum se garantează la art. 2 din Convenție, încălcat în ceea ce privește rudele reclamanților numite „persoanele îndepărtate” în apendice? având în vedere protecția procedurală a dreptului la viață (a se vedea Salman c. Turcia [GC], nr. 2886/93, § 104, CEDO 2000) VII), a fost investigația efectuată de autoritățile naționale suficientă pentru a îndeplini obligația lor de a efectua o anchetă eficace, conform articolului 2 din Convenție? Suferința mentală a reclamanților cauzată de dispariția rudelor lor a fost suficient de gravă pentru a constitui tratament inuman, în sensul articolului 3 din Convenție? Dacă este cazul, a existat încălcarea articolului 3 din Convenție în ceea ce privește reclamanții? Rudele reclamanților, numite „persoanele absorbite” în apendice, au fost private de libertate în sensul articolului 1 din Convenție? În cazul în care a avut loc o astfel de detenție, este în conformitate cu garanțiile articolului 5 5 din Convenție? Reclamanții dispuneau de soluții interne eficace în ceea ce privește plângerile lor în temeiul articolului 2, conform articolului 13 din Convenție? Guvernul este invitat să prezinte în apendice copii ale întregii dosare de anchetă în toate cazurile penale instituite în legătură cu răpirea rudelor reclamanților, numite „persoanele îndepărtate”, inclusiv următoarele cazuri: nr. 59113, 59114, 59125, 59126, 59127, 59128, 59129, 59133, 59134, 59135, 59136, 59138, 59163, 59164, 599166 și 59171. Guvernul este solicitat, în special, să furnizeze următoarele informații în ceea ce privește fiecare dintre cererile: (a) orice informații, susținute de documente relevante, care este capabilă să refuteze acuzațiile reclamanților că rudele lor au fost răpite de serviciile de stat; și, în orice caz, (b) o listă completă a tuturor acțiunilor de investigație luate în legătură cu plângerile reclamanților cu privire la răpirea rudelor lor, în ordinea cronologică, indicând datele și autoritățile implicate, precum și un scurt rezumat al constatărilor; precum și: (c) copii ale documentelor din dosarele de investigație în cazurile penale respective, cum ar fi, în special: (i) reclamațiile inițiale ale reclamanților cu privire la răpirea rudelor lor care au determinat deschiderea anchetei; (ii) decizia(e) de a iniția procedura penală; (iii) decizia(e) de a acorda reclamanților statutul de victimă în procedura penală, dacă este cazul; (iv) înregistrarea oricărui interviu al serviciilor de stat (de exemplu, serviciilor militare, administrația locală și ofițerii de poliție, serviciilor la blocajele de drum și punctele de control, angajații altor agenții de aplicare a legii, etc.) desfășurate în cadrul anchetei; (v) declarațiile martorilor oculari la răpirile, dacă este cazul; (vi) în cazul în care scenele crimei au fost examinate, experții și/sau examenele forense au fost ordonate în cursul anchetei, copii ale tuturor rapoartelor și constatărilor relevante ale experților; (vii) în cazul în care investigațiile au fost suspendate și redeschise, copii ale fiecărei decizii privind suspendarea/renunțarea procedurii și a documentelor care conțin motivele acestor decizii (cum ar fi ordinele procurorului de a relua investigația și de a lua măsuri de investigare); viii) orice alte documente relevante pentru stabilirea circumstanțelor factuale ale acuzațiilor și evaluarea eficacității investigațiilor penale. STATEMENT OF FACTS

The applicants are fifty two Russian nationals listed in the Appendix. They live in Mesker-Yurt village and Grozny, Chechnya. The applicants in the application no. 3340/08 are represented before the Court by lawyers from the Stichting Russian Justice Initiative (SRJI), an NGO based in the Netherlands with a representative office in Russia (in partnership with NGO Astreya). The first applicant in the application no. 24689/10 is represented by lawyers from the Dagestan NGO “Borets za Spravedlivost”. The other three applicants are not legally represented. The applicants in both applications are close relatives of seventeen men who were apprehended between the end of May and the beginning of June 2002 by servicemen from various parts of Mesker-Yurt village during a special operation of the federal forces.

The circumstances of the applications as presented by the applicants can be summarised as follows.

A.

General information pertaining to both applications

1.

Abduction of the applicants’ relatives

At the material time the village of Mesker-Yurt was under curfew. Checkpoints of the federal forces were functioning on the roads leading to and from the settlement.

According to the applicants’ submission, between 21 May and 11

June 2002 the servicemen of the federal forces conducted a sweeping-up operation in Mesker-Yurt. They blocked the village and set up a temporary filtration camp at the outskirts of the settlement. The majority of the applicants’ relatives were apprehended between 21 May and 5 June 2002 either from their homes, or from the local mosque, where they hid at night believing that it was a safe place. Some of the abducted men had been taken away from other locations in the village. All of the men detained during the special operation were taken to the filtration camp and some of them were released within the following few days.

The circumstances of the abduction of the applicant’s relatives are similar to each other and can be summarised as follows. According to the applicants, on or around 21 May 2002 a large group of masked armed men in camouflage uniforms and bullet-proof vests arrived in Mesker-Yurt in several armored personnel vehicles (APC) and other military vehicles such as UAZ minivans and URAL lorries and entered the applicants’ houses and the mosque. One of the applicant’s relatives, Mr Shaip (also spelled as “Shoip”) Makhmudov, was abducted from the nearby field where he was tending cows. Speaking unaccented Russian, the servicemen checked the residents’ identity documents and then took the applicants’ relatives away under the pretext of a further identity check. They told the applicants that their relatives would be released after completion of the check.

The applicants visited the filtration camp on several occasions and passed food to their relatives via the servicemen. Few days later, according to the applicants, body of Mr Adam Temersultanov who had been detained during the special operation was thrown out from the military UAZ vehicle at the outskirts of the village and found by the fellow villagers. The other sixteen men were transferred to an unknown location and the applicants have had no news of their missing relatives thereafter.

2.

Official investigation into the abduction of the applicants’ relatives

The applicants complained of each abduction to law enforcement agencies. In connection with their complaints, between June and July 2002 the Shali district prosecutor’s office opened criminal cases nos.

59114, 59125, 59126, 59127, 59128, 59129, 59133, 59134, 59135, 59136, 59138, 59163, 59164, 59166 and 59171 under Article 126 of the Criminal Code (abduction). The applicants nos. 11, 19, 24, 30 and 40 in the application

Ortsuyeva and Others

and the applicant no. 3 in the application

Magomedova and Others

were granted victim status in the criminal proceedings.

On 6 August 2002 all the criminal cases were joined under the joint case no.

On a number of occasions the applicants requested information from the investigative authorities about the progress in the proceedings. In reply they received formal letters stating that the investigation was in progress. According to the applicants, no meaningful steps have been taken by the authorities to investigate the incident; the investigators failed to take the most basic steps, such as questioning of the witnesses to the abductions and of the servicemen involved in the military operation.

B.

Peculiarities of the individual applications

Summaries of the facts for each abduction are outlined below. Each of them was perpetrated from either family houses in various streets in Mesker-Yurt or from the village mosque, save for the abduction of Mr

Shaip Makhmudov who had been taken away from the nearby field while tending cattle. After the abduction all of the abducted men were taken to the temporary filtration camp.

Abduction of Mr Islam Ortsuyev, who was born in 1980

The applicants are close relatives of Mr Islam Ortsuyev:

The applicants are close relatives of Mr Ibragim Askhabov:

The applicants live in Mesker-Yurt, Chechnya. Mr Ibragim Askhabov was abducted from his house in 8 Checkhova Street on 22 May 2002.

According to the applicant no. 17 (Ms Aminat Askhabova), in June 2002 she learned that Mr Askhabov was detained on the premises of the Shali district department of the interior (the ROVD). When she arrived at the ROVD to confirm this information, she was told that a few days prior to her visit Mr Ibragim Askhabov had been transferred to an unknown location. It is unclear whether the applicant provided this information to the domestic investigation.

(e)

Abduction of Mr Shaip Makhmudov (also spelled as Shoip), who was born in 1980

The applicants are close relatives of Mr Shaip Makhmudov:

The applicants are close relatives of Mr Sayd-Magomed Abubakarov:

Abduction of Mr Lechi Temirkhanov, who was born in 1980

26.

The applicant, Ms Larisa Temirkhanova, was born in 1969 and lives in Mesker-Yurt, Checnya. She is the sister of Mr Lechi Temirkahnov.

Mr Lechi Temirkahnov was abducted from his uncle’s house (the number is unknown) in Moskovskaya Street on 21 May 2002.

Abduction of Mr Apti Dedishov, who was born in 1965, Mr Abu Dedishov, who was born in 1968, and Mr Adam Dedishov, who was born in 1971

The applicants are close relatives of the three abducted brothers:

The brothers Apti, Abu and Adam Dedishov were abducted simultaneously from their house in 6 Shkolnaya Street on 22 May 2002.

The applicants are close relatives of the abducted brothers:

Abduction of Mr Adam Temersultanov, who was born in 1976, and subsequent discovery of his body

The applicants are close relatives of Mr Adam Temersultanov:

Both applicants live in Mesker-Yurt, Chechnya.

On 25 May 2002 Mr Adam Temersultanov went to the village mosque, where he stayed for several days during the special operation believing that it was a safe place. On 30 May 2002 Mr Temersultanov was taken for identity check by servicemen to the checkpoint on the bridge in the vicinity of the mosque and detained. On 4 June 2002 the applicants’ fellow villagers saw one of the military UAZ vehicles with Mr Temersultanov’s body in it and the servicemen throwing the body out of the vehicle. The applicant no.

44 (Ms Malika Amkhadova) submitted that when she had subsequently seen the body of her son Adam Temersultanov, he was missing the little finger on the left hand.

2.

Application no. 24689/10 Magomedova and Others v.

Russia

The applicants nos. 1, 2, 3 and 4 are close relatives of Mr Magomedrasul Magomedov:

1.

Ms Khatimat Magomedova, who was born in 1974, the daughter;

2.

Ms Madinat Magomedova, who was born in 1977, the daughter;

3.

Ms Zukhra Dengayeva, who was born in 1950, the wife;

4.

Mr Gadzhidibir Magomedov, who was born in 1972, the son.

The applicants live in Komsomolskoye, Dagestan.

On 23 May 2002 Mr Magomedrasul Magomedov went to his sister’s house in Mesker-Yurt, Chechnya with his friend Mr Kh. M. The next day, when they wanted to leave the settlement, they noticed that Mesker

‑

Yurt was surrounded by military servicemen and all the roads leading to and from the village were blocked. In early June (the exact date is unknown) Mr

Magomedov and Mr Kh. M. were told by the servicemen to go to the village mosque and join the other residents who had gathered there. Mr

Magomedov was taken away from the mosque on the same day and, most probably, taken to the temporary filtration camp. His whereabouts remain unknown since. As for Mr Kh. M., a few days later he was allowed to leave the village.

COMPLAINTS

1.

Relying on Article 2 of the Convention, the applicants allege that State agents were responsible for the abduction and disappearance of their relatives (referred to as “abducted persons” in the Appendix

)

, and in respect of Mr Adam Temersultanov, for his abduction and subsequent killing. The applicants further complain that the authorities failed to carry out an effective investigation into the matter.

2.

Referring to Article 3 of the Convention, the applicants in both cases complain of the severe mental distress they suffer due to the indifference demonstrated by the national authorities in connection with the disappearance of their close relatives and the State’s failure to conduct an effective investigation into the matter.

3.

The applicants in both cases submit that the unacknowledged detention of their relatives referred to as “abducted persons” in the Appendix violates all of the guarantees of Article 5 of the Convention.

4.

The applicants in both cases complain under Article 13 of the Convention that they did not have an effective remedy in respect of their complaints under Article 2 of the Convention.

QUESTIONS TO THE PARTIES

1.

Has the right to life, as guaranteed by Article 2 of the Convention, been violated in respect of

the applicants’ relatives referred to as “abducted persons” in the Appendix? Having regard to the procedural protection of the right to life (see

Has the applicants’ mental suffering caused by their relatives’ disappearance been sufficiently serious to amount to inhuman treatment, within the meaning of Article 3 of the Convention? If so, has there been a breach of Article 3 of the Convention in respect of the applicants?

Were the applicants’ relatives, referred to as “abducted persons” in the Appendix, deprived of liberty within the meaning of Article

5

1 of the Convention? If such detention took place, was it in compliance with the guarantees of Article 5

4.

Did the applicants have at their disposal effective domestic remedies in respect of their complaints under Article 2, as required by Article 13 of the Convention?

The Government are requested to submit copies of the entire investigation files in all criminal cases instituted in relation to the abduction of the applicants’ relatives referred to as “abducted persons” in the Appendix, including the following cases: nos. 59113, 59114, 59125, 59126, 59127, 59128, 59129, 59133, 59134, 59135, 59136, 59138, 59163, 59164, 59166 and 59171.

The Government are, in particular, requested to provide the following information in respect of each of the applications:

(a)

any information, supported by relevant documents, which is capable of rebutting the applicants’ allegations that their relatives

had been

abducted by State servicemen;

and, in any event,

(b)

a complete list of all investigative actions taken in connection with the applicants’ complaints about the abduction of their relatives, in the chronological order, indicating dates and the authorities involved, as well as a brief summary of the findings;

as well as:

(c)

copies of documents from the investigation files in respective criminal cases, such as, in particular:

(i)

the applicants’ initial complaints about the abduction of their relatives which had prompted the opening of the investigation;

(ii)

decision(s) to initiate criminal proceedings;

(iii)

decision(s) to grant the applicants victim status in the criminal proceedings, if any;

(iv)

record(s) of any interviews of State servicemen (such as, for instance, military servicemen, local administration and police officers, servicemen at roadblocks and checkpoints, employees of other law enforcement agencies, etc.) held in connection with the investigation;

(v)

statements of the eye witnesses to the abductions, if any;

(vi)

if crime scene (s) were examined, expert and/or forensic examinations were ordered in the course of the investigation, copies of all the relevant expert reports and findings;

(vii)

where the investigations were suspended and reopened, copies of each and every decision on suspension/resumption of the proceedings and of the documents containing the reasons for such decisions (such as prosecutor’s orders to resume investigation and take investigative steps);

(viii)

any other documents relevant for the establishment of the factual circumstances of the allegations and the evaluation of the effectiveness of the criminal investigations.
