Al Nashiri împotriva României

Comunicat la 18 septembrie 2012 și 26 mai 2015 THIRD SECTION Cererea nr. 33234/12 Abd Al Rahim Husseyn Muhammad AL NASHIRI împotriva României depusă la 1 iunie 2012 Faptele și plângerile în acest caz au fost rezumate în Declarația faptelor și întrebărilor părților, care este disponibilă pe HUDOC. Având în vedere întrebările prezentate în Declarația faptelor și întrebărilor părților, Guvernul este invitat să formuleze observații cu privire la evoluțiile recente, în special cele menționate în scrisoarea reprezentantului reclamantului din 27 martie 2015, precum și la declarațiile conexe publicate la 22 aprilie 2015 de Der Spiegel Versiunea online a ziarului.

Guvernul este, de asemenea, invitat să prezinte observații cu privire la acest caz în lumina hotărârii Curții în cazul Al Nashiri c. Polonia (nr. 28761/11, 24 iulie 2014). Guvernul este invitat să prezinte o copie a documentelor dosarului penal menționate în scrisorile nr. 716/C2/2012 din 19 octombrie 2012 și 18 iunie 2013 trimise de Procuror la Curtea Înaltă de Casare și Justiție Ministerului Afacerilor Externe, a căror copie a fost adăugată la Observațiile Guvernului din 11 decembrie 2012 și 5 iulie 2013.

QUESTIONS 1. Having regard to the questions contained in the Statement of facts and Questions to the parties, the Government are invited to comment on the recent developments, notably those referred to in the letter of the applicant’s representative of 27 March 2015, as well as on the related statements published on 22 April 2015 by Der Spiegel newspaper online version. The Government are also invited to submit comments on the present case in the light of the Court’s judgement in the case Al Nashiri v. Poland (no. 28761/11, 24 July 2014). 2. The Government are asked to submit a copy of the documents of the criminal file referred to in the letters nos.
