Kralj împotriva Croației

Comunicat la 8 septembrie 2015 SECȚIUNE Cererea nr. 12407/15 Nada KRALJ și alții împotriva Croației depusă la 6 martie 2015 DECLARAREA FACTELOR O listă a reclamanților este prezentată în apendice. Circumstanțele cazului Faptele cazului, astfel cum au fost prezentate de solicitanți, pot fi rezumate după cum urmează. La 18 august 1995, tatăl reclamanților, J.M., a fost ucis de trei oameni îmbrăcați în uniforme de camuflaj. A fost deschisă o anchetă în acest sens și se pare că este încă în așteptare. Reclamanții se plâng în temeiul aspectului procedural al articolelor 2 și 14 din Convenție că ancheta privind moartea tatălui lor nu a fost eficace și că motivul pentru uciderea sa, care a avut loc numai din cauza originei etnice sârbe, nu a fost investigat.

De asemenea, în conformitate cu art. 13 din Convenție, în legătură cu art. 2 din Convenție, acestea se plâng că nu au avut niciun remediu eficace. [GC], nr. 2886/93, ECHR 2000-VII), s-a efectuat o anchetă în acest caz de către autoritățile interne, conform cerințelor prevăzute la art. 2 din convenție? Autoritățile relevante au respectat obligația procedurală în temeiul articolului 14 din Convenție de a investiga dacă există vreun motiv în spatele crimelor rudelor apropiate ale reclamanților care ar putea fi legate de originea lor sârbă (a se vedea mutatis mutandis Šečić c. Croația , nr. 40116/02, § 66, CEDO 2007 VI)? Reclamanții au la dispoziția lor un remediu intern eficient pentru plângerile lor din Convenția, conform articolului 13 din Convenția?

STATEMENT OF FACTS

A list of the applicants is set out in the appendix. The circumstances of the case The facts of the case, as submitted by the applicants, may be summarised as follows. On 18 August 1995 the applicants’ father, J.M., was killed by three men dressed in camouflage uniforms. An investigation has been opened in that respect and it appears that it is still pending. COMPLAINTS The applicants complain under the procedural aspect of Articles 2 and 14 of the Convention that the investigation into the death of their father was not effective and that the motive for his killing, which occurred only because of his Serbian ethnic origin, was not investigated. They also complain under Article 13 of the Convention, in conjunction with Article 2 of the Convention, that they had no effective remedy.

QUESTIONS TO THE PARTIES

1. Having regard to the procedural protection of the right to life (see paragraph 104 of Salman v. Turkey [GC], no. 21986/93, ECHR 2000-VII), has there been an investigation in the present case by the domestic authorities, complying with the requirements under Article 2 of the Convention? 2. Have the relevant authorities complied with their procedural obligation under Article 14 of the Convention to investigate whether there was any motive behind killings of the applicants’ close relatives that might be related to their Serbian origin (see, mutatis mutandis , Šečić v. Croatia , no. 40116/02, § 66, ECHR 2007 ‑ VI)? 3. Do the applicants have at their disposal an effective domestic remedy for their Convention complaints, as required by Article 13 of the Convention?
