CASE OF KARÁCSONY AND OTHERS v. HUNGARY

Reclamanții, dl Gergely Karácsony, dl Péter Szilágyi, Dávid Dorosz și dna Rebeka Katalin Szabó, s-au născut în 1975, 1981, 1985 și 1977 respectiv și trăiesc în Budapesta. 11. În momentul material, reclamanții erau membri ai parlamentului și al partidului de opoziție Párbeszéd Magyarországért (Dialogu pentru Ungaria). Dl Szilágyi a fost, de asemenea, unul dintre notarii Parlamentului. 12. Într-o sesiune plenară din 30 aprilie 2013, în cadrul unui discurs de pre-agenda, un membru al parlamentului opozitiv al Partidului Socialist maghiar a criticat guvernul și a acuzat-o de corupție în ceea ce privește, printre altele, reorganizarea pieței tutunului. Dl Zoltán Cséfalvay, Secretarul de Stat pentru Economia Națională, răspundea în numele Guvernului atunci când reclamanții dl Karácsony și dl Szilágyi au dus în centrul Camerei o carte mare care a arătat cuvintele „FIDESZ [partidul în Guvern] furați, vă înșelați și vă mințițiți”. Apoi, au pus-o lângă secretarul de stat. 13. Procesul-verbal al sesiunii a citit după cum urmează: „Dr. Zoltán Cséfalvay, Secretarul de Stat pentru Economia Națională: ... Spune-le că creșterea salariilor mărfurilor afectează în special persoanele cu un venit minim, deoarece venitul minim a fost crescut cu 5,4 %, ceea ce este imposibil de a continua cu inflația mai mică de 3,5 %. Și spune-le, de asemenea... (Gergely Karácsony și Péter Szilágyi arată o plasă care afișează cuvintele "FIDESZ furi, trișezi, și minți.". – Intervenții de la parlamentarii guvernamentali: - Reguli de procedură! Doctore! Speaker sună clopotul.) Speaker: Honorable Parlament! (Intervenții constante de la parlamentarii guvernamentali. Gergely Karácsony și Péter Szilágyi pun pachetul lângă pulpitul speakerului.) Solicit dlui Gergely Karácsony să îndepărteze pachetul în același mod în care au adus-o. Vă rugăm să continuați dl Secretar de Stat! (Intervenții de la parlamentarii guvernamentali: Cum au putut obține asta în? – [Speaker] sună clopotul.]” 14. La 6 mai 2013, orașul a prezentat o propunere de amendare a dlui Karácsony 50.000 de forints maghiari (HUF); echivalent cu 170 EUR) și a dlui Szilágyi HUF 185.520 (600 EUR) pentru comportamentul lor, înregistrat în minută și considerat grav ofensiv pentru ordinea parlamentară, în aplicarea articolului 49 alineatul (4) și a articolului 49 alineatul (7) din Legea Parlamentului. Președintele propune aplicarea unei amenzi maxime (o treime din remunerația sa lunară) în ceea ce privește dl Szilágyi, deoarece a fost ales oficial al Parlamentului și nu a fost doar un diputat obișnuit. Nu au fost furnizate alte motive în propunere. O decizie de aprobare a propunerii președintelui a fost adoptată de plenară la 13 mai 2013, fără dezbatere. 15. La 21 mai 2013 în timpul votului final asupra proiectului de lege nr. T/10881 de modificare a anumitor Acte legate de tutun, reclamanții dl Dorosz și dna Szabó au intrat în centrul camerei și au prezentat acolo o pancartă mare care a arătat cuvintele „Aici Operaționează Mafia Națională a Tutunului”. 16. Procesul-verbal al sesiunii se citește după cum urmează: „Vorbește: ... Întreb onorabilul Parlament dacă adoptă proiectul de lege T/10881 în conformitate cu propunerea consolidată, astfel cum a fost modificată acum. Vă rog să votați! (Voting) proclam decizia: Parlamentul a (domnii Dávid Dorosz și dna Rebeka Szabó afișează un banner cu cuvintele „Aici opera Mafia Națională din Tutun”) adoptat proiectul de lege cu 222 de voturi în favoarea, 81 de voturi împotrivă și 1 abținere. (Aplauze de la parlamentarii FIDESZ). Amintesc atenția celor doi deputați ai Parlamentului asupra faptului că comportamentul lor constituie o perturbare gravă a procedurii plenare. Vă informez în consecință că Regulamentul de procedură și art. 49 alineatul (4) din Legea Parlamentului (aplauze continue de către membrii Partidului Socialist maghiar) sancționează o astfel de conduită. (Dr. István Józsa. – Vrem legislație împotriva Mafiei!) Îi cer colegilor mei să dezleagă și să îndepărteze bannerul. (Dávid Dorosz și Rebeka Szabó nu dă deasupra bannerului către ofițer. - Pauză scurtă. – Tare zgomot de la diputații de opoziție.) Vă rugăm să ajutați doamna și domnilor, deputații de Parlament, să îndepărteze draperiile. (Dávid Dorosz și Rebeka Szabó părăsesc sesiunea). Mulțumesc foarte mult.” 17. La 24 mai 2013, Președintele a prezentat o propunere de amendare a dlui Dorosz și a dnei Szabó HUF 70.000 EUR (240 EUR) fiecare pentru conduita lor, înregistrată în procesul-verbal și considerată ofensivă gravă pentru ordinea parlamentară, în aplicarea art. 49 alineatele (4) și (7) din Legea Parlamentului. Propunerea a afirmat că este necesară o amendă sporită, deoarece s-a produs o conduită gravă similară. Nu au fost specificate alte motive în propunere. Plenarul a adoptat propunerea la 27 mai 2013 fără dezbatere. 18. Reclamanții, dna Bernadett Szél, dna Ágnes Osztolykán și dna Szilvia Lengyel, s-au născut în 1977, 1974 și 1971 și trăiesc în Budakeszi, Budapesta și, respectiv, Gödöllő. 19. În momentul material, reclamanții erau membri ai parlamentului și a partidului de opoziție LMP (Politica poate fi diferită). 20. La 21 iunie 2013, Parlamentul a avut un vot final asupra unei noi legi, proiect de lege nr. T/7979 privind transferul de terenuri agricole și forestiere. Propunerea legislativă a fost destul de controversată și a generat motive încălzite între membrii opoziției. În protest în timpul votului final asupra proiectului de lege, dna Lengyel a plasat o mică roată de aur plină cu sol pe masa în fața primului ministru, în timp ce dna Szél și dna Osztolykán au dezvoltat o banner care a arătat cuvintele „Districția terenului în loc de jaf de teren” în fața pulpitului speakerului; între timp, dna Lengyel a folosit un megafon pentru a vorbi. În cursul dezbaterii detaliate și a unui discurs în dezbaterea finală a proiectului de lege, a prezentat trei propuneri de modificare și a prezentat două propuneri de modificare chiar înainte de votul final. 21. Procesul-verbal al sesiunii se citește după cum urmează: „Vorbește: Următorul punct de ordine de zi este votul asupra amendamentelor prezentate înainte de votul final asupra proiectului de lege agricolă și forestieră și asupra votului final. Deputații Parlamentului au primit proiectul de lege la numărul T/7979 și textul consolidat al proiectului de lege la numărul T/9797/2610. În primul rând vom vota amendamentele. Adoptarea lor necesită o majoritate calificată. (interrupție continuă a sesiunii) ... Speaker: Deoarece membrii lui Jobbik [partidul de opoziție] nu îmi permite să-mi iau poziția la pulpitul Speakerului, voi continua să prezid sesiunea de aici. (Aplauze puternice de la grupul parlamentar de guvernare). Deoarece membrii lui Jobbik nu permit membrului stâng, al partidului de opoziție și al notarului să stea la [pulpitul orașului] în timpul votului prin apel nominal și să efectueze votul și să proclame rezultatele ( zgomot continuu). Solicit deputaților Parlamentului să ia loc și să mă asculte! Solicit Parlamentului să confirme că, întrucât membrii lui Jobbik nu permit votul cu apel nominal, vom vota electronic. (Aplauze puternice de la grupul parlamentar de guvernare. Intervenții din aceeași parte: Hurray!). Hotărâți deputați! Vă cer tuturor care sunt de acord, având în vedere circumstanțele neobișnuite, să votați prin vot electronic, în loc să votați cu apel nominal. (Membrii grupului parlamentar Jobbik ocupă scaunul președintelui, cântând „Trădătoare, trădătoare” pentru câteva minute. Szilvia Lengyel plasează o mică rulotă de aur plină de sol pe masă în fața Primului Ministru. Dr. Bernadett Szél și Ágnes Osztolykán [reclamanții] desfășoară o banneră care conține cuvintele „Distribuție de teren în loc de jaf de teren!” în fața pulpitului speakerului). La 25 iunie 2013, Președintele a prezentat o propunere de amendare a dnei Szél și a dnei Lengyel HUF 131.400 (430 EUR) fiecare și a dnei Osztolykán HUF 154.000 (510) pentru comportamentul lor, înregistrat în minuta de procedură și considerat grav ofensiv pentru ordinea parlamentară, în aplicarea articolului 49 alineatul (4) și a articolului 49 alineatul (7) din Legea Parlamentului. 23. Președintele propune aplicarea amenzii maxime, având în vedere situația extraordinară care s-a dezvoltat în timpul procesului de votare și faptul că diputații s-au implicat în desfășurarea unui mod grav ofensiv în ordinea parlamentară prin afișarea bannerului și folosirea unui megafon. O decizie de aprobare a propunerii Președintelui a fost adoptată de plenară la 26 iunie 2013, fără dezbatere.

The applicants, Mr Gergely Karácsony, Mr Péter Szilágyi, Mr Dávid Dorosz and Ms Rebeka Katalin Szabó, were born in 1975, 1981, 1985 and 1977 respectively and live in Budapest. 11. At the material time the applicants were members of parliament and of the opposition party Párbeszéd Magyarországért (Dialogue for Hungary). Mr Szilágyi was also one of the notaries to Parliament. 12. At a plenary session on 30 April 2013, during a pre-agenda speech, an opposition member of parliament from the Hungarian Socialist Party criticised the Government and accused it of corruption with regard to, inter alia, the reorganisation of the tobacco market. Mr Zoltán Cséfalvay, the Secretary of State for the National Economy, was replying on behalf of the Government when the applicants Mr Karácsony and Mr Szilágyi carried into the centre of the Chamber a large placard displaying the words “FIDESZ [the party in Government] You steal, you cheat, and you lie.” Subsequently, they placed it next to the Secretary of State’s seat. 13. The minutes of the session read as follows: “Dr Zoltán Cséfalvay, the Secretary of State for the National Economy: ... Tell them that the increase of commodity wages particularly affects those with a minimum income, since the minimum income has been increased by 5.4 %, which is impossible to keep up with inflation lower than 3.5%. And tell them also ... (Gergely Karácsony and Péter Szilágyi show a placard displaying the words “FIDESZ You steal, you cheat, and you lie.". – Interventions from the government MPs: - Rules of procedure! Doctor! The Speaker rings the bell.) Speaker: Honourable Parliament! (Constant interventions from the government MPs. Gergely Karácsony and Péter Szilágyi place the placard next to the speaker’s pulpit.) On 6 May 2013 the Speaker presented a proposal to fine Mr Karácsony 50,000 Hungarian forints ((HUF); equivalent to EUR 170) and Mr Szilágyi HUF 185,520 (EUR 600) for their conduct, as recorded in the minutes and considered to be gravely offensive to parliamentary order, in application of sections 49(4) and 49(7) of the Parliament Act. The Speaker proposed that as regards Mr Szilágyi the maximum fine (a third of his monthly remuneration) be applied, since he had been elected an official of Parliament and was not just an ordinary MP. No other reasons were given in the proposal. A decision approving the Speaker’s proposal was adopted by the plenary on 13 May 2013, without debate. 15. On 21 May 2013 during the final vote on Bill no. T/10881 amending certain tobacco-related Acts the applicants Mr Dorosz and Ms Szabó carried into the centre of the Chamber and displayed there a large banner displaying the words “Here Operates the National Tobacco Mafia”. 16. The minutes of the session read as follows: “Speaker: ... I ask the Honourable Parliament whether it adopts Bill T/10881 in accordance with the consolidated proposal as amended just now. Please vote! (Voting) I proclaim the decision: Parliament has (Mr Dávid Dorosz and Ms Rebeka Szabó display a banner with the words “Here Operates the National Tobacco Mafia”) adopted the Bill with 222 votes in favour, 81 against and 1 abstention. (Applause from FIDESZ MPs). I call the attention of the two Members of Parliament to the fact that their conduct constitutes a grave disruption of the plenary proceedings. I inform you accordingly that the Rules of Procedure and section 49(4) of the Parliament Act (continuous applause from members of the Hungarian Socialist Party) sanction such conduct. (Dr István Józsa. – We want legislation against the Mafia!) I ask my colleagues to untie and remove the banner. (Dávid Dorosz and Rebeka Szabó do not hand over the banner to the usher. – Short break. – Loud noise from the opposition MPs.) On 24 May 2013 the Speaker submitted a proposal to fine Mr Dorosz and Ms Szabó HUF 70,000 (EUR 240) each for their conduct, as recorded in the minutes and considered to be gravely offensive to parliamentary order, in application of sections 49(4) and 49(7) of the Parliament Act. The proposal stated that an increased fine was necessary since similar seriously disruptive conduct had occurred before. No other reasons were specified in the proposal. The plenary adopted the proposal on 27 May 2013 without debate. 18. The applicants, Ms Bernadett Szél, Ms Ágnes Osztolykán and Ms Szilvia Lengyel, were born in 1977, 1974 and 1971 and live in Budakeszi, Budapest and Gödöllő respectively. 19. At the material time the applicants were members of parliament and of the opposition party LMP (Politics Can Be Different). 20. On 21 June 2013 Parliament held a final vote on a new law, Bill no. T/7979 on the Transfer of Agricultural and Forestry Land. The legislative proposal was quite controversial and generated heated reactions among opposition members. In protest during the final vote on the bill, Ms Lengyel placed a small, golden wheelbarrow filled with soil on the table in front of the Prime Minister, while Ms Szél and Ms Osztolykán unfurled a banner displaying the words “Land distribution instead of land robbery!” in front of the Speaker’s pulpit; meanwhile, Ms Lengyel used a megaphone to speak. She had previously delivered two speeches during the detailed debate and one speech during the final debate on the bill, filing three amending motions, and introduced two amending proposals just before the final vote. 21. The minutes of the session read as follows: “Speaker: The next point on the agenda is the vote on the amendments submitted prior to the final vote on the Transfer of Agricultural and Forestry Land Bill and the final vote. Members of Parliament have received the Bill under number T/7979 and the consolidated text of the Bill under number T/9797/2610. First we shall vote on the amendments. Their adoption requires a qualified majority. (continuous disruption of the session) ... Speaker: Because the members of Jobbik [opposition party] do not allow me to take my position at the Speaker’s pulpit, I will continue presiding over the session from here. (Strong applause from the ruling parliamentary group). Because members of Jobbik are not allowing the left-wing, opposition party member and notary to sit at [the Speaker’s pulpit] during the vote by roll call and conduct the vote and proclaim the results (Continuous noise). I request Members of Parliament to take their seats and listen to me! I request Parliament to confirm that since the members of Jobbik are not allowing the vote by roll call to take place, we shall cast our vote electronically. Again, I request technical assistance to overcome this problem so that the Members of Parliament can exercise their right to vote, since I am hindered in accessing my own voting card. ...” 22. On 25 June 2013 the Speaker presented a proposal to fine Ms Szél and Ms Lengyel HUF 131,400 (EUR 430) each and Ms Osztolykán HUF 154,000 (EUR 510) for their conduct, as recorded in the minutes and considered to be gravely offensive to parliamentary order, in application of sections 49(4) and 49(7) of the Parliament Act. 23. The Speaker proposed that the maximum fine be applied, given the extraordinary situation that had developed during the voting process and that the MPs had engaged in conduct gravely offensive to parliamentary order by displaying their banner and using a megaphone. A decision approving the proposal of the Speaker was adopted by the plenary on 26 June 2013, without debate.
