Decizia nr. 37844/05 Aleksandr Aleksandrovich RYABCHENKO și Irina Alekseyevna RYABCHENKO împotriva Rusiei și alte 15 cereri (a se vedea lista anexată) Curtea Europeană a Drepturilor Omului (A treia secțiune), care așezează la 30 iunie 2016 în calitate de comitet compus din: Helena Jäderblom, președinte, Dmitry Dedov, Branko Lubarda, judecători și Hasan Bakırcı, grefier adjunct al secțiunii, Având în vedere cererile depuse mai sus la diferitele date indicate în tabelul adăugat, având în vedere observațiile prezentate de guvernul contestat și observațiile prezentate în răspuns de solicitanți, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDURĂ Lista reclamantului și detaliile relevante ale cererilor sunt prezentate în tabelul adăugat. În temeiul articolului 6 § 1 din Convenție, reclamațiile reclamanților privind durata excesivă a procedurilor civile au fost comunicate guvernului rus („Guvernului”). Unele reclamanți au formulat, de asemenea, alte plângeri în temeiul dispozițiilor Convenției. Având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze în comun într-o singură decizie. În prezentele cereri, după examinarea tuturor materialelor dinaintea acesteia, Curtea consideră că, din motivele menționate mai jos, guvernul contestat nu poate fi considerat responsabil pentru întârzierile care au avut loc în procesul examinării cazurilor civile ale reclamanților. În special, Curtea constată că, având în vedere durata generală a procedurii, complexitatea relevantă a cauzelor, comportamentul reclamanților și cel al autorităților, inclusiv diligencia pe care le-au manifestat în timp ce se ocupă de cazurile, precum și nivelul competenței implicate, durata procedurii nu a fost excesivă și a îndeplinit cerințele de „tempă rațională” (a se vedea, printre altele, Vasilichenko c. Rusia , nr. 34784/02 , §§ 41-43, 23 septembrie 2010; Danilina c. Rusia (dec.), nr. 5727/04, 11 martie 2010; Kuznetsova c. Rusia (dec.), nr. 9839/03, 24 mai 2007; Antonov c. Rusia (dec.), nr. 38020/03, 3 noiembrie 2011; Markin c. Rusia (dec.), nr. 59502/00, 16 septembrie 2004; și Kuznetsov c. Rusia (dec.), nr. 73994/01, 17 iunie 2004) Având în vedere cele de mai sus, Curtea constată că aceste plângeri sunt manifestamente nefondate și trebuie respinse în conformitate cu art. 35 §§ 3 și 4 din Convenție. Unele reclamante se plângeau că nu aveau la dispoziție un remediu eficace pentru a se plânge de lungimea excesivă a procedurii în cazurile lor civile. Curtea reiterează în acest sens că această dispoziție se aplică numai celor care au o cerere argumentată în temeiul Convenției (a se vedea Silver și alții c. Regatul Unit) , 25 martie 1983, § 113, Serie A nr. 61). Având în vedere că plângerea reclamanților în temeiul articolului 6 a fost respinsă pentru a fi vădit nefondată, plângerea în temeiul articolului 13 ar trebui, de asemenea, declarată în mod manifest nefondat și respinsă în temeiul articolului 35 §§ § 3 și 4 din Convenție. Curtea a examinat cererile enumerate în tabelul adăugat și consideră că, având în vedere toate materialele în posesia sa și în măsura în care chestiunile reclamate sunt din competența sa, aceste plângeri fie nu îndeplinesc criteriile de admisibilitate prevăzute la articolele 34 și 35 din Convenție, fie nu dezvăluie nicio apariție a unei încălcări a drepturilor și libertăților consacrate în Convenție sau în protocolurile sale. Rezultă că această parte a cererilor trebuie respinsă în conformitate cu art. 4 din Convenție. Din aceste motive, Curtea, în unanimitate, decide să se alăture cererilor; declară că cererile sunt inadmisibile. Adoptate în limba engleză și notificate în scris la 21 iulie 2016. FACTS AND PROCEDURE
The list of applicant and the relevant details of the applications are set out in the appended table.
The applicants’ complaints under Article
6 § 1 of the Convention concerning the excessive length of civil proceedings were communicated to the Russian Government (“the Government”). Some applicants also raised other complaints under the provisions of the Convention.
A.
Joinder of the applications
Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.
B.
Complaints under
Article
6 § 1 of the Convention (excessive length of civil proceedings)
In the present applications, having examined all the material before it, the Court considers that for the reasons stated below, the respondent Government cannot be held liable for delays which occurred in the process of the examination of the applicants’ civil cases.
In particular, the Court notes that having regard to the overall length of the proceedings, the relevant complexity of the cases, the applicants’ conduct and that of the authorities, including the diligence they displayed while dealing with the cases, and the levels of jurisdiction involved, the length of the proceedings was not excessive and met the “reasonable time” requirement (see, among other authorities,

In view of the above, the Court finds that these complaints are manifestly ill-founded and must be rejected in accordance with Article
35 §§
3 and
4 of the Convention.
C.
Complaint under Article 13 of the Convention (lack of an effective remedy to complain about the excessive length of the proceedings)
Certain applicants complained that they did not have at their disposal an effective remedy to complain about the excessive length of the proceedings in their civil cases. The Court reiterates in this respect that this provision only applies to those with an arguable claim under the Convention (see
Silver and Others v. the United Kingdom
, 25 March 1983, § 113, Series A no. 61). Given that the applicants’ complaint under Article 6 was rejected for being manifestly ill-founded, the complaint under Article 13 should also be declared manifestly ill-founded and rejected under Article 35 §§ 3 and 4
of the Convention.
D.
Remaining complaints
Some applicants also raised other complaints under various Articles of the Convention.
The Court has examined the applications listed in the appended table and considers that, in the light of all the material in its possession and in so far as the matters complained of are within its competence, these complaints either do not meet the admissibility criteria set out in Articles 34 and 35 of the Convention or do not disclose any appearance of a violation of the rights and freedoms enshrined in the Convention or the Protocols thereto.
It follows that this part of the applications must be rejected in accordance with Article
35
§
4 of the Convention.
For these reasons, the Court, unanimously,
