CINTIMEA SECȚIUNE DECIZIE Nr. 31386/05 Olga Andreyevna DEREVYANKO împotriva Ucrainei și a altor 6 cereri (a se vedea lista anexată) Curtea Europeană a Drepturilor Omului (Cincimea Secțiunea), care așezează la 29 septembrie 2016 în calitate de comitet compus din: Khanlar Hajiyev, președinte, Faris Vehabović, Carlo Ranzoni, judecători și Hasan Bakırcı, secretar adjunct al secțiunii; Având în vedere cererile depuse mai sus la diferitele date indicate în tabelul adăugat, având în vedere observațiile prezentate de părți, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDURĂ Lista reclamanților și detaliile relevante ale cererilor sunt prezentate în tabelul adăugat. 13 din Convenția privind lungimea excesivă a procedurilor civile și lipsa oricărui remediu eficace în dreptul intern au fost comunicate guvernului ucrainean („Guvernul”). Unii solicitanți au formulat, de asemenea, alte plângeri în temeiul dispozițiilor Convenției. Având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze în comun într-o singură decizie. Curtea, după examinarea tuturor materialelor care i-au fost prezentate și având în vedere jurisprudența sa în cauză, consideră că plângerile reclamanților din cadrul acestui șef sunt inadmisibile din următoarele motive: în cererea nr. 74269/11, procedura în cauză nu se referă nici la acuzația penală împotriva reclamantului, nici la drepturile sale civile (a se vedea mutatis mutandis Garimpo c. Portugalia) , nr. 66752/01, (dec.), 10 iunie 2004); cererile nr. 18266/08 și 3469/10 au fost introduse din timp și în cererile nr. 31386/05, 28938/06, 50428/06 și 42025/07, durata procedurii nu a fost excesivă sau irezonabilă. Având în vedere cele de mai sus, Curtea constată că aceste plângeri trebuie respinse în conformitate cu art. 35 §§ 1, 3 și 4 din Convenție. Unii solicitanți au formulat, de asemenea, alte plângeri în temeiul diferitelor articole ale Convenției. Curtea a examinat cererile enumerate în tabelul adăugat și consideră că, având în vedere toate materialele în posesia sa și în măsura în care chestiunile reclamate sunt din competența sa, aceste plângeri fie nu îndeplinesc criteriile de admisibilitate prevăzute la articolele 34 și 35 din Convenție, fie nu dezvăluie nicio apariție a unei încălcări a drepturilor și libertăților consacrate în Convenție sau în protocolurile sale. Rezultă că această parte a cererilor trebuie respinsă în conformitate cu art. 4 din Convenție. Din aceste motive, Curtea, în unanimitate, decide să se alăture cererilor; declară că cererile sunt inadmisibile. Adoptate în limba engleză și notificate în scris la 20 octombrie 2016. FACTS AND PROCEDURE

The applicants’ complaints under Articles
6 § 1 and
13 of the Convention concerning the excessive length of civil proceedings and the lack of any effective remedy in domestic law were communicated to the Ukrainian Government (“the Government”). Some applicants also raised other complaints under the provisions of the Convention.

Joinder of the applications
Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.
B.
Complaints under
Articles
6 § 1 and
13 of the Convention (excessive length of civil proceedings and lack of any effective remedy in domestic law)
The Court, having examined all the materials submitted to it and having regard to its case-law on the subject, considers that the applicants’ complaints under this head are inadmissible for the following reasons: in application no. 74269/11 the proceedings in question concern neither the criminal charge against the applicant, nor his civil rights (see,
mutatis mutandis
,
Garimpo v. Portugal
, no. 66752/01, (dec.), 10 June 2004); applications nos. 18266/08 and 3469/10 were introduced out of time and in applications nos. 31386/05, 28938/06, 50428/06, and 42025/07 the length of the proceedings was not excessive or unreasonable.
In view of the above, the Court finds that these complaints must be rejected in accordance with Article
35 §§
1, 3 and
4 of the Convention.
C.
Remaining complaints
Some applicants also raised other complaints under various Articles of the Convention.
The Court has examined the applications listed in the appended table and considers that, in the light of all the material in its possession and in so far as the matters complained of are within its competence, these complaints either do not meet the admissibility criteria set out in Articles 34 and 35 of the Convention or do not disclose any appearance of a violation of the rights and freedoms enshrined in the Convention or the Protocols thereto.
It follows that this part of the applications must be rejected in accordance with Article
35
§
4 of the Convention.
For these reasons, the Court, unanimously,
