ARSLANOĞLU AND OTHERS v. TURKEY (CtEDO, 2016)

Decizia nr. 14046/05 de la SECȚIUNEA DECIZIE nr. 14046/05 Murat ARSLANOδLU împotriva Turciei și a altor 124 de cereri (a se vedea lista anexată) Curtea Europeană a Drepturilor Omului (a doua secțiune), ședința la 11 octombrie 2016 în calitate de comitet compus din: Nebojša Vučinić, președinte, Valeriu Grițco, Stéphanie Mourou-Vikström, judecători și Hasan Bakırcı, grefier adjunct al secțiunii; Având în vedere cererile depuse mai sus la diferitele date indicate în tabelul adăugat, după ce a deliberat, hotărăște după cum urmează: FACTE O listă a reclamanților și a reprezentanților acestora este prezentată în apendice. Guvernul turc („Guvernul”) a fost reprezentat de agentul lor. Faptele cazului, astfel cum au fost prezentate de părți, pot fi rezumate după cum urmează. Toți reclamanții își îndeplineau condamnarea la închisoare sau erau în detenție prealabilă la depunerea cererilor prezente. Consiliul disciplinar al închisorilor respective a hotărât să impună corespondenței reclamanților mai multe tipuri de măsuri de monitorizare, cum ar fi oprirea, distrugerea sau censurarea scrisorilor private. Reclamanții au contestat deciziile autorităților închisoare în fața judecătorilor de executare și, respectiv, a instanțelor de asemănare. Instanțele interne au respins obiecțiile reclamanților și au hotărât că restricțiile impugate sunt conforme cu legislația și reglementările interne și au fost justificate prin motive de ordine și securitate în închisoare, prevenirea infracțiunilor și protecția terților. Legea internă relevantă Se poate găsi o descriere a legii interne cu privire la noul remediu introdus prin Legea nr. 6384 Sayan c. Turcia (dec.), nr. 49460/11, §§ 6-12, 14 iunie 2016). COMPLAINTE Reclamanții au invocat articolele 8, 9, 10 și/sau 14 din Convenție și s-au plâns că restricțiile impuse corespondenței lor au încălcat, într-un mod discriminatoriu, dreptul lor de a respecta corespondența lor numai sau împreună cu dreptul lor la libertatea de gândire și dreptul lor la libertate de exprimare. Unele dintre reclamante au invocat, de asemenea, articolele 6 și 13 din Convenție și s-au plâns de ineficacitatea și nedreptatea procedurilor în fața instanțelor naționale. În cele din urmă, pe baza aceleași fapte, unele dintre reclamante au invocat articolele 1, 3, 5, 7, 17 și 18 din Convenție, art. 1 din Protocolul nr. 12 și Protocolurile nr. 4, 6, 7 și 13. Având în vedere subiectul similar al cererilor, de la început, Curtea consideră oportun să le examineze în comun într-o singură decizie. Curtea va examina cererile numai din punctul de vedere al articolului 8 din Convenție (a se vedea Asan c. Turcia (dec.), nr. 38453/09, 30 august 2016). Guvernul a remarcat că, în temeiul Legii nr. 6384 a fost înființată o nouă comisie de compensare pentru a aborda cererile privind durata procedurilor și neexecuția hotărârilor. De asemenea, au remarcat că competența Comisiei de compensare a fost ulterior extinsă printr-un decret adoptat la 9 martie 2016 pentru a examina plângerile referitoare, printre altele, la presupusa încălcare a dreptului de respectare a corespondenței deținuților sau persoanelor condamnate, din cauza refuzului administrației închisorii de a primi sau de a trimite scrisori sau corespondențe similare redactate în turc. În consecință, ei au susținut că reclamanții nu au epuizat căile de recurs interne, deoarece nu au făcut nici o cerere la Comisia de Compensare. 10. Curtea a examinat cereri similare împotriva Turciei în mai multe ocazii și a constatat o încălcare a articolului 8 din Convenție din motivul că interferența nu este „în conformitate cu legea” (a se vedea Tan v. Turcia, nr. 9460/03, §§ 24-26, 3 iulie 2007, și Tur v. Turcia , nr. 13692/03 , §§ 23-25, 11 iunie 2013) sau nu au fost „necesari într-o societate democratică” (a se vedea Fazıl Ahmet Tamer v. Turcia , nr. 6289/02, §§ 54-56, 5 decembrie 2006, și Mehmet Nuri Özen v. Turcia , nr. 37619/05, §§§ 18-19, 2 februarie 2010). 11. De asemenea, Curtea constată că în decizia sa în cazul Ümmühan Kaplan (n. 24240/07, § 77, 20 martie 2012), el a subliniat că ar putea examina totuși, în conformitate cu procedura sa normală, cererile acestui tip care au fost deja comunicate guvernului. Cu toate acestea, ținând cont de obiecția guvernului în ceea ce privește neutilizarea noii căi de recurs interne stabilite prin Legea nr. 6384, Curtea își reiterează concluzia în cazul Turgut și alții c. Turcia (dec.), nr. 4860/09, §§ 47-59, 26 martie 2013); Çakır și alții c. Turcia (dec.), nr. 51274/07, § 6, 25 iunie 2013); Yöyler și alții c. Turcia (dec.), nr. 10783/07, § 11-13, 16 decembrie 2014); Yıldız și Yanak (dec.), nr. 44013/07, § 29-38, 27 mai 2014); și Sayan c. Turcia (dec.), nr. 49460/11, 14 12. Având în vedere cele de mai sus, Curtea concluzionează că cererile ar trebui respinse în temeiul articolului 35 §§ 1 și 4 din Convenție pentru neepuizare a căilor de recurs interne. Din aceste motive, Curtea decide, în unanimitate, să se alăture cererilor; declara cererea inadmisibilă. Adoptată în limba engleză și notificată în scris la 17 noiembrie 2016. THE FACTS

A list of the applicants and their representatives are set out in the appendix. The Turkish Government (“the Government”) were represented by their Agent.

A.

The circumstances of the case

The facts of the case, as submitted by the parties, may be summarised as follows.

The applicants were all serving their prison sentences or were in pre-trial detention when the present applications were lodged. Disciplinary boards of respective prisons decided to impose on the applicants’ correspondence several types of monitoring measures such as stopping, destroying or censoring their private letters.

The applicants challenged the prison authorities’ decisions before the enforcement judges and the assize courts respectively. The domestic courts dismissed the applicants’ objections and ruled that the impugned restrictions were consistent with the domestic laws and regulations and were justified by reasons of order and security in the prisons, prevention of offences and protection of third parties.

COMPLAINTS

The applicants invoked Articles 8, 9, 10 and/or 14 of the Convention and complained that the restrictions imposed on their correspondence breached, in a discriminatory manner, their right to respect for their correspondence solely or together with their right to freedom of thought and their right to free expression. Some of the applicants also invoked Articles 6 and 13 of the Convention and complained about the ineffectiveness and unfairness of the procedures before the national courts. Finally, based on the same facts some of the applicants invoked Articles 1, 3, 5, 7, 17 and 18 of the Convention, Article 1 of Protocol No. 12 and Protocols nos. 4, 6, 7 and 13.

THE LAW

Having regard to the similar subject matter of the applications, at the outset the Court finds it appropriate to examine them jointly in a single decision.

The Court will examine the applications solely from the standpoint of Article 8 of the Convention (see

Asan v. Turkey

(dec.), no.

38453/09, 30

August 2016).

The Government noted that pursuant to Law no. 6384 a new Compensation Commission had been established to deal with applications concerning the length of proceedings and the non-execution of judgments. They further noted that the competence of the Compensation Commission was subsequently enlarged by a decree adopted on 9 March 2016 to examine complaints relating to, among other things, the alleged breach of the right to respect for correspondence of detainees or convicted persons, on account of the prison administration’s refusal to receive or send letters or similar correspondence that are drafted in Turkish. Accordingly, they maintained that the applicants had not exhausted domestic remedies, as they had not made any application to the Compensation Commission.

The Court has examined similar applications against Turkey on several occasions and found a violation of Article 8 of the Convention on the grounds that the interference was not “in accordance with the law” (see

Furthermore, the Court also notes that in its decision in the case of

Ümmühan Kaplan

24240/07, § 77, 20 March 2012), it stressed that it could nevertheless examine, under its normal procedure, applications of that type which had already been communicated to the Government. However, taking into account the Government’s objection with regard to the applicants’ failure to make use of the new domestic remedy established by Law no. 6384, the Court reiterates its conclusion in the cases of
