CINTIMEA SECȚIUNE DECIZIE Nr. 24759/08 Inna Volodymyrivna KLYMENKO și alții împotriva Ucrainei și a altor 7 cereri (a se vedea lista anexată) Curtea Europeană a Drepturilor Omului (Cincimea Secțiune), care așeză la 26 ianuarie 2017 în calitate de comitet compus din: Erik Møse, președinte, Yonko Grozev, Mārtiδš Mits, judecători și Karen Reid, grefierul secțiunii, Având în vedere cererile depuse mai sus la diferitele date indicate în tabelul anexat, având în vedere observațiile prezentate de guvernul contestat și observațiile prezentate în răspuns de unii dintre solicitanți, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDURĂ Lista reclamanților și detaliile relevante ale cererilor sunt prezentate în tabelul anexat.

13 din Convenția privind lungimea excesivă a procedurilor civile și lipsa oricărui remediu eficace în dreptul intern au fost comunicate guvernului ucrainean („Guvernul”). Unii solicitanți au formulat, de asemenea, alte plângeri în temeiul dispozițiilor Convenției. Având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze în comun într-o singură decizie. Curtea, după examinarea tuturor documentelor care i-au fost prezentate și având în vedere jurisprudența sa în această privință, consideră că plângerile reclamanților din cadrul acestui șef sunt inadmisibile deoarece durata procedurii nu a fost excesivă sau irezonabilă (a se vedea Yuryeva și Yuryev c. Ucraina , nr. 3431/03, § 43, 31 iulie 2012). În plus, cererile nr. 24759/08 și 2657/11 au fost introduse din timp.

Având în vedere cele de mai sus, Curtea constată că aceste plângeri sunt manifestamente nefondate și trebuie respinse în conformitate cu art. 35 § 1, 3 și 4 din Convenție. Curtea a examinat cererile enumerate în tabelul adăugat și consideră că, având în vedere toate materialele în posesia sa și în măsura în care chestiunile reclamate sunt din competența sa, aceste plângeri fie nu îndeplinesc criteriile de admisibilitate prevăzute la articolele 34 și 35 din Convenție, fie nu dezvăluie nicio apariție a unei încălcări a drepturilor și libertăților consacrate în Convenție sau în protocolurile sale. Prin urmare, această parte a cererilor trebuie respinsă în conformitate cu art. 4 din Convenție. Din aceste motive, Curtea decide, în unanimitate, să se alăture cererilor; declara cererile inadmisibile.

FACTS AND PROCEDURE

The list of applicants and the relevant details of the applications are set out in the appended table. The applicants’ complaints under Articles 6 § 1 and 13 of the Convention concerning the excessive length of civil proceedings and the lack of any effective remedy in domestic law were communicated to the Ukrainian Government (“the Government”). Some applicants also raised other complaints under the provisions of the Convention. THE LAW A. Joinder of the applications Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.

B. Complaints under Articles 6 § 1 and 13 of the Convention (excessive length of civil proceedings and lack of any effective remedy in domestic law) The Court, having examined all the materials submitted to it and having regard to its case-law on the subject, considers that the applicants’ complaints under this head are inadmissible since the length of the proceedings was not excessive or unreasonable (see, Yuryeva and Yuryev v. Ukraine , no. 3431/03, § 43, 31 July 2012). Furthermore, applications nos. 24759/08 and 2657/11 were introduced out of time. In view of the above, the Court finds that these complaints are manifestly ill-founded and must be rejected in accordance with Article 35 §§ 1, 3 and 4 of the Convention.

C. Remaining complaints Some applicants also raised other complaints under various articles of the Convention. The Court has examined the applications listed in the appended table and considers that, in the light of all the material in its possession and in so far as the matters complained of are within its competence, these complaints either do not meet the admissibility criteria set out in Articles 34 and 35 of the Convention or do not disclose any appearance of a violation of the rights and freedoms enshrined in the Convention or the Protocols thereto. It follows that this part of the applications must be rejected in accordance with Article 35 § 4 of the Convention. For these reasons, the Court, unanimously, Decides to join the applications; Declares the applications inadmissible.
