CINTIMEA DECIZIE A SECȚIUNEI Cerere nr. 15387/08 Olena Ivanivna SKUTELNYK și alții împotriva Ucrainei și a altor trei cereri (a se vedea tabelul apendice) Curtea Europeană a Drepturilor Omului (Cincimea Secțiune), care așezează la 21 septembrie 2017 în calitate de comitet compus din: Nona Tsotsoria, președinte, Gabriele Kucsko-Stadlmayer, Ltif Hüseynov, judecători și Liv Tigerstedt, grefier adjunct al secțiunii interioare; Având în vedere cererile depuse mai sus la diferitele date indicate în tabelul adăugat, având în vedere observațiile prezentate de guvernul contestat și observațiile prezentate în răspuns de solicitanți, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDURĂ Lista reclamanților și detaliile relevante ale cererilor sunt prezentate în tabelul adăugat. Reclamațiile reclamanților în temeiul articolelor 6 § 1 și 13 din Convenție privind durata excesivă a procedurilor civile și lipsa oricărui remediu eficace în legislația internă au fost comunicate guvernului ucrainean („Guvernul”). Unii solicitanți au formulat, de asemenea, alte plângeri în temeiul dispozițiilor Convenției. Având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze în comun într-o singură decizie. Curtea, după examinarea tuturor documentelor care i-au fost prezentate și având în vedere jurisprudența sa pe această temă, consideră că plângerile reclamanților din cadrul acestui șef sunt inadmisibile deoarece durata procedurii nu a fost excesivă sau irezonabilă (a se vedea, Yuryeva și Yuryev c. Ucraina , nr. 3431/03, § 43, 31 iulie 2012). În plus, plângerile formulate de reclamanții în cererea nr. 13561/12 privind procedurile între 6 august 2004 și 24 iulie 2009 trebuie respinse pentru că au fost introduse din timp. Având în vedere cele de mai sus, Curtea constată că aceste plângeri trebuie respinse în conformitate cu art. 35 §§ 1, 3 și 4 din Convenție. 15387/08 și 13561/12, reclamanții au formulat și alte plângeri în temeiul diverselor articole ale Convenției. Curtea a examinat cererile și consideră că, având în vedere tot materialul în posesia sa și în măsura în care chestiunile reclamate sunt în competența sa, aceste plângeri fie nu îndeplinesc criteriile de admisibilitate prevăzute la articolele 34 și 35 din Convenție sau nu divulgă nici o apariție a unei încălcări a drepturilor și libertăților consacrate în Convenție sau în protocolurile acestora. Rezultă că această parte a cererilor trebuie respinsă în conformitate cu art. 4 din Convenție. Din aceste motive, Curtea, în unanimitate, decide să se alăture cererilor; declara cererile inadmisibile. Adoptate în limba engleză și notificate în scris la 12 octombrie 2017. FACTS AND PROCEDURE
The list of applicants and the relevant details of the applications are set out in the appended table.
The applicants’ complaints under Articles
6 § 1 and
13 of the Convention concerning the excessive length of civil proceedings and the lack of any effective remedy in domestic law were communicated to the Ukrainian Government (“the Government”). Some applicants also raised other complaints under the provisions of the Convention.
A.
Joinder of the applications
Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.
B.
Complaints under
Articles
6 § 1 and
13 of the Convention (excessive length of civil proceedings and the lack of any effective remedy in domestic law)
The Court, having examined all the materials submitted to it and having regard to its case-law on the subject, considers that the applicants’ complaints under this head are inadmissible since the length of the proceedings was not excessive or unreasonable (see,
Yuryeva and Yuryev v.
Ukraine
, no. 3431/03, § 43, 31 July 2012).
Furthermore, the complaints raised by the applicants in application no.
13561/12 concerning the proceedings between 6 August 2004 and 24
July 2009 must be dismissed for having been introduced out of time.
In view of the above, the Court finds that these complaints must be rejected in accordance with Article 35 §§ 1, 3 and 4 of the Convention.
C.
Remaining complaints
In applications nos.
15387/08 and 13561/12, the applicants also raised other complaints under various articles of the Convention.
The Court has examined the applications and considers that, in the light of all the material in its possession and in so far as the matters complained of are within its competence, these complaints either do not meet the admissibility criteria set out in Articles 34 and 35 of the Convention or do not disclose any appearance of a violation of the rights and freedoms enshrined in the Convention or the Protocols thereto.
It follows that this part of the applications must be rejected in accordance with Article
35
§
4 of the Convention.
For these reasons, the Court, unanimously,
Decides
to join the applications;
Declares
the applications inadmissible.
