Mkhitaryan împotriva Armeniei

Publicat la 3 februarie 2025 CIFTH SECȚIUNE Cererea nr. 57475/18 Eduard MKHITARYAN împotriva Armenia depusă la 7 noiembrie 2018 comunicată la 13 ianuarie 2025 OBIECTUL CAUZEI La 11 septembrie 2015 s-a desfășurat o demonstrație pe una dintre străzile centrale ale Erevan. În mod deosebit, demonstranții, inclusiv reclamantul, au mers în fața biroului președintelui, situat pe Avenue Baghramyan. În timp ce au fost opriți la jumătatea drumului de la un cordon de poliție, au decis să țină un loc pe drum și au refuzat să respecte ordinele poliției de a despăgubi drumul în 6 ore. În dimineața devreme a 12 septembrie 2015, la ora 17:30, după expirarea termenului respectiv, poliția a dizolvat ședința și a supus reclamantului la o arestare administrativă pe termen scurt.

Apoi, la cererea depusă de poliție, Curtea Administrativă a impus reclamantului o amendă în valoare de 50 000 de drame armeni pentru nerespectarea ordinilor legale ale poliției de a clarifica drumul (o infracțiune administrativă în temeiul articolului 182 din Codul de infracțiuni administrative). Apelurile reclamantului nu au avut succes și decizia finală a fost acordată la 7 iunie 2018. Reclamantul, care se bazează pe articolele 10 și 11 din Convenție, se plâng că drepturile sale la libertatea de exprimare și libertatea de asamblare au fost încălcate. 11 din Convenție, luată singură și citită în lumina art. 10 din Convenție?

SUBJECT MATTER OF THE CASE

On 11 September 2015 a demonstration was held on one of the central streets of Yerevan. Notably, the demonstrators, including the applicant, marched towards the President’s office, situated on Baghramyan Avenue. Being stopped halfway by a police cordon, they decided to hold a sit-in on the road and refused to comply with the orders of the police to clear the road in 6 hours. In the early morning of 12 September 2015, at around 5.30 a.m., after the expiry of the said deadline, the police disbanded the sit-in and subjected the applicant to a short-term administrative arrest. Then, upon an application by the police, the Administrative Court imposed a fine on the applicant in the amount of 50,000 Armenian drams for his failure to comply with the lawful orders of the police to clear the road (an administrative offence under Article 182 of the Code of Administrative Offences).

The applicant’s appeals were unsuccessful, and the final decision was served on him on 7 June 2018. The applicant, relying on Articles 10 and 11 of the Convention, complains that his rights to freedom of expression and freedom of assembly were violated.

Has there been a violation of the applicant’s right to freedom of peaceful assembly, contrary to Article 11 of the Convention, taken alone and read in the light of Article 10 of the Convention?
