sumele relevante (inclusiv dobânzile de întârziere) au fost plătite reclamantelor sau reprezentanților lor în condiții acceptate de ele (vezi anexa 3). B) Procedurile interne Procedurile interne contestate s-au încheiat în toate cazurile privind deciziile privind durata excesivă a procedurilor. În 94 dintre acestea, potrivit Curții sau informații ulterioare din partea autorităților, deciziile interne au fost amânate pentru a pune capăt executării acestor cazuri. Mai mult, primul pașaport al reclamantei i-a fost returnat la a doua eliberare din custodie, la 6 octombrie 1999, prin urmare, nu par a fi necesare măsuri individuale suplimentare. III. Măsuri generale A) Măsuri luate ca răspuns la încălcările articolului 6 § 1 1. Măsuri legislative și de reglementare S-au luat diverse măsuri legislative în vederea reducerii duratei generale a procedurilor judiciare, atât civile, cât și penale.
În special, în 2012 a fost introdusă o nouă procedură de revizuire prin apel, atât pentru cauzele civile, cât și pentru cele penale, instanța de apel dobândind puterea de a examina noi probe și de a decide în fond fără a trimite cazul direct înapoi la instanța inferioară pentru un nou proces (cu câteva rare excepții). Această reformă a rezolvat problema procedurilor civile îndelungate, deoarece acestea au fost cauzate de repetarea proceselor penale. Acest proces va fi finalizat atunci când toate instanțele naționale vor fi echipate cu instrumentele tehnologice necesare. Acest lucru pare capabil să prevină amânările audierilor cauzate de absența părților care nu au fost convocate în mod corespunzător.
La 23 iunie 2016, Codurile de procedură civilă și penală au fost modificate în continuare pentru a introduce posibilitatea de a pune deciziile judiciare la dispoziția părților în termen de cinci zile de la adoptarea lor, inclusiv prin publicarea lor online. Acest lucru a redus frecvența cererilor de prelungire a termenului de apel. În plus, au fost luate măsuri legislative suplimentare în ceea ce privește eficiența procedurilor civile: modificarea Codului de procedură civilă din 28 iunie 2009 a stabilit un termen limită de examinare a unei acțiuni în termen de două luni după ce au fost depuse cereri de audiere. Această lege a ajutat la reducerea activității părților în termen de cinci zile de la adoptarea lor, inclusiv prin publicarea lor online.
Pentru aceste scopuri, în cadrul acestui program au fost alocate și cheltuite peste 60 de miliarde de ruble (aproximativ 927 de milioane de euro) între 2007 și 2012 și alte 90,6 miliarde de ruble (aproximativ 1,400 de miliarde de euro) sunt prevăzute pentru cheltuielile pentru programul său federal de urmărire din 2013 până în 2020. în general, bugetul sistemului judiciar federal rus continuă să crească semnificativ prin furnizarea de fonduri pentru instanțele penale, așa cum a menționat și CEJ (numărul de judecători ai instanțelor judecătorești federale au fost alocate pentru eficiență, un număr de 41% din personalul general al instanțelor judecătorești a fost alocat).
în perioada 2005 - 2015, a fost introdusă o nouă instanță de judecată, cu o durată mai mare de 40 de ani, care a fost înlocuită cu o mai mică asistență juridică decât cele ale instanțelor judecătorești din Europa, iar numărul instanțelor judecătorești a crescut în mod rezonabil, de la o poziție de 41% la aceeași durată. Pentru a îmbunătăți condițiile tehnice pentru funcționarea instanțelor, între 2005 și 2015 au fost construite, renovate sau achiziționate în total 400 de clădiri, iar în instanțe au fost introduse instrumente IT moderne, inclusiv hardware și software avansate. Peste 1.500 de instanțe federale au fost echipate cu computere și alte facilități și instrumente tehnice. Au fost create site-uri web oficiale ale tuturor instanțelor federale de jurisdicție generală și un spațiu de informare publică comun pentru judecători și cetățeni (Pravosudiye).
Aceste măsuri sunt capabile să reducă timpul petrecut la căutarea dosarelor și a datelor, să prevină pierderea documentelor, să asigure accesul rapid și ușor la informații și să reducă durata generală a procedurilor. Alte măsuri în curs de desfășurare includ introducerea administrației electronice a procedurilor, notificarea automată a părților la proceduri cu privire la data, ora și locul audierilor judiciare, precum și introducerea difuzării publice a audierilor prin internet. Curtea Supremă a organizat sesiuni speciale de formare și întâlniri anuale cu judecătorii de instanțe de jurisdicție generală și cu alți 98.000 de funcționari ai instanțelor pentru a le sensibiliza asupra dreptului la un proces echitabil într-un timp rezonabil.
De asemenea, ea emite în mod regulat revizuiri tematice, inclusiv extrasuri din jurisprudența Curții Europene, pentru a asigura uniformitatea practicii judiciare. Universitatea de Justiție (fostă Academie de Justiție) a oferit, de asemenea, formare inițială și avansată judecătorilor și altor funcționari ai instanțelor, inclusiv pe tema lungimii procedurilor. Între 2005 și 2014, peste 18.000 de judecători și 98.000 de alți funcționari ai instanțelor au participat la diverse evenimente de formare la Universitatea de Justiție. B) Măsuri luate ca răspuns la încălcarea articolului 8 Încălcarea dreptului reclamantei la respectarea vieții private în cazul Smirnova a fost un incident izolat. Autoritățile au sublinizat că creșterea gradului de conștientizare descrisă mai jos în Legea nr. 1 din mai 2010 (Federal Law No. 6868) a intrat în vigoare ca o măsură de remediere suficientă în caz de încălcare a unor proceduri penale exagerate.
Dacă procedura durează mai mult de trei ani în materie civilă și patru ani în materie penală, plângerea poate fi depusă fără a aștepta sfârșitul procedurii. Ca măsuri de însoțire a Legii privind despăgubirii din 2010, Plenul Curții Supreme și Curtea Supremă de Comerț au emis o hotărâre comună cu orientări care clarifică punerea în aplicare a acesteia, care a fost actualizată în martie 2016, cu clarificări suplimentare. Acest remediu a fost deja examinat de către Comitetul Miniștrilor în contextul neexecutării hotărârilor interne care acordă despăgubiri financiare împotriva autorităților de stat.

Președintele instanței trebuie să revizuiască astfel de cereri în termen de cinci zile și poate stabili date de audiere sau să indice alte măsuri specifice pe care judecătorul să le ia. Atunci când examinează o cerere de accelerare, președintele instanței ia în considerare factori precum complexitatea cazului, conduita procedurii, acțiunile deja publicate și alte criterii de publicare. D au fost publicate și difuzate note și alte criterii de publicare. E. Curtea a luat, de asemenea, măsuri rezonabile pentru a asigura că toate autoritățile publice și alte autorități au fost informate în timp util de deciziile judecătorești și de alte măsuri de publicare și de publicare.
Numărul cazurilor examinate în afara acestor termene a scăzut din 2005 în comparație cu 2014, după cum urmează: de la anterior 6,9% la 1,4% în cauzele civile și de la anterior 3,4% la 0,8% în cauzele penale.Conform Raportului CEPEJ privind Sistemele judiciare europene Ediția 2014 (2012 Data): Eficiența și calitatea justiției, timpul de soluționare (rațiunea dintre cauzele pendente și cauzele soluționate) atât în cauzele civile, cât și în cauzele penale din Federația Rusă este cel mai scurt din Europa, cu o rată de soluționare (rațiunea dintre cauzele soluționate și cauzele primite) de 99 la 100%.Conform datelor Raportului CEPEJ din 2016 (2014), datele au rămas aceleași în 2014, iar timpul de soluționare a fost considerat satisfăcător.F) Alte măsuri generale de prevenire a încălcărilor constatate în cadrul acestor cazuri au fost adoptate de către alte grupuri de persoane în conformitate cu art. 46 din Convenția Europeană privind prevenirea și remedierea încălcărcărilor, a se vedea anexa nr. IV.Cererea de soluționare a CIV.Considerarea că aceste măsuri vor fi soluționate în totalitate în contextul celorlalte cazuri, a fost examinată de către Curtea Europeană, iar în celelalte cazuri, în conformitate cu art. 46, a fost constatată că aceste măsuri vor fi soluționate în conformitate cu cele mai recente concluzii ale Curții.

Resolution CM/ResDH(2017)168 Execution of the judgments of the European Court of Human Rights 106 cases against the Russian Federation concerning length of domestic judicial proceedings and remedies thereof (Adopted by the Committee of Ministers on 7 June 2017 at the 1288 th meeting of the Ministers’ Deputies) The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”), Having regard to the final judgments transmitted by the Court to the Committee in these cases and to the violations established; Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required: - of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and - of general measures preventing similar violations; Having noted that the just satisfaction, where awarded,

Case summaries The cases in the Kormacheva group (82 cases) and the Smirnova group (20 cases) concern the excessive length of civil and criminal proceedings and the lack of an effective domestic remedy in this respect (violations of Articles 6 § 1 and 13). The Chernichkin group (four cases) concerns the authorities’ refusal to examine a claim for compensation in respect of excessively long civil proceedings due to the lack of a relevant legal provision (violation of Article 6 § 1). In three of these cases the Court also found other violations, namely: a violation of Article 6 § 1 and of Article 1 of Protocol No. 1 on account of the delayed enforcement of domestic judicial decisions concerning monetary awards against the State ( Falimonov ,
Tokazov ) (this issue has been examined in the Timofeyev group of cases [1] ); a violation of Article 5 §§ 1 and 3 on account of the repeated detention of the applicants in the course of a criminal investigation on the basis of insufficiently reasoned decisions ( Smirnova ) (this issue is being examined in the Klyakhin group of cases); and a violation of Article 8 on account of the failure to return the passport to one of the applicants upon her release from custody ( Smirnova ). II. Individual measures A) Just satisfaction In all cases in which the European Court awarded just satisfaction, the relevant sums (including default interest) were paid to the applicants or their representatives under conditions accepted by them (see Annex 3). B) Domestic proceedings The impugned domestic proceedings have ended in all the cases concerning excessive length of proceedings.
In 94 of them, according to the Court’s judgments or information subsequently submitted by the authorities, the domestic proceedings had been brought to an end or discontinued before the adoption of the judgments. In eight other cases ( Baburin , Chevkin , Kazyulin , Kolomiyets , Komarova, Konashevskaya and Others, Kormacheva, Plaksin ), the proceedings ended after the adoption of the Court’s judgments (see Appendix 4). C) Other individual measures As regards the two cases concerning the delayed enforcement of domestic judicial decisions ( Falimonov , Tokazov ), these decisions had been enforced before the European Court delivered its judgments. As regards the Smirnova case, the applicants had been released from detention at the time the Court delivered its judgment.
In addition, the first applicant’s passport had been returned to her upon her second release from custody, on 6 October 1999. Consequently, no further individual measures appear to be required. III. General measures A) Measures taken in response to the violations of Article 6 § 1 1. Legislative and regulatory measures Various legislative measures were taken with a view to reducing the overall length of judicial proceedings, both civil and criminal. In particular, a new appellate review procedure was introduced in 2012 for both civil and criminal cases, with the appeal instance acquiring the power to examine new evidence and decide on the merits directly without sending the case back to the lower court for a new trial (with some rare exceptions).
This reform has addressed the problem of lengthy proceedings insofar as they were caused by repeated remittals of cases to the first instance for re-examination. Tight deadlines were also set for the appeal courts to examine appeals: three months for civil cases and 45 days for scheduling a hearing for criminal cases. Notification of parties in both civil and criminal cases via a text message indicating the date, time and venue of the hearing was also introduced in 2013, by a regulation of the Supreme Court’s Judicial Department. This process will be finalised when all the national courts are equipped with the necessary technological tools. This appears capable of preventing adjournments of hearings caused by the absence of the parties who had not been duly summoned.
On 23 June 2016, the Codes of Civil and Criminal Procedure were further amended to introduce the possibility of making judicial decisions available to parties within five days of their adoption, including by publishing them online. This has reduced the frequency of requests for extension of the time-limit for appeal. Additional legislative measures were taken with regard to increasing the efficiency of civil proceedings: the amendments to the Code of Civil Procedure of 28 June 2009 set a deadline for examination of a civil case within two months after the claim was filed. This has helped to prevent long periods of inactivity on the part of judicial authorities, including the periods between the registration of the claim and the first hearing.
Furthermore, in order to reduce the judges’ workload, an alternative mediation procedure was introduced by a law adopted on 27 July 2010 (№ 193-FZ). This law provides the parties to civil proceedings with a possibility to resolve their dispute with the assistance of a mediator, without filing a court action. The issue of refusal of claims for compensation in respect of excessively long civil proceedings due to the lack of relevant legislation, was resolved by the adoption of the 2010 Compensation Act (see Section C below). 2. Capacity-building and training measures A number of measures to strengthen the capacity of the national judiciary have been taken, mainly within the scope of the Federal Programme for the Development of the Russian Judicial System.
For these purposes, more than 60 billion roubles (approx. 927 million EUR) were allocated and spent within this programme between 2007 and 2012 and another 90.6 billion roubles (approx. 1,400 billion EUR) are foreseen for the expenditure for its follow-up federal programme from 2013 until 2020. In general, the Russian judicial system budget continues to increase by providing sustainable funding for the courts, as also noted by the CEPEJ (the European Commission for the Efficiency of Justice, a body of the Council of Europe). [2] The number of judges in the courts of general jurisdiction (civil and criminal proceedings) and in the commercial courts was increased by more than 2000 between 2005 and 2015, and the number of justices of the peace by more than 40%.
Additionally, the position of federal judge assistant was introduced in all courts which has allowed judicial proceedings to be significantly expedited. In the same period, 41 new courts and 32 representations of permanent judicial bodies were opened. A number of staff were reassigned from less busy courts to the ones with the heaviest workloads. In order to improve the technical conditions for the functioning of courthouses, 400 buildings in total were constructed, renovated or purchased between 2005 and 2015. Modern IT tools were introduced to the courts, including advanced hardware and software. More than 1,500 federal courts were equipped with computers and other technical facilities and tools.
Official websites of all federal courts of general jurisdiction and a common public information space for judges and citizens (“Pravosudiye”) were created. These measures are capable of reducing the time spent on searching for case-files and data, to prevent the loss of documents, to ensure quick and easy access to information and to reduce the overall length of proceedings. Other measures currently underway include the introduction of electronic administration of proceedings, automatic notification of parties to the proceedings about the date, time and venue of court hearings, as well as the introduction of internet broadcasting of public court hearings. The Supreme Court has organised special training sessions and annual meetings with judges of courts of general jurisdiction and justices of the peace to raise their awareness of the right to a fair trial within a reasonable time.
It also regularly issues thematic reviews, including extracts from the European Court’s caselaw, to ensure uniformity of judicial practice. The University of Justice (previously the Academy of Justice) has also provided initial and advanced training to judges and other court officials, including on the issue of the length of proceedings. Between 2005 and 2014, more than 18,000 judges and 98,000 other court officials participated in various training events at the University of Justice. B) Measures taken in response to the violation of Article 8 The violation of the applicant’s right to respect for her private life in the Smirnova case was an isolated incident. The authorities stressed that the awareness raising measures described in Section D below are sufficient to prevent similar violations in the future.
C) Measures taken in response to the violations of Article 13 The law providing for a domestic remedy in respect of excessively lengthy judicial and enforcement proceedings as well as of pre-trial criminal proceedings ("the Compensation Act" – Federal Law No. 68-FZ) entered into force on 4 May 2010. This law provides for both a compensatory and acceleratory remedy. 1. Compensatory remedy A complaint in respect of excessively lengthy judicial proceedings must be submitted within six months following the end of the impugned proceedings. If the proceedings last longer than three years in civil and four years in criminal matters, the complaint can be submitted without awaiting the end of the proceedings.
As accompanying measures to the 2010 Compensation Act, the Plena of the Supreme Court and the Supreme Commercial Court issued a joint ruling with guidelines clarifying its implementation which was updated in March 2016, with additional clarifications. This remedy has already been examined by the Committee of Ministers in the context of non-enforcement of domestic judgments awarding monetary compensation against state authorities.
In November 2011, the Committee of Ministers considered this remedy to be sufficient (see Interim Resolution CM/ResDH(2011)293) and closed the supervision of the cases concerned in September 2016. With regard to the excessively lengthy civil and criminal proceedings, the European Court has also characterised this new remedy as prima facie effective (see, for example, Fakhretdinov v. Russian Federation, Application No. 26716/09, decision of 23 September 2010, §§ 27 and 31, concerning lengthy criminal proceedings; Palacheva v. Russian Federation, Application No. 39814/04, judgment of 19/06/2014, concerning lengthy civil proceedings). Notably, in Stolyarova (Application No. 15658/09, decision of 28/06/2016), the Court noted that the applicant had successfully used the Compensation Act and received appropriate compensation for the lengthy civil proceedings.
2. Acceleratory remedy In 2010, a new provision was introduced to the Codes of Civil and Criminal Procedure (Article 6.1) according to which the parties to the proceedings can now request acceleration thereof when their civil or criminal cases have not been examined for a long time, i.e. within the time-limits prescribed by law (see Section A above). The president of the court is to review such requests within five days and can set hearing dates or indicate other specific action to be taken by the judge. When examining a request for acceleration, the president of the court takes into account such factors as the complexity of the case, the conduct of the parties, the actions already taken by the court and other criteria.
D) Publication and dissemination measures The government has taken publication and dissemination measures to ensure that various state authorities are aware of the Convention standards concerning the requirement to conduct judicial proceedings within a reasonable time and other rights at issue. The judgments of the European Court were disseminated to all the authorities concerned, often with explanatory notes and recommendations. The judgments were also translated and published. E) Assessment of the impact of the measures taken The vast majority of civil and criminal cases are now considered within the time-limits fixed by domestic legislation. The number of cases considered outside of such time-limits has decreased since 2005 when compared with 2014, as follows: from previously 6,9% to 1,4% in civil cases and from previously 3,4% to 0,8% in criminal cases.
According to the CEPEJ Report on “European Judicial Systems – Edition 2014 (2012 Data): Efficiency and Quality of Justice”, the disposition time (ratio between pending cases and resolved cases) of both civil and criminal cases in the Russian Federation is the shortest in Europe, with a clearance rate (ratio between resolved cases and incoming cases) of 99 to 100%. According to the latest 2016 CEPEJ Report (2014 data), the data stayed the same in 2014, and the disposition time was considered satisfactory. F) Other violations found The general measures in response to the other violations found by the European Court in these cases have been or are being examined within the context of the relevant groups, as indicated in the case description (see above).
IV. Conclusions of the respondent State The government considers that the measures adopted have fully remedied the consequences of the violations of the Convention found by the European Court in these cases and that these measures will prevent similar violations in future. The Russian Federation has, therefore, complied with its obligations under Article 46, paragraph 1, of the Convention. Appendix 3: List of payment of just satisfaction
