Kvasov împotriva Rusiei și alte 5 cereri

Comunicat la 13 iunie 2017 SECȚIUNEA TERZĂ Cererea nr. 70713/12 Vladimir Ivanovich KVASOV împotriva Rusiei și a altor 5 cereri (a se vedea lista adăugată) DECLARAREA FACTELOR Reclamanților se plângeau în temeiul articolului 3 din Convenție că au fost supuși de maltrat de către oficialii de stat și că statul nu a efectuat o anchetă internă eficientă în legătură cu aceste incidente. Detaliile relevante privind acuzațiile lor sunt reflectate în tabelele atașate, informațiile referitoare la presupusa încălcare a aspectului material al articolului 3 din apendicele nr. Toate reclamanții au susținut că încercările lor de a iniția ancheta penală în legătură cu incidentele s-au dovedit inutile.

Având în vedere leziunile constatate asupra reclamanților după timpul petrecut de către ei în custodie de stat, reclamanții au fost supuși la tortură sau tratamente inumane sau degradante, în încălcarea articolului 3 din Convenție (a se vedea, printre altele, Razzakov c. Rusia , nr. 57519/09, 5 februarie 2015; Gorshchuk c. Rusia , nr. 31316/09, 6 octombrie 2015; Turbylev c. Rusia , nr. 4722/09, 6 Octombrie 2015; Fartushin v. Rusia , nr. 38887/09 , 8 octombrie 2015; Aleksandr Andreyev v. Rusia , nr. 2281/06, 23 februarie 2016; și Leonid Petrov v. Rusia , nr. 52783/08, 11 octombrie 2016)? Au renunțat autoritățile sarcinile lor de probă prin furnizarea unei explicații plauzibile sau convingătoare cu privire la modul în care leziunile reclamanților au fost cauzate (a se vedea Selmouni , citat mai sus § 87 , și Salman v. Turcia [GC], nr. 2886/93, § 100, CEHR 2000 VII și Bouyid v. Belgia [GC], nr. 23380/09, § 83 și mai departe, CEHR 2015)? Autoritățile au efectuat o anchetă eficace, în conformitate cu obligația procedurală prevăzută la art. 3 din convenție (a se vedea Lyapin v. Rusia , nr. 46956/09, §§ 125-40, 24 iulie 2014),

având în vedere: (a) refuzul autorităților de investigare de a deschide cazuri penale și de a investiga acuzațiile reclamanților de maltrat de către oficialii de stat și de a depăși respingerea acestor refuzuri ca fiind ilegale și neconvențiate de autoritățile sau instanțe de anchetă mai înalte; și (b) incapacitatea autorităților investigatoare de a pune în aplicare măsuri de investigație deplină în cadrul anchetelor pre-investirii, astfel cum a fost modificată de Legea Federală nr. 23-FZ din 4 martie 2013, de exemplu, confruntări, parade de identificare, căutări, etc.; Guvernul este invitat să prezinte în ceea ce privește dl Mokhov (cazul nr. 50144/13) exemplare ale certificatului postului de prim ajutor (undat), nota IVS din 20/05/2009 și o copie a deciziei finale în cadrul procedurii judiciare pe care reclamantul le-a adus în legătură cu maltraturile sale.

Nici o plângere de la solicitant în timpul detenției. 20/11/2009 Procuror al Regiunii Voronezh 07/12/2009 11/01/2010 25/01/2010 01/03/2010 25/03/2010 06/08/2010 27/04/2011 La 19/04/2012, instanța a respins plângerea împotriva hotărârii din 27/04/2011, raționând că plângerile sale cu privire la maltrat au fost examinate în timpul procedurii penale împotriva reclamantului și au fost respinse. De asemenea, există mai multe concedii ale plângerilor fratelui solicitant.

Versiunea autorităților este că reclamantul s-a rănit înaintea arestării din cauza condiției sale intoxicate.

STATEMENT OF FACTS

The applicants complained under Article 3 of the Convention that they had been subjected to ill-treatment by State officials and that the State failed to conduct an effective domestic investigation into those incidents. The relevant details regarding their allegations are reflected in the attached tables. The information regarding the alleged breach of the substantive aspect of Article 3 in contained in Appendix no. 1. The reaction of the domestic authorities to the applicants’ complaints is reflected in Appendix no. 2. All of the applicants submitted that their attempts to initiate criminal investigation in connection with the incidents proved futile.

QUESTIONS TO THE PARTIES

1. Having regard to the injuries found on the applicants after the time spent by them in State custody, have the applicants been subjected to torture, or inhuman or degrading treatment, in breach of Article 3 of the Convention (see, among other authorities, Razzakov v. Russia , no. 57519/09, 5 February 2015; Gorshchuk v. Russia , no. 31316/09, 6 October 2015; Turbylev v. Russia , no. 4722/09, 6 October 2015; Fartushin v. Russia , no. 38887/09, 8 October 2015; Aleksandr Andreyev v. Russia , no. 2281/06, 23 February 2016; and Leonid Petrov v. Russia , no. 52783/08, 11 October 2016)? 2. Have the authorities discharged their burden of proof by providing a plausible or satisfactory and convincing explanation of how the applicants’ injuries were caused (see Selmouni , cited above, § 87, and Salman v. Turkey [GC], no. 21986/93, § 100, ECHR 2000 ‑ VII and Bouyid v. Belgium [GC], no. 23380/09, § 83 and further, ECHR 2015)? 3.
