H.M. și alții împotriva Ungariei

Comunicat la 13 septembrie 2017 CUARTA SECȚIUNE Cererea nr. 38967/17 H.M. și alții împotriva Ungariei depusă la 1 iunie 2017 OBIECTUL CAUZEI Cererea se referă la închiderea în curs, în condiții care sunt presupuse inumane, a unei familii irakiene (tatăl, mama însărcinată și patru copii minori) la zona de tranzit Tompa de la granița Ungariei și Serbiei începând cu 3 aprilie 2017, în așteptarea examinării cererilor lor de azil. Reclamanții au fost supuși unor tratamente inumane sau degradante în zona de tranzit de frontieră Tompa, în încălcarea articolului 3 din Convenție, având în vedere în special statutul vulnerabil al familiei?

Reclamanții au fost privați de libertate în zona de tranzit în încălcarea articolului 5 § 1 din Convenție (a se vedea mutatis mutandis, Amuur v. Franța , 25 iunie 1996, §§ 38-49, Raportul hotărârilor și hotărârilor 1996 III, Riad și Idiab c. Belgia , nr. 29787/03 și 29810/03, § 68, 24 ianuarie 2008)? Dacă este cazul, reclamanții au avut la dispoziția lor o procedură eficace prin care ar putea contesta legalitatea detenției, conform articolului 5 § 4 din Convenție? Reclamanții au la dispoziția lor un remediu intern eficace pentru plângerea lor în temeiul articolului 3 din Convenție în ceea ce privește tratamentele presupuse inumane sau degradante în zona de tranzit, conform articolului 13 din Convenție?

SUBJECT MATTER OF THE CASE

The application concerns the ongoing confinement, in conditions which are allegedly inhuman, of an Iraqi family (the father, the pregnant mother and their four minor children) to the Tompa transit zone at the border of Hungary and Serbia from 3 April 2017, pending the examination of their asylum requests. QUESTIONS tO THE PARTIES 1. Have the applicants been subjected to inhuman or degrading treatment at the Tompa border transit zone, in breach of Article 3 of the Convention, having regard in particular to the vulnerable status of the family? 2. Were the applicants deprived of their liberty in the transit zone in breach of Article 5 § 1 of the Convention (see, mutatis mutandis, Amuur v.
