Comunicat la 9 octombrie 2017 CUARTĂ SECȚIUNE Cererea nr. 51967/09 Andrey Vladimirovich DUBROV împotriva Ucrainei depusă la 5 iulie 2009 DECLARAȚIEA FACTELOR Reclamantul, dl Andrey Vladimirovich Dubrov, este un național ucrainean care s-a născut în 1975 și este în prezent reținut în colonia corecțională Berezan nr. 95. Faptele cazului, astfel cum au fost prezentate de reclamant, pot fi rezumate după cum urmează. La 25 aprilie 2012, reclamantul a fost arestat pe suspectul de a fi comis o serie de furturi. După arestarea sa, el a fost plasat în centrul de detenție preventivă din Kyiv („Kyiv SIZO”). La 21 mai 2012, Spitalul Kyiv City a informat investigatorul care se ocupă de cazul penal al reclamantului că el a fost înregistrat ca având postul III de HIV și candidiază orofaringeană începând cu 29 februarie 2012. La 19 noiembrie 2012, autoritățile penale au informat mama reclamantului că el a fost deținut în sala medicală a coloniei corecționale Bucha nr. 85. El a fost examinat de către un terapeut în mai multe ocazii. La 15 și 29 mai 2013, reclamantul a depus cereri la Curtea de District Solomyanskyy din Kyiv („Curtea de District”), care se ocupă de cazul său penal, solicitând o examinare legistică pentru a stabili starea de sănătate și furnizarea de tratamente medicale relevante. La 10 septembrie 2013, autoritățile penale au informat mama reclamantului că el a fost reținut în Kyiv SIZO sub supravegherea unui doctor specializat în boli infecțioase. Se menționează că reclamantul a refuzat terapia antiretrovirală foarte activă sugerată. La 7 octombrie 2013, în răspuns la cererea de către Curtea de District din 26 de ani. Septembrie 2013, administrația SIZO a informat instanța că reclamantul a avut stadiul III HIV, candidiaza orofaringeană și dermatită seborrheică. Reclamantul a fost furnizat cu terapie antiretrovirală specifică. Nu există informații în dosar despre decizia Tribunalului de District privind cererile reclamantului din 15 și 29 mai 2013. La 20 martie 2014, administrarea SIZO a informat mama reclamantului că a fost diagnosticat cu HIV etape IV, tuberculoză în etape precoce, hepatită cronică ușoară C, candidiază orofaringeană și dermatită seborrheică. A fost administrat cu terapie de desintoxicare și tratament pentru tuberculoză și HIV. COMPLAINT Reclamantul se plânge în conformitate cu art. 3 din Convenție că a contractat HIV, tuberculoză și hepatită C în timp ce este în detenție și că nu a primit tratamentul necesar pentru bolile sale.

The applicant, Mr Andrey Vladimirovich Dubrov, is a Ukrainian national who was born in 1975 and is currently detained in Berezan correctional colony no. 95.
The circumstances of the case
The facts of the case, as submitted by the applicant, may be summarised as follows.
On 25 April 2012 the applicant was arrested on suspicion of having committed a number of thefts. After his arrest he was placed in the Kyiv pre-trial detention centre (“the Kyiv SIZO”).
On 21 May 2012 the Kyiv City Hospital informed the investigator dealing with the applicant’s criminal case that he had been registered as having stage III HIV and oropharyngeal candidiasis since 29 February 2012.
On 19 November 2012 the penal authorities informed the applicant’s mother that he was being held in the medical ward of Bucha correctional colony no. 85. He had been examined by a therapist on a number of occasions.
On 15 and 29 May 2013 the applicant lodged applications with the Solomyanskyy District Court of Kyiv (“the District Court”), which was dealing with his criminal case, requesting a forensic examination in order to establish his state of health and the provision of relevant medical treatment.
On 10 September 2013 the penal authorities informed the applicant’s mother that he was being held in the Kyiv SIZO under the supervision of a doctor specialising in infectious diseases. It was mentioned that the applicant had refused the highly active antiretroviral therapy suggested to him.
On 7 October 2013, in reply to an application by the District Court of 26
September 2013, the SIZO administration informed the court that the applicant had stage III HIV, oropharyngeal candidiasis, and seborrheic dermatitis. The applicant was being provided with specific antiretroviral therapy. There is no information in the case file about the District Court’s decision on the applicant’s applications of 15 and 29 May 2013.
On 20 March 2014 the SIZO administration informed the applicant’s mother that he had been diagnosed with stage IV HIV, early stage tuberculosis, mild chronic hepatitis C, oropharyngeal candidiasis, and seborrheic dermatitis. He was being provided with detoxification therapy and treatment for tuberculosis and HIV.
The applicant complains under Article 3 of the Convention that he contracted HIV, tuberculosis, and hepatitis C while in detention and that he did not receive the necessary treatment for his diseases.
