Circumstanțele cazurilor Cauzele, astfel cum sunt prezentate de solicitanți, pot fi rezumate după cum urmează. În diferite date, reclamanții au depus o procedură civilă în legătură cu drepturile și obligațiile lor civile. În diferite date, instanța internă a pronunțat hotărâri cu privire la cazurile reclamanților (a se vedea apendicele). Instanțele de apel sau de casă nu au informat în mod corespunzător reclamanții și/sau avocații acestora cu privire la data și ora audierilor (a se vedea apendicele).

Reclamanții se plâng în temeiul articolului 6 § 1 din Convenție că dreptul lor la un proces echitabil a fost încălcat deoarece ei și/sau avocații lor nu au fost informați în mod corespunzător cu privire la data și ora ședințelor dinaintea instanțelor interne care, ca urmare, au avut loc în absența lor și/sau avocaților lor. Reclamanții au avut o audiere echitabilă în determinarea drepturilor și obligațiilor lor civile, în conformitate cu art. 6 § 1 din Convenție?

În special, reclamanții și/sau avocații lor au fost notificați în mod corespunzător cu privire la audieri în fața instanțelor interne (a se vedea Pirali Orujov v. Azerbaidjan , nr. 8460/07 , § 40-46, 3 februarie 2011; Maksimov v. Azerbaidjan , nr. 38228/05, §§ 36-43, 8 Octombrie 2009; Abbasov c. Azerbaidjan , nr. 24271/05, §§ 28-34, 17 ianuarie 2008)? STATEMENT OF FACTS

The particulars of the applicants are set out in the Appendix. The circumstances of the cases The facts of the cases, as submitted by the applicants, may be summarised as follows. On various dates the applicants lodged civil proceedings in connection with their civil rights and obligations. On various dates the domestic courts delivered judgments concerning the applicants’ cases (see Appendix). The appellate or cassation courts failed to duly inform the applicants and/or their lawyers about the date and time of the hearings (see Appendix).

COMPLAINT The applicants complain under Article 6 § 1 of the Convention that their right to a fair trial was breached because they and/or their lawyers were not duly informed of the date and time of the hearings before the domestic courts which, as a result, were held in their and/or their lawyers’ absence QUESTION Did the applicants have a fair hearing in the determination of their civil rights and obligations, in accordance with Article 6 § 1 of the Convention?
