Comunicat la 9 februarie 2018 PRIMEA SECȚIUNE Cerere nr. 7961/15 Oleg Valeriyovych SINKEVYCH împotriva Ucrainei și Rusiei și 14 alte cereri (a se vedea lista adăugată) DECLARAREA FACTELOR Faptele cazurilor, astfel cum sunt prezentate de solicitanți, sunt prezentate în tabelul adăugat. Reclamanții se plâng în temeiul articolului 3 din Convenția privind condițiile sărace de detenție și că au fost umiliți și tratați rău. În toate cererile, cu excepția cererii nr. 17947/15, reclamanții se plâng de asemenea că autoritățile interne nu au luat măsurile necesare pentru efectuarea unei anchete eficace privind presupusul tratament nepotrivit. Reclamanții se plâng, în plus, în temeiul articolului 5 § 1 din Convenția privind ilegalitatea detenției lor. În ceea ce privește toate cererile reclamanților se plâng în temeiul articolului 4 din Convenție, că au fost obligați să facă forța de muncă. În ceea ce privește cererile nr. 17947/15 și 32500/15, reclamanții se plâng, de asemenea, în temeiul articolului 5 § 3 din Convenție, că au fost reținuți fără o procedură judiciară. În ceea ce privește cererea nr. 32500/15, reclamantul se plânge, de asemenea, în temeiul articolului 5 § 4 din Convenție, că nu are dreptul să ia o procedură prin care legalitatea deținerii sale ar fi decisă rapid de către o instanță. În ceea ce privește cererea nr. 32500/15, reclamantul se plânge, de asemenea, în conformitate cu art. 5 § 5 din Convenție, că nu are niciun drept executor de compensare. În ceea ce privește cererile nr. 25342/15 și 29738/15, reclamanții se plâng că au fost forțați să dea interviuri jurnaliștilor cu textele elaborate de captorii lor, în încălcarea articolului 10 din Convenție. În toate cererile, cu excepția cererii nr. 17947/15, reclamanții se plâng că guvernele contestate nu au luat măsurile necesare pentru asigurarea drepturilor convenției, astfel cum prevede art. 13 din Convenția. Prin urmare, nu dispuneau de remedii eficace în acest sens. Infracțiunile presupuse ale Convenției fac obiectul „jurisdicției” statelor respondente în sensul articolului 1 din Convenție? Reclamanții au fost supuși torturelor sau tratamente inumane sau degradante, în încălcarea articolului 3 din Convenție? Reclamanții au fost privați de libertate, în încălcarea articolului 5 § 1 din Convenție? În ceea ce privește toate cererile, faptele se plâng de încălcarea articolului 4 din Convenție? Până la eliberarea sa la 21 februarie 2015 el a fost torturat, maltratat, păstrat în condiții inumane și degradante și obligat să efectueze o muncă forțată. Cazul a fost introdus de dna Kateryna Stanislavivna Zolota, soțul reclamantului. În februarie și martie 2015, reclamantul a depus plângeri la poliție, biroul procurorului și Serviciul de Securitate al Ucrainei. Nu a fost răspuns. Cazul a fost introdus de doamna Olena Mykolayivna Kushnir, soțul reclamantului. Înființat la 9 februarie 2015 de Departamentul de Investigație al Ministerului Internului Ucrainei din Kyiv. Până la eliberarea sa la 20 februarie 2016 el a fost torturat, maltratat, păstrat în condiții inumane și degradante și obligat să efectueze o muncă forțată. Cazul a fost introdus de doamna Yeva Ivanivna Dmytruk, soțul reclamantului. Institutat la 24 noiembrie 2014 de Departamentul de Investigații al Ministerului de Interni al Ucrainei din regiunea Volyn. Până la eliberarea sa pe 18 Decembrie 2016 a fost torturat, maltratat, păstrat în condiții inumane și degradante și obligat să efectueze o muncă forțată. Până la eliberarea sa la 15 martie 2016 el a fost torturat, maltratat, păstrat în condiții inumane și degradante și obligat să efectueze muncă forțată. The applicants complain under Article 3 of the Convention of the poor conditions of their detention and of having been humiliated and ill

In all the applications, except for application no. 17947/15, the applicants also complain that the domestic authorities failed to take measures necessary for carrying out an effective investigation into the alleged ill

treatment.
The applicants furthermore complain under Article 5 § 1 of the Convention of the unlawfulness of their detention.
As regards all the applications the applicants complain under Article 4 of the Convention that they were obliged to do forced labour.
As regards applications nos. 17947/15 and 32500/15, the applicants also complain under Article 5 § 3 of the Convention that they were detained without a court order.
As regards application no. 32500/15, the applicant also complains under Article 5 § 4 of the Convention that he was not entitled to take proceedings by which the lawfulness of his detention would be decided speedily by a court.
