DECIZIA nr. 4470/08 SOCIETATEA SCRIITTORILOR ROMÂNI DIN MOLDOVA și alții împotriva Republicii Moldova Curtea Europeană a Drepturilor Omului (A doua secțiune), ședința la 20 februarie 2018 în calitate de comitet compus din: Paul Lemmens, președinte, Valeriu Grițco, Stéphanie Mourou-Vikström, judecători și Hasan Bakırcı, secretar adjunct al secțiunii, Având în vedere cererea depusă la 23 ianuarie 2008, după deliberare, hotărăște după cum urmează: FACTE O listă a reclamanților este prezentată în apendice. Plainele reclamanților în temeiul art. 11 au fost comunicate Guvernului Moldovei („Guvernul”), reprezentate de agentul lor ad-interim la momentul respectiv, dna R. Revencu. Reclamanții nu au răspuns la ultima scrisoare a Registrului din 19 octombrie 2017 (recepută de reprezentantul lor la 8 noiembrie 2017), reamintind că perioada permisă pentru prezentarea observațiilor lor în răspuns a expirat la 3 ianuarie 2017 și că nu s-a solicitat nici o prelungire a timpului.

Curtea consideră că, în aceste circumstanțe, reclamanții pot fi considerați ca nu mai doresc să își urmărească cererea, în sensul articolului (a) din Convenție. , Curtea nu constată nicio circumstanță specială în ceea ce privește respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale, care necesită examinarea continuă a cazului. Având în vedere cele de mai sus, este oportun să se scoată cazul din listă. Din aceste motive, Curtea decide, în unanimitate, să excludă cererea din lista de cazuri.

DECISION Application no. 4470/08 SOCIETATEA SCRIITORILOR ROMÂNI DIN MOLDOVA and Others against the Republic of Moldova The European Court of Human Rights (Second Section), sitting on 20 February 2018 as a Committee composed of: Paul Lemmens, President, Valeriu Grițco, Stéphanie Mourou-Vikström, judges, and Hasan Bakırcı, Deputy Section Registrar, Having regard to the above application lodged on 23 January 2008, Having deliberated, decides as follows: THE FACTS A list of the applicants is set out in the appendix. The applicants’ complaints under Article 11 were communicated to the Moldovan Government (“the Government”), who were represented by their Agent ad-interim at the time, Ms R. Revencu.

The applicants failed to respond to the last Registry’s letter of 19 October 2017 (received by their representative on 8 November 2017), reminding them that the period allowed for submission of their observations in reply had expired on 3 January 2017 and that no extension of time had been requested. Their attention was drawn to Article 37 § 1 (a) of the Convention. THE LAW The Court considers that, in these circumstances, the applicants may be regarded as no longer wishing to pursue their application, within the meaning of Article 37 § 1 (a) of the Convention. Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and its Protocols which require the continued examination of the case.

In view of the above, it is appropriate to strike the case out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
