SECOND SECTION
DECISION Application no. 60451/21 H.A. against Türkiye The European Court of Human Rights (Second Section), sitting on 27 March 2025 as a Committee composed of: Gediminas Sagatys , President , Stéphane Pisani, Juha Lavapuro , judges , and Viktoriya Maradudina, Acting Deputy Section Registrar, Having regard to the above application lodged on 8 December 2021, Having regard to the interim measure indicated to the respondent Government under Rule 39 of the Rules of Court, Having regard to the decision not to have the applicant’s name disclosed, in accordance with Rule 47 § 4 of the Rules of the Court, Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr H.A., was born in 1993. He was represented by Mr F. Amca, a lawyer practising in Istanbul. On 23 December 2021, the Court decided to indicate to the Turkish Government (“the Government”), under Rule 39 of the Rules of Court, that the applicant should not be removed from Türkiye for the duration of the proceedings before the Court. The applicant’s complaints under Articles 2, 3 and 13 of the Convention concerning the risk of his deportation to Syria were communicated to the Government. On 12 February 2025 the applicant and his representative informed the Registry of the applicant’s intention to withdraw the application. The Government confirmed the applicant’s intention to withdraw on 24 February 2025, stating that he wished to voluntarily return to Syria and providing the relevant voluntary repatriation documents signed by the applicant.
THE LAW In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application. Accordingly, the case should be struck out of the list. The interim measure previously indicated to the Government under Rule 39 of the Rules of Court in this application therefore ceases to have any basis. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
