Genç și Kolsuz împotriva Turciei

Comunicat la 18 septembrie 2018 SECȚIUNE Cerere nr. 62917/12 Fatma GENÇ și alții împotriva Turciei depusă la 26 iulie 2012 OBIECTUL CAUZEI Cererea se referă la presupusa expropriare de facto a unei părți a plăcii de teren ale reclamanților din Diyarbakır. În 2000 municipalitatea Diyarbakır a început să utilizeze planul reclamanților pentru a construi un drum fără să-l fi expropiat. În 2008, în cursul procedurii de despăgubire a reclamanților, municipalitatea a emis o decizie, deducend partea folosită ca drum din terenul reclamantului ca „contribuție la costurile de planificare” (düzenleme ortaklık plăteșteı ), în conformitate cu secțiunea 18 din Legea Zoning. Cazul reclamanților a fost în cele din urmă respins de către instanța internă, care se baza pe această deducere și a constatat că situația nu a putut fi considerată de facto expropriare.

Reclamanții se plâng de încălcarea drepturilor lor în temeiul articolului 1 din Protocolul nr. 1 la Convenție. Autoritățile au efectuat vreo plată reclamanților pentru incapacitatea lor de a beneficia de proprietatea lor în cursul perioadei de începere a utilizării terenurilor lor din Comunitate, fără a hotărî în acest sens până la deducerea efectuată în conformitate cu noul plan de zonare? În caz contrar, a existat o încălcare a dreptului reclamanților la bucuria pașnică a bunurilor lor în sensul art. 1 din Protocolul nr. 1 la Convenție? În special, a fost impusă o sarcină disproporționată în dreptul reclamanților la proprietate între 2000 și 2008? SUBJECT MATTER OF THE CASE

The application concerns the alleged de facto expropriation of part of the applicants’ plot of land in Diyarbakır. In 2000 the Diyarbakır Municipality started using the applicants’ plot with a view to constructing a road without having expropriated it. In 2008, during the course of the proceedings brought by the applicants for compensation, the Municipality issued a decision, deducting the part used as road from the applicant’s land as “contribution to planning costs” ( düzenleme ortaklık payı ), pursuant to Section 18 of the Zoning Law. The applicants’ case was eventually dismissed by the domestic court, which relied on that deduction and found that the situation could not be considered as de facto expropriation.

The applicants complain of a violation of their rights under Article 1 of Protocol No. 1 to the Convention. QUESTIONS tO THE PARTIES Did the authorities make any payment to the applicants for their inability to benefit from their property during the period starting from the Municipality’s use of their land without any decision to that effect until the deduction made in line with the new zoning plan? If not, has there been a violation of the applicants’ right to peaceful enjoyment of their possessions within the meaning of Article 1 of Protocol No. 1 to the Convention? In particular, did the interference in the applicants’ right to property between 2000 and 2008 without compensation impose a disproportionate burden on him?
