A cincea secțiune decizia nr. 68781/17 Andriy Yevgenovych SKRYBKA împotriva Ucrainei Curții Europene a Drepturilor Omului (A Cincea Secțiune), care așeză la 11 octombrie 2018 în calitate de comitet compus din: Yonko Grozev, președinte, Gabriele Kucsko-Stadlmayer, Ltif Hüseynov, judecători și Liv Tigerstedt, grefier interimar, având în vedere cererea depusă la 9 septembrie 2017, Având în vedere observațiile prezentate de Guvernul contestat și observațiile prezentate în răspuns de solicitant, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIU Detaliile reclamantului sunt prezentate în tabelul adăugat. 13 din Convenția privind lungimea excesivă a procedurilor civile și lipsa oricărui remediu eficace în dreptul intern au fost comunicate guvernului ucrainean („Guvernul”).

DREPTUL Curtea, după examinarea tuturor materialelor care i-au fost prezentate și având în vedere jurisprudența sa pe această temă, consideră că plângerile reclamantei în temeiul acestui cap sunt inadmisibile deoarece durata procedurii interne nu a fost excesivă sau irezonabilă, având durat aproximativ trei ani și trei luni timp de trei niveluri de competență (a se vedea Yuryeva și Yuryev c. Ucraina) , nr. 3431/03, § 43, 31 iulie 2012). Având în vedere cele de mai sus, Curtea constată că cererea este evident nefondată și trebuie respinsă în conformitate cu art. 35 §§ 3 și 4 din Convenție. Din aceste motive, Curtea declară în unanimitate cererea inadmisibilă.

FACTS AND PROCEDURE

The applicant’s details are set out in the appended table. The applicant’s complaints under Articles 6 § 1 and 13 of the Convention concerning the excessive length of civil proceedings and the lack of any effective remedy in domestic law were communicated to the Ukrainian Government (“the Government”). THE LAW The Court, having examined all the materials submitted to it and having regard to its case-law on the subject, considers that the applicant’s complaints under this head are inadmissible since the length of the domestic proceedings was not excessive or unreasonable, having lasted roughly three years and three months for three levels of jurisdiction (see, Yuryeva and Yuryev v. Ukraine , no. 3431/03, § 43, 31 July 2012). In view of the above, the Court finds that the application is manifestly ill-founded and must be rejected in accordance with Article 35 §§ 3 and 4 of the Convention.

For these reasons, the Court, unanimously, Declares the application inadmissible. Done in English and notified in writing on 8 November 2018.
