PRIMEI DECIZIE DE SECȚIUNE Această versiune a fost rectificată la 19 februarie 2019 în temeiul articolului 81 din Regulamentul de procedură. Cererea nr. 31757/12 Robert Cezary PRZYBYLSKI împotriva Poloniei și a altor 86 de cereri (a se vedea lista anexată) Curtea Europeană a Drepturilor Omului (prima secțiune), care așezează la 6 noiembrie 2018 în calitate de comitet compus din: Ksenija Turković, președinte, Krzysztof Wojtyczek, Pauliine Koskelo, judecători, și Abel Campos, grefierul secțiunii, având în vedere cererile depuse mai sus la diferitele date indicate în tabelul adăugat, având în vedere declarațiile prezentate de guvernul contestat la 20 februarie și 7 iunie 2018, care solicită Curtea să elimine cererile din lista cazurilor și răspunsul reclamanților la această declarație, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDURA O listă a reclamanților este prezentată în apendice.
Guvernul polonez („Guvernul”) a fost reprezentat de agentul lor, dna J. Chrzanowska, și ulterior de dl J. Sobczak, Ministerul Afacerilor Externe. Toate reclamanții se plângeau în temeiul articolului 6 § 1 din Convenție cu privire la durata excesivă a procedurilor în cazurile lor și în temeiul articolului 13 din Convenția cu privire la lipsa sau insuficientă de remediere pentru durata excesivă a procedurilor acordate de instanțe naționale. Solicitațiile au fost comunicate guvernului. Prin scrisorile din 20 februarie și 7 iunie 2018, Guvernul a informat Curtea că au propus să facă o declarație în vederea soluționării problemelor formulate de cereri.
În fiecare caz, Guvernul a recunoscut o încălcare a articolului 6 § 1 din cauza lungii excesive a procedurilor și a încălcării articolului 13 din cauza lipsei unui remediu eficace, asigurând o soluție suficientă pentru încălcarea articolului 6 § 1. Ei au oferit plata sumelor specificate pentru fiecare reclamant într-un tabel anexat la declarațiile lor. Guvernul s-a angajat în continuare să adopte o serie de măsuri generale în ceea ce privește alte persoane care au fost victime de încălcări similare sau care ar putea fi afectate de încălcări similare în viitor. Sumele menționate mai sus, care sunt specificate în apendicele deciziei, trebuie să acopere orice prejudiciu material și moral, precum și costurile și cheltuielile, vor fi eliberate de orice impozite care ar putea fi aplicabile și vor fi plătite în termen de trei luni de la data notificării hotărârii luate de Curte în temeiul articolului 37 § 1 din Convenție.
În cazul în care aceste sume nu se plătesc în termenul de trei luni, guvernul s-a angajat să plătească dobânzi simple pentru fiecare dintre ele, de la expirarea perioadei respective până la decontare, la o rată egală cu rata marginală de creditare a Băncii Centrale Europene în timpul perioadelor de incumprire plus trei puncte procentuale. În plus, Guvernul a făcut o declarație privind măsurile generale care urmează să fie adoptate în punerea în aplicare a hotărârii pilot Rutkowski și alții (a se vedea Rutkowski și alții c. Polonia , nr. 72287/10 și altele 2, 7 iulie 2015 ) și a solicitat în continuare Curtea să elimine cererile în conformitate cu art. 37 din convenție. În diferite date din 2018, Curtea a primit scrisori din partea reclamanților care au informat Curtea că toate au fost de acord cu termenii declarațiilor guvernamentale.
HOTĂRÂREA având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze în comun într-o singură decizie. Curtea constată că, în urma acordului expres al reclamanților cu termenii declarațiilor formulate de Guvern, cauzele ar trebui tratate ca o soluție prietenoasă între părți.
Curtea a examinat deja declarațiile unilaterale prezentate de Guvern în procedura de judecată pilot în cazul Rutkowski și alții Având în vedere sumele propuse de Guvern în declarațiile lor unilaterale privind măsurile individuale de remediere, nu au existat circumstanțe în ceea ce privește respectarea drepturilor omului, astfel cum sunt definite în Convenția și în Protocolele sale, care ar necesita examinarea continuă a cazurilor în care s-a încheiat o soluție prietenoasă (a se vedea Załuska și Rogalska v. Polonia și 398 alte cereri (dec.), nr. 53491/10 și 72286/10, § 37, 20 iunie 2017). De asemenea, s-a afirmat că, având în vedere măsurile generale luate sau care urmează să fie luate în viitor de guvernul contestat, decontarea a fost bazată pe „respectul drepturilor omului” interpretat în contextul procedurii de judecată pilot (a se vedea ibid, § 45). 10. Prin urmare, Curtea ia act de soluțiile prietenoase atinse între părți și este convins că soluțiile se bazează pe respectul drepturilor omului, așa cum este definit în Convenția și în Protocolele sale, și nu găsește motive pentru a justifica o examinare continuă a cererilor.
11. Având în vedere cele de mai sus, este necesar să se scoată din listă cazurile. Din aceste motive, Curtea, în unanimitate, decide să se alăture cererilor; decide să se elimine cererile din lista cazurilor sale în conformitate cu art. 39 din Convenție.

DECISION This version was rectified on 19 February 2019 under Rule 81 of the Rules of Court. Application no. 31757/12 Robert Cezary PRZYBYLSKI against Poland and 86 other applications (see list appended) The European Court of Human Rights (First Section), sitting on 6 November 2018 as a Committee composed of: Ksenija Turković, President, Krzysztof Wojtyczek, Pauliine Koskelo, judges, and Abel Campos, Section Registrar, Having regard to the above applications lodged on the various dates indicated in the appended table, Having regard to the declarations submitted by the respondent Government on 20 February and 7 June 2018 requesting the Court to strike the applications out of the list of cases and the applicants’ reply to that declaration, Having deliberated, decides as follows:
1. A list of the applicants is set out in the appendix.
2.The Polish Government (“the Government”) were represented by their Agent, Ms J. Chrzanowska, and subsequently by Mr J. Sobczak, of the Ministry of Foreign Affairs.
3.All the applicants complained under Article 6 § 1 of the Convention about the excessive length of proceedings in their cases and under Article 13 of the Convention about the lack of, or insufficient, redress for the excessive length of proceedings granted to them by the national courts.
4.The applications were communicated to the Government.
5.By letters dated 20 February and 7 June 2018 the Government informed the Court that they proposed to make a declaration with a view to resolving the issues raised by the applications. In each case the Government acknowledged a violation of Article 6 § 1 on account of the excessive length of proceedings and violation of Article 13 on account of the lack of an effective remedy, securing sufficient redress for a violation of Article 6 § 1. They offered payment of sums specified in respect of each applicant in a table appended to their declarations. The Government further undertook to adopt a range of general measures in respect of other persons who were victims of similar violations or might be affected by similar violations in the future. The sums referred to above, which are specified in the appendix to the decision, are to cover any pecuniary and non-pecuniary damage as well as costs and expenses, will be free of any taxes that may be applicable. They will be payable within three months from the date of notification of the decision taken by the Court pursuant to Article 37 § 1 of the Convention. In the event of failure to pay these sums within the said three-month period, the Government undertook to pay simple interest on each of them, from expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default periods plus three percentage points. In addition, the Government made a declaration on general measures to be adopted in implementation of the Rutkowski and Others pilot judgment (see Rutkowski and Others v. Poland , nos. 72287/10 and 2 others, 7 July 2015). They further requested the Court to strike out the applications in accordance with Article 37 of the Convention.
6.On various dates in 2018 the Court received letters from the applicants informing the Court that they had all agreed to the terms of the Government’s declarations. THE LAW
7.Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.
8.The Court finds that following the applicants’ express agreement to the terms of declarations made by the Government the cases should be treated as a friendly settlement between the parties.
9.The Court has already examined the unilateral declarations submitted by the Government in the pilot-judgment procedure in the case Rutkowski and Others (cited above). It found that, in view of the amounts proposed by the Government in their unilateral declarations on the individual measures of redress, there have been no circumstances regarding respect for human rights as defined in the Convention and its Protocols which would require the continued examination of the cases where a friendly settlement has been concluded (see Załuska and Rogalska v. Poland and 398 other applications (dec.), nos. 53491/10 and 72286/10, § 37, 20 June 2017). It has also been satisfied that, having regard to the general measures taken or to be taken in the future by the respondent Government, the settlement was based on “respect for human rights” as interpreted in the context of the pilot ‑ judgment procedure (see ibid , § 45).
10.The same conclusions apply to the instant cases. The Court therefore takes note of the friendly settlements reached between the parties. It is satisfied that the settlements are based on respect for human rights as defined in the Convention and its Protocols and finds no reasons to justify a continued examination of the applications.
11.In view of the above, it is appropriate to strike the cases out of the list. For these reasons, the Court, unanimously, Decides to join the applications; Decides to strike the applications out of its list of cases pursuant to Article 39 of the Convention.
