Topçu și alții împotriva Turciei

Comunicat la 13 decembrie 2018 SEGUNDA SECȚIUNE Cerere nr. 24320/11 Nurettin TOPÇU și alții împotriva Turciei depusă la 10 ianuarie 2011 OBIECTUL CAUZEI Cererea se referă la un litigiu între solicitanți și Trezoreria cu privire la unele parcele de teren care au fost supuse a două anchete cadastrale diferite în 1958 și, respectiv, 1973. Deși terenurile în cauză au fost înregistrate în numele Trezoreriei în urma primului sondaj cadastral, acestea au fost înregistrate în numele reclamanților în urma celui de-al doilea sondaj cadastral, deoarece au avut acte de titlu.

La cererea de corecție a registrului de terenuri, proprietatea terenurilor a fost modificată în funcție de primele rezultate cadastrale, care au dus la anularea unora dintre actele de titlu ale reclamanților de către comisia de teren de teren în 1977. Cazul reclamanților de restituire a actelor lor de titlu a fost acceptat de instanța cadastrală în 1980, având în vedere că comisia de înregistrare a terenurilor nu avea nicio competență de a anula sau de a modifica rezultatul final al sondajului cadastral. În 2002, bazandu-se pe primele rezultate cadastrale, registrul de teren a examinat propria moțiune înregistrările referitoare la terenurile în cauză și a anulat actele de titlu ale reclamanților, având în vedere că au încălcat primele rezultate cadastrale.

Reclamanții au contestat această decizie, dar cauza lor a fost respinsă de către instanțe care au constatat că în cazul mai multor sondaje cadastrale privind același teren ar fi luată în considerare doar primul sondaj. Invocând art. 1 din Protocolul nr. 1 la Convenție, reclamanții se plâng că au fost ilicit de proprietatea lor. Reclamanții au epuizat toate căile de recurs interne eficace, în conformitate cu art. 35 § 1 din Convenție? În special, o acțiune bazată pe art. 1007 din Codul Civil constituie un remediu eficace? În cazul în care este cazul, care era termenul pentru o astfel de acțiune și când a început să se execute în cazurile reclamanților? Guvernul este invitat să prezinte exemple de decizii judiciare în situații comparabile și să demonstreze eficacitatea acestui remediu.

Având în vedere actele de titlu ale reclamanților care se bazează pe în cadrul celui de-al doilea sondaj cadastral; reclamanții au avut un bun în sensul articolului 1 din Protocolul nr. 1 la Convenție? Dacă este cazul, în lumina concluziilor atinse în Anna Popova c. Rusia (nr. 59391/12, 4 octombrie 2016) și Gladysheva c. Rusia (nr. 7097/10, 6 decembrie 2011), au înregistrarea terenurilor reclamanților ca proprietate a Trezorului constituie o încălcare a dreptului reclamantului la bucurarea pașnică a posesiunii lor în sensul aceleiași dispoziții?

SUBJECT MATTER OF THE CASE

The application concerns a dispute between the applicants and the Treasury concerning some plots of land which were subjected to two different cadastral surveys in 1958 and 1973, respectively. Although the lands at issue were registered in the name of the Treasury following the first cadastral survey, they were registered in the name of the applicants following the second cadastral survey as they had title deeds. Upon a correction request from the land registry, the lands’ ownership was modified according to the first cadastral results, which gave rise to the annulment of some of the applicants’ title deeds by the land registry commission in 1977. The applicants’ case for the restitution of their title deeds was accepted by the cadastral court in 1980, on the grounds that the land registry commission had had no-competency to cancel or modify the final result of the cadastral survey.

In 2002, relying on the first cadastral results, the land registry examined of its own motion the registrations concerning the lands at issue and cancelled the applicants’ title deeds considering that they violated the first cadastral results. The applicants objected to that decision, but their case was dismissed by the courts which found that in case of several cadastral surveys concerning the same land only the first survey would be taken into account. Invoking Article 1 of Protocol No. 1 to the Convention, the applicants complain that they had been unlawfully deprived of their property. QUESTIONS tO THE PARTIES 1. Have the applicants exhausted all effective domestic remedies, as required by Article 35 § 1 of the Convention?

In particular, did an action based on Article 1007 of the Civil Code constitute an effective remedy? If so, what was the time-limit for such an action and when did it start to run in the applicants’ cases? The Government are invited to submit examples of judicial decisions rendered in comparable situations and showing the effectiveness of this remedy. 2. In view of the applicants’ title deeds relied on during the second cadastral survey; did the applicants have a property within the meaning of Article 1 of Protocol No. 1 to the Convention? If so, in the light of the conclusions reached in Anna Popova v. Russia (no. 59391/12, 4 October 2016) and Gladysheva v. Russia (no. 7097/10, 6 December 2011), did the registration of the applicants’ lands as the property of the Treasury constitute a violation of applicants’ right to peaceful enjoyment of their possession within the meaning of the same provision?
