Publicat la 12 mai 2025 CIFTH SECȚIUNE Aplicația nr. 19922/19 Valeriy Viktorovych KOT împotriva Ucrainei și alte 6 cereri (a se vedea lista anexată) comunicată la 23 aprilie 2025 OBIECTUL CAZULUI Reclamanții se bazează, în special, pe art. 3 din Convenție. O.I. Kolinko (denumită în continuare nr. 41442/19) se plânge că durata detenției sale de la data arestării (31 decembrie) 2014) până la condamnarea sa de către o instanță de primă instanță (9 iunie 2017) și apoi de la data în care această condamnare a fost anulată (1 martie 2018) până la data în care detenția sa într-o instituție de rezervă a fost înlocuită cu o altă măsură (12 noiembrie 2019) a fost incompatibilă cu art. 5 3 din Convenție. El se plânge de asemenea că nu are niciun drept eficace și executiv de compensare pentru deținerea sa în presupusă contravenție cu dispoziția menționată anterior, astfel cum prevede art. 5 din Convenția. 3 din Convenție? Având în vedere protecția procedurală împotriva torturei, tratamente inumane și degradante (a se vedea Labita c. Italia [GC], nr. 26772/95, § 131, CEDH 2000-IV și Kaverzin c. Ucraina , nr. 23893/03, §§§ 169-182, 15 mai 2012), a fost compatibilă cu cerințele articolului 3 din convenție cu privire la plângerea relevantă a reclamantului de către autoritățile interne? Părțile sunt solicitate să furnizeze copii cu toate dosarele medicale și documentele procedurale relevante referitoare la investigarea plângerilor privind tratamentele bolnave formulate de solicitant. Kolinko) A fost durata detenției reclamantului în așteptarea anchetei și procesului în încălcarea cerinței de „tempo rațional” de la art. 3 din Convenție (a se vedea, în special, Ignatov c. The applications concern allegations of ill-treatment by law-enforcement authorities and of a lack of effective domestic investigation in respect of the applicants’ relevant complaints. The applicants rely, in particular, on Article
