Comunicat la 6 februarie 2019 CINTIMEA SECȚIUNE Cererea nr. 8098/18 Isa OZDEMIR împotriva Azerbaidjanului și a altor 4 cereri (a se vedea lista anexată) OBIECTUL CAUZELOR Reclamanților se referă la detenția și îndepărtarea forțabilă în Turcia. Având în vedere afirmațiile reclamanților și informațiile disponibile, reclamanții au/ar expune în Turcia un risc real de tratament contrar articolului 3 din Convenție? Reclamanții au fost privați de libertate în încălcarea articolului 5 § f) din Convenție? Reclamanții au la dispoziția lor o procedură eficace prin care să poată contesta licența deținerii lor în așteptarea îndepărtării, astfel cum se prevede la art. 5 § 4 din Convenție? Reclamanții au o cerere argumentată în temeiul articolului 3 din Convenție în sensul plângerilor în temeiul articolului 13 din Convenție?

În acest caz, reclamanții au la dispoziția lor un remediu intern eficace, astfel cum se prevede la art. 13 din Convenție, prin care ar fi putut contesta îndepărtarea lor din cauza faptului că ar risca să fie supuse torturei sau maltraturilor dacă ar fi fost eliminate? Dacă da, un astfel de remediu a furnizat garanții de accesibilitate, calitate, viteză și efect suspensiv? Guvernul este invitat să facă referire la dispozițiile specifice ale dreptului intern și să furnizeze exemple relevante din jurisprudența instanțelor interne în acest sens. Apendice nr. de cerere nr. SUBJECT MATTER OF THE CASES

The applications concern the applicants’ detention and forcible removal to Turkey. QUESTIONS tO THE PARTIES 1. In the light of the applicants’ claims and the available information, did/would the applicants’ forcible removal to Turkey expose them to a real risk of treatment contrary to Article 3 of the Convention? 2. Were the applicants deprived of their liberty in breach of Article 5 § 1 (f) of the Convention? 3. Did the applicants have at their disposal an effective procedure by which they could challenge the lawfulness of their detention pending removal, as required by Article 5 § 4 of the Convention? 4. Did the applicants have an arguable claim under Article 3 of the Convention for the purposes of their complaints under Article 13 of the Convention?

If so, did the applicants have at their disposal an effective domestic remedy, as required by Article 13 of the Convention, by which they could have challenged their removal on the grounds that they would risk being subjected to torture or ill-treatment if removed? If yes, did such a remedy provide guarantees of accessibility, quality, speed and suspensive effect?
