Comunicat la 7 martie 2019 PRIMEA SECȚIUNE Cerere nr. 48981/17 Nella ARAMBAŠIN împotriva Croației și a altor două cereri (a se vedea lista anexată) OBIECTUL CAUZELOR Reclamanților au dreptul să primească în temeiul legislației interne pentru închirierea apartamentelor lor sub rezerva schemei de închiriere protejată și, în cazul în care nu. 41306/18, incapacitatea reclamantului de a evacua locația protejată și un membru al gospodăriii sale și de a se muta în apartamentul ei sub rezerva acestui sistem.

Nivelul de închiriere protejat a reclamanților a avut dreptul să primească în temeiul legislației interne pentru închiriere a apartamentelor lor supuse schemei de închiriere protejate, în încălcarea dreptului lor la bucurarea pașnică a bunurilor lor garantate de art. 1 din Protocolul nr. 1 la Convenție, având în vedere că nu au putut recupera posesia apartamentelor lor sau să le închirie în condiții de piață (a se vedea Statileo c. Croația , nr. 12027/10, 10 iulie 2014)? Cerere nr. 41306/18: În cazul în care hotărârile instanțelor interne refuză să ordone locația protejată și un membru al gospodăriii ei care trăiesc în apartamentul reclamantului, pentru a-l anula în încălcarea dreptului reclamantului la bucurarea pașnică a bunurilor sale garantate de art. 1 din Protocolul nr. 1 la Convenție, având în vedere nivelul de închiriere protejată, reclamantul a avut dreptul să primească în temeiul legislației interne (a se vedea Statileo, citat mai sus, § 143)? The applications concern the allegedly inadequate level of (protected) rent the applicants have been entitled to receive under the domestic law for lease of their flats subject to the protected lease scheme and, in case no. 41306/18, the applicant’s inability to evict the protected lessee and a member of her household and move into her flat subject to that scheme.
