Comunicat la 23 aprilie 2019 CUARTA SECȚIUNE Cerere nr. 19444/14 Alexandru FIERĂSCU împotriva României și a altor 9 cereri (a se vedea lista anexată) OBIECTUL CAUZUL Toate cererile se referă la echitatea procedurii penale împotriva reclamanților. Toate reclamanții se plâng în temeiul articolului 6 § 1 din Convenție că au fost condamnați injust în urma capcanării de către agenți de stat și că motivul lor de capcană nu a fost examinat în mod corespunzător în cadrul procedurii interne. În plus, în cererile nr. 78458/14 și nr. 22369/2015, reclamanții se plâng în temeiul articolului 6 § 1 din Convenție cu privire la echitatea procedurii penale din cauza faptului că, după ce au fost achitați de instanțele inferioare, acestea au fost condamnate de instanța de ultima instanță fără o examinare directă a acuzatului și/sau a martorilor auziți de instanțele inferioare.

PRIVIND PREZENTAREA COMUN TO PARTE A avut reclamanții o audiere echitabilă în determinarea acuzațiilor penale împotriva acestora, în conformitate cu art. 6 § 1 din Convenție? În special, au fost reclamanții victime de capcană de către agent provocator și au dispunut de garanții procedurale adecvate în acest sens? SUBJECT MATTER OF THE CASE

All the applications concern the fairness of the criminal proceedings against the applicants. All the applicants complain under Article 6 § 1 of the Convention that they were unfairly convicted following entrapment by State agents and that their plea of entrapment was not properly examined in the domestic proceedings. In addition, in applications no. 78458/14 and no. 22369/2015 the applicants complain under Article 6 § 1 of the Convention about the fairness of the criminal proceedings on account of the fact that, after having been acquitted by the lower courts, they had been convicted by the court of last instance without a direct examination of the accused and/or of the witnesses heard by the lower courts.

COMMON QUESTIONS tO THE PARTIES 1. Did the applicants have a fair hearing in the determination of the criminal charges against them, in accordance with Article 6 § 1 of the Convention? 2. In particular, were the applicants victims of entrapment by agent provocateur and did they have appropriate procedural safeguards in that respect?
