Afet Süreyya Eren împotriva Turciei și alte 130 cauze

Rezoluția CM/ResDH(2019)241 Execuția hotărârilor Curții Europene a Drepturilor Omului Ineficacitate a cazurilor de investigație împotriva Turciei (grupul Batı) (Adoptat de Comitetul de Miniștri la 25 septembrie 2019 în cadrul ședinței 1355 a Deputaților Miniștrilor) Comitetul de miniștri, în conformitate cu art. 46 alineatul (2) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea hotărârilor finale ale Curții Europene a Drepturilor Omului (denumită în continuare „Convenția” și „Curtea”, având în vedere hotărârile finale transmise de Curte Comitetului în aceste cazuri (a se vedea lista din apendice) și încălcarea dreptului la viață și interzicerea torturii, inclusiv ineficacitatea anchetelor, urmăririi penale și a procedurilor disciplinare în ceea ce privește uciderea, torturarea și maltraturile presupuse de către forțele de poliție și de securitate între 1993 și 2010 (violații articolelor 2 și 3); Remarcarea încălcărilor de fond în aceste cazuri a fost supravegheată în principal de Comitetul de miniștri în cadrul grupului Aksoy (a se vedea Rezoluția Finală CM/ResDH(2019)51 ), de grupul Oya Ataman (a se vedea Decizia CM/Del/Dec(2016)1259/H46-34 ) și de grupurile Kasa și Erdoğan ( CM/Del/Dec(2017)1302/H46-33 Amintind în plus că, în unele dintre aceste cazuri, Curtea a constatat alte încălcări,

însă că măsurile generale privind aceste încălcări au fost sau sunt examinate de către comitet în contextul altor grupuri de cazuri, și anume: Măsuri care vizează prevenirea lungii excesive a detenției preventive, lipsa unor motive suficiente pentru justificarea acesteia, lipsa unui remediu eficace pentru a-și pune în pericol legalitatea și lipsa dreptului de compensare în ceea ce privește detenția antevențială ilegală au fost luate în cadrul grupului de cazuri Demirel (a se vedea Rezoluția Finală CM/ResDH(2016)332 În cadrul grupului Murat Satık și al altele (a se vedea Rezoluția finală ResDH(2005)75 Măsurile în ceea ce privește lungimea excesivă a procedurilor și introducerea unui remediu eficace în acest sens au fost luate în cadrul grupului Ormancı și al altele de cazuri (a se vedea Rezoluția finală CM/ResDH(2014)298 A se vedea Rezoluția Finală CM/ResDH(2008)83 Çıraklar (a se vedea Rezoluția Finală DH(99)555 ) și grupul Gençel (a se vedea Rezoluția Finală CM/ResDH(2013)256 Măsuri privind absența asistenței juridice în custodia de poliție au fost luate în cadrul grupului de cazuri Salduz (a se vedea Rezoluția Finală (a se vedea Rezoluția Finală CM/ResDH(2013)256 CM/ResDH(2018)219 Măsurile privind admiterea în dosarul declarațiilor care se presupune că au fost obținute sub tratament sau tortura sunt examinate în cadrul grupului de cazuri Hulki Güneș;

Amintind obligația statului contestat, în temeiul articolului 46 alineatul (1) din convenție, de a respecta toate hotărârile finale în cazurile la care a fost parte și că această obligație presupune, peste și peste plata sumelor atribuite de Curte, adoptarea de către autoritățile statului contestat, dacă este necesar: a măsurilor individuale pentru a pune capăt încălcărilor stabilite și a șterge consecințele acestora, astfel încât să atingă, în măsura posibilului, restabilirea în integritate și a măsurilor generale de prevenire a încălcărilor similare; după ce a invitat Guvernul Statului pârât să informeze Comitetul cu privire la măsurile luate pentru a respecta obligația menționată anterior; După examinarea informațiilor furnizate de guvern în ceea ce privește măsurile individuale în aceste cazuri (a se vedea documentele DH-DD(2019)867 DH-DD(2019)793 DH-DD(2019)707 DH-DD(2017)627 și a remarcat cu regret profund, având în vedere aceste informații, faptul că în aceste cazuri nu sunt posibile sau necesare măsuri individuale suplimentare; având în vedere, de asemenea, faptul că justa satisfacție, în cazul în care a fost acordată, a fost plătită de Guvernul Statului pârât; Amintind că problema măsurilor generale necesare ca răspuns la deficiențele constatate de Curte în aceste hotărâri și ineficacitatea anchetelor în ceea ce privește acuzațiile de utilizare excesivă a forței,

în timp ce dispersarea demonstrațiilor pașnice continuă să fie examinată în cadrul ineficacității grupului de investigații (Batı grupul de cazuri și faptul că închiderea acestor cazuri nu prejudecă, prin urmare, evaluarea măsurilor generale necesare a Comitetului; DECLAREA că a exercitat funcțiile sale în temeiul articolului 46 alineatul (2) din Convenție în aceste cazuri în ceea ce privește măsurile individuale și DECIDE pentru a închide examinarea acestor cazuri.

Resolution CM/ResDH(2019)241 Execution of the judgments of the European Court of Human Rights Ineffectiveness of investigations cases against Turkey (Batı group) (Adopted by the Committee of Ministers on 25 September 2019 at the 1355 th meeting of the Ministers’ Deputies) The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”, Having regard to the final judgments transmitted by the Court to the Committee in these cases (see list in appendix) and to the violations of the right to life and prohibition of torture, including ineffectiveness of investigations, criminal prosecutions and disciplinary proceedings in relation to killing, torture and ill-treatment allegedly inflicted by the police and security forces between 1993 and 2010 (violations of Articles 2 and 3); Noting that the substantive violations in these cases have mainly been supervised by the Committee of Ministers under the Aksoy group (see Final Resolution CM/ResDH(2019)51 ), the Oya Ataman group (see decision CM/Del/Dec(2016)1259/H46-34 ) and the Kasa and Erdoğan groups ( CM/Del/Dec(2017)1302/H46-33 );

Recalling further that in some of these cases the Court found other violations, but that general measures in respect of these violations have been or are being examined by the Committee in the context of other groups of cases, namely: - Measures aimed at preventing excessive length of pre-trial detention, lack of sufficient reasons to justify it, lack of an effective remedy to challenge its lawfulness and lack of the right to compensation in respect of unlawful pre-trial detention were taken within the framework of the Demirel group of cases (see Final Resolution CM/ResDH(2016)332 ); - Measures aimed at preventing excessive length of police custody were taken within the framework of the Murat Satık and Others group (see Final Resolution ResDH(2005)75 ); - Measures in relation to excessive length of proceedings and introducing an effective remedy in this respect were taken within the framework of the Ormancı and Others group of cases (see Final Resolution CM/ResDH(2014)298 ); - Measures in relation to the State Security Courts were taken within the framework of the cases of Sertkaya (see Final Resolution CM/ResDH(2008)83 ), Çıraklar (see Final Resolution DH(99)555 ) and the Gençel group (see Final Resolution CM/ResDH(2013)256 );

- Measures relating to the absence of legal assistance in police custody were taken within the Salduz group of cases (see Final Resolution CM/ResDH(2018)219 ); - Measures concerning the admission to the case file of the statements allegedly obtained under ill-treatment or torture are examined under the Hulki Güneș group of cases; Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required: - of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and - of general measures preventing similar violations; Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation; Having examined the information provided by the government as regards the individual measures in these cases (see documents DH-DD(2019)867 , DH-DD(2019)793 , DH-DD(2019)707 , DH-DD(2017)627 ) and noted with deep regret, in the light of this information, that no further individual measures are possible, or required in these cases;

having moreover noted that the just satisfaction, where awarded, was paid by the government of the respondent State; Recalling that the question of general measures required in response to the shortcomings found by the Court in these judgments and ineffectiveness of investigations in respect of allegations of excessive use of force while dispersing peaceful demonstrations continues to be examined within the framework of the ineffectiveness of investigations group ( Batı group) of cases and that the closure of these cases therefore in no way prejudges the Committee’s evaluation of the general measures required; DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in these cases as regards the individual measures and DECIDES to close the examination of these cases.
