Rezoluția CM/ResDH(2019)353 Execuția hotărârilor Curții Europene a Drepturilor Omului 95 de cazuri împotriva Turciei (Adoptat de Comitetul de Miniștri la 11 decembrie 2019 la ședința 1363 a Deputaților Miniștrilor) Comitetul de miniștri, în conformitate cu art. 46 alineatul (2) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea hotărârilor finale ale Curții Europene a Drepturilor Omului (denumită în continuare „Convenția” și „Curtea”, având în vedere hotărârile finale transmise de Curte comitetului în aceste cazuri și încălcările stabilite în temeiul neexecuției sau al întârzierii aplicării deciziilor judiciare interne, mai ales în favoarea entităților deținute sau controlate de stat (violații la art. 6 alineatul (1) și la art. 1 din Protocolul nr.1); Amintind că o serie de cazuri se referă, de asemenea, la o lungime excesivă a procedurilor judiciare (violația articolului 6 alineatul (1) (a fost examinată această chestiune în cadrul grupului Ormancı și alții de cazuri (a se vedea CM/ResDH(2014)298 ); Amintind obligația statului contestat, în temeiul articolului 46 alineatul (1) din convenție, de a respecta toate hotărârile finale în cazurile la care a fost parte și că această obligație presupune, peste și peste plata sumelor atribuite de Curte, adoptarea de către autoritățile statului contestat,

dacă este necesar: a măsurilor individuale pentru a pune capăt încălcărilor stabilite și a șterge consecințele acestora, astfel încât să atingă, în măsura posibilului, restabilirea în integritate; și a măsurilor generale de prevenire a încălcărilor similare; după ce a invitat Guvernul Statului pârât să informeze Comitetul cu privire la măsurile luate pentru a respecta obligația menționată anterior; După examinarea raportului de acțiune furnizat de guvern, care indică măsurile individuale adoptate pentru a da efect hotărârilor, inclusiv informațiile furnizate cu privire la plata satisfacției echitabile acordate de Curte (a se vedea documentul DH-DD(2019)1324 Amintind că problema măsurilor generale necesare în răspunsul la deficiențele constatate de Curte în aceste hotărâri continuă să fie examinată în cadrul Ahmet Kilic (38473/02), Yerebasmaz (14710/03), Bozuyuk (3595/05), Akpınar (416/98), Kranta (31277/03), Kaynak și Cokkalander (34445/08); Kizmaz (34461/08) cazurile; în plus, cele două cazuri din urmă necesită, de asemenea, măsuri individuale; și închiderea cazurilor enumerate mai jos, prin urmare, în nici un caz prejudecă evaluarea continuă a măsurilor generale necesare Comitetului;

DECLAREA că a exercitat funcțiile sale în temeiul articolului 46 alineatul (2) din convenție în cazurile enumerate în apendice în ceea ce privește măsurile individuale și DECIDE să încheie examinarea acestor cazuri.

Resolution CM/ResDH(2019)353 Execution of the judgments of the European Court of Human Rights 95 cases against Turkey (Adopted by the Committee of Ministers on 11 December 2019 at the 1363 rd meeting of the Ministers’ Deputies) The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”, Having regard to the final judgments transmitted by the Court to the Committee in these cases and to the violations established on account of the non-enforcement or delayed enforcement of domestic judicial decisions, mostly delivered against entities owned or controlled by the State (violations of Article 6, paragraph 1, and of Article 1 of Protocol No.1); Recalling that a number of cases also concern excessive length of judicial proceedings (violation of Article 6, paragraph 1) (this issue was examined under the Ormancı and Others group of cases (see CM/ResDH(2014)298 )); Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court,

the adoption by the authorities of the respondent State, where required: - of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum; and - of general measures preventing similar violations; Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation; Having examined the action report provided by the government indicating the individual measures adopted to give effect to the judgments including the information provided regarding the payment of the just satisfaction awarded by the Court (see document DH-DD(2019)1324 ); Recalling that the question of general measures required in response to the shortcomings found by the Court in these judgments continues to be examined within the framework of the Ahmet Kilic (38473/02), Yerebasmaz (14710/03), Bozuyuk (3595/05), Akpınar (41246/98), Kranta (31277/03), Kaynak and Cokkalander (34445/08); Kizmaz (34461/08) cases; that moreover the latter two cases also require individual measures; and that the closure of the cases listed below therefore in no way prejudges the Committee’s continuing evaluation of the general measures required; DECLARES that it has exercised its functions under Article 46, paragraph 2,
