Comunicat la 20 noiembrie 2019 PRIMEA SECȚIUNE Cerere nr. 35063/12 Antonio PERRI și alții împotriva Italiei și a altor 14 cereri (a se vedea lista anexată) OBIECTUL CAUZELOR Cererea se referă la aplicarea legislației retrospective, în special art. 1 § 218 din Legea nr. 266/2005 din 23 decembrie 2005 la procedurile naționale întâmpinate de solicitanți (sau ascendenții sau soții acestora). Reclamanții (sau ascendenții sau soții lor) au fost inițial angajati de autoritățile guvernamentale locale. Atunci când au fost transferate, în temeiul articolului 8 din Legea nr. 124/1999, pentru a lucra pentru Ministerul Educației, Universităților și Cercetării, durata lor de serviciu cu autoritățile guvernamentale locale, angajatorul lor original, nu este pe deplin recunoscută în scopuri financiare și juridice.
Reclamanții (sau ascendenții sau soții lor) au depus proceduri în fața instanțelor interne, susținând că transformarea salariului lor într-o lungime noțională de serviciu cu noul angajator la transfer a fost ilegală și prejudicială. Ei au solicitat plasarea în clasa profesională corespunzătoare lungii lor de serviciu de la data transferului, precum și stabilirea oricărei compensații datorate acestora. Atunci când aceste proceduri erau pendente la diferite niveluri de competență, art. 1 § 218 din Legea nr. 266/2005 din 23 decembrie 2005 a intrat în vigoare. Această dispoziție are ca scop să aducă efect ceea ce legislatorul susține că este intenția inițială a Parlamentului atunci când adoptă art. 8 din Legea nr. 124/1999.
Considerând că această lege interpretativă, instanța internă a respins reclamanții (sau predecesorii acestora). În cursul ultimei proceduri, după hotărârea Curții a Uniunii Europene din 6 septembrie 2011 în Scattolon , C-108/10, Curtea de Cassare a trimis aceste cazuri instanțe competente de recurs pentru a determina dacă reclamanții (sau soții lor ascendenți) au suferit o pierdere substanțială a salariului numai ca urmare a transferului. Prin o serie de hotărâri pronunțate între 2014 și 2017, instanța de recurs a decis că reclamanții nu au suferit o pierdere substanțială a salariului. Mulți solicitanți au apelat împotriva acestor hotărâri. Începând cu 2018, aceste proceduri erau încă în așteptare în fața Curții de Casare.
Reclamanții au epuizat toate căile de recurs interne eficace, în conformitate cu art. 35 § 1 din Convenție? Reclamanții au avut o audiere echitabilă în determinarea drepturilor și obligațiilor lor civile, în conformitate cu art. 6 § 1 din Convenție? În special, a existat interferență legislativă cu administrarea justiției destinată influenței determinarea judiciară a unui litigiu din cauza aplicării retrospective la cazul lor de la art. 1, § 218 din Legea nr. 266/2005 (a se vedea Agrati și alții c. Italia, nr. 43549/08 și altele 2, 7 iunie 2011)? În cazul în care este cazul, această interferență a fost bazată pe motive convingătoare de interes general? A existat o interferență cu bucuria pașnică a reclamanților de bunuri lor, în sensul articolului 1 din Protocolul nr. 1, având în vedere promulgarea articolului 1, § 218, Legea nr. 266/2005?
Dacă este cazul, interferența a impus o sarcină individuală excesivă reclamanților?

The applications concern the application of retrospective legislation, specifically Article 1 § 218 of Law no. 266/2005 of 23 December 2005 to pending national proceedings commenced by the applicants (or their ascendants or spouses). The applicants (or their ascendants or spouses) had initially been employed by the local government authorities. When they were transferred, under Article 8 of Law no. 124/1999, to work for the Ministry of Education, Universities and Research, their length of service with the local government authorities, their original employer, was not fully recognised for financial and legal purposes. The applicants (or their ascendants or spouses) lodged proceedings before the domestic courts arguing that the conversion of their salary into a notional length of service with the new employer upon transfer had been unlawful and detrimental.
They sought placement in the professional grade corresponding to their full length of service from the date of the transfer as well as the determination of any compensation due to them. When those proceedings were pending at different levels of jurisdiction, Article 1 § 218 of Law no. 266/2005 of 23 December 2005 entered into force. This provision intended to give effect to what the legislator claimed to be the original intention of the Parliament when adopting Article 8 of Law no. 124/1999. Relying on that interpretative law the domestic courts dismissed the applicants’ (or their predecessors’) claims. The applicants (or their ascendants or spouses) lodged an appeal.
In the course of the last proceedings, following the judgment of the Court of Justice of the European Union of 6 September 2011 in Scattolon , C-108/10, the Court of Cassation remitted those cases to the competent courts of appeal for determination of whether the applicants (or their ascendants or spouses) had suffered a substantial loss of salary solely as a result of the transfer. By a number of judgments delivered between 2014 and 2017 the courts of appeal ruled that the applicants had not suffered a substantial loss of salary. Many applicants appealed against those judgments. As of 2018 those proceedings were still pending before the Court of Cassation.
1. Have the applicants exhausted all effective domestic remedies, as required by Article 35 § 1 of the Convention? 2. Did the applicants have a fair hearing in the determination of their civil rights and obligations, in accordance with Article 6 § 1 of the Convention? In particular, was there interference by the legislature with the administration of justice designed to influence the judicial determination of a dispute on account of the retrospective application to their case of Article 1, § 218, of Law no. 266/2005 (see Agrati and Others v. Italy , nos. 43549/08 and 2 others, 7 June 2011)? If so, was that interference based on compelling grounds of general interest? 3. Has there been an interference with the applicants’ peaceful enjoyment of their possessions, within the meaning of Article 1 of Protocol No. 1, considering the enactment of Article 1, § 218, Law no. 266/2005?
If so, did the interference impose an excessive individual burden on the applicants?
