DECIZIA nr. 5723/09 Zhamshid Ilmuratovich ALIYEV împotriva Rusiei și a altor 19 cereri (a se vedea lista anexată) Curtea Europeană a Drepturilor Omului (A treia secțiune), care așeză la 4 februarie 2020 în calitate de comitet compus din: Alena Poláčková, președinte, Dmitry Dedov, Gilberto Felici, judecători și Stephen Phillips, grefierul secțiunii, Având în vedere cererile depuse mai sus la diferitele date indicate în tabelul anexat, având în vedere observațiile prezentate de guvernul contestat și observațiile prezentate în răspuns de solicitanți, după deliberare, hotărăsc după cum urmează: Reclamanții sunt resortisanți ruși și resortisanți din alte țări care trăiesc în diferite regiuni ale Federației Ruse și în străinătate.
Detaliile lor personale figurează în tabelul apendice. Guvernul rus ("guvernul") a fost reprezentat inițial de dl G. Matyushkin, reprezentantul Federației Ruse la Curtea Europeană a Drepturilor Omului, și apoi de succesorul său în acest birou, dl M. Galperin. În diferite date între 2007 și 2015, reclamanții au fost urmăriți penal și condamnați pentru diverse infracțiuni în temeiul legislației ruse în vigoare. Informațiile procedurilor interne relevante sunt prezentate în tabelul apendice. COMPLAINTS Reclamanții se plângeau în temeiul articolului 6 §§ §§ și al articolului 3 litera (d) din Convenție că nu le-a fost oferită ocazia de a examina martorii urmăririi judiciare în timpul procesului. HOTĂRÂREA Curții consideră că, în conformitate cu art. 42 § 1 din Regulamentul Curții, cererile enumerate în tabelul adăugat ar trebui să fie aderate.
Guvernul contestat, în observațiile lor, a susținut că reclamanții au avut audieri echitabile în ceea ce privește determinarea acuzațiilor penale împotriva acestora, în conformitate cu art. 6 § 1 din Convenție. Unele solicitanți nu sunt de acord, în timp ce celelalte nu furnizează argumente specifice. Curtea a examinat cu atenție cererile enumerate în tabelul apendice și a concluzionat că, având în vedere preocuparea principală a Curții în temeiul articolului 6 § 1 pentru a evalua echitatea generală a procedurii penale (a se vedea Al-Khawaja și Tahery c. Regatul Unit [GC], nos.
26766/05 și 22228/06, § 118, ECHR 2011, și Schatschaschwili c. Germania [GC], nr. 9154/10, § 101, CEDO 2015), presupunerea că, în principiu, sistemul juridic rus oferă garanții procedurale robuste care asigură dreptul unui acuzat de a examina martorii care depune mărturie împotriva lui, asigurându-se că citirea mărturiei martorilor absenți este posibilă doar ca o excepție (a se vedea Zadumov v. Russia , nr. 2257/12 , § 63, 12 decembrie 2017, recent reiterat în Kiba și alții (dec.), nr. 38047/08 și altele 2, § 16, 17 aprilie 2018), materialul în posesia sa, și în măsura în care chestiunile reclamate sunt în competența sa, cererile sunt vădit nefondate și, prin urmare, trebuie respinse în conformitate cu art. 35 §§§ litera (a) și 4 din Convenție Din aceste motive, Curtea decide, în unanimitate, să se alăture cererilor; cererea inadmisibilă.Fabricată în limba engleză și notificată în scris la 5 martie 2020. The applicants are Russian nationals and nationals of other countries living in various regions of the Russian Federation and abroad. Their personal details appear in the appended table.
The Russian Government ("the Government") were represented initially by Mr G. Matyushkin, the Representative of the Russian Federation to the European Court of Human Rights, and then by his successor in that office, Mr M. Galperin.
On various dates between 2007 and 2015 the applicants were criminally prosecuted and convicted of various offences under the Russian legislation in force. The particulars of the relevant domestic proceedings are presented in the appended table. COMPLAINTS
The applicants complained under Article 6 §§ 1 and 3 (d) of the Convention that they were not provided an opportunity to examine the prosecution witnesses during trial. THE LAW
The Court considers that in accordance with Rule 42 § 1 of the Rules of Court, the applications listed in the appended table should be joined.
The respondent Government in their observations argued that applicants had had fair hearings in the determination of the criminal charges against them in accordance with Article 6 § 1 of the Convention.
Certain applicants disagreed, while the others did not provide specific arguments.
The Court has carefully examined the applications listed in the appended table and concluded that, in the light of the Court’s primary concern under Article 6 § 1 to evaluate the overall fairness of the criminal proceedings (see Al-Khawaja and Tahery v. the United Kingdom [GC], nos. 26766/05 and 22228/06, § 118, ECHR 2011, and Schatschaschwili v. Germany [GC], no. 9154/10, § 101, ECHR 2015), the presumption that in principle the Russian legal system offers robust procedural guarantees securing the right of an accused to examine witnesses testifying against him, ensuring that the reading out of absent witnesses’ testimony is possible only as an exception (see Zadumov v. Russia , no. 2257/12, § 63, 12 December 2017, recently reiterated in Kiba and Others (dec.), nos. 38047/08 and 2 others, § 16, 17 April 2018), the material in its possession, and in so far as the matters complained of are within its competence, the applications are manifestly ill-founded, and thus must be rejected in accordance with Article 35 §§ 3 (a) and 4 of the Convention For these reasons, the Court, unanimously, Decides to join the applications; Declares the applications inadmissible.
