CUARTA DECIZIE DECIZIE Nr. 7338/16 Benty Yasmine CHALOUB și Latifa Moussoukoura CAMARA împotriva Țărilor de Jos, Curtea Europeană a Drepturilor Omului (a patra secțiune), care stă la 15 octombrie 2020 în calitate de comitet compus din: Armen Harutyunyan, președinte, Jolien Schukking, Ana Maria Guerra Martins, judecători și Liv Tigerstedt, grefier adjunct al secțiunii interioare, Având în vedere cererea depusă la 3 februarie 2016, după deliberare, hotărăște după cum urmează: Prima solicitantă, dna Benty Yasmine Chaloub, s-a născut în 1984. Ea este mama celui de-al doilea reclamant, dna Latifa Moussoukoura Camara, care s-a născut în 2013. Ambele solicitanți sunt resortisanți ai Guineei și locuiesc în Rotterdam. În temeiul articolului 3 din Convenție, reclamația reclamanților că, în cazul în care acestea au fost îndepărtate în Guineea, există un risc real că al doilea reclamant ar fi supus mutilării genitale feminine și că primul reclamant ar fi fost forțat să fie recirculat, a fost comunicat guvernului olandez („Guvernul”). Decembrie 2017, acestea au informat Curtea că, la 29 iulie 2020, au acordat reclamanților un permis de ședere în temeiul articolului 8 din Convenție (verblijfsvergunning conform artikel 8 EVRM ), valabil începând cu 12 august 2019 până la 15 iunie 2023. Pe această bază, Guvernul a solicitat Curtea să elimine cazul din lista cazurilor în curs. La 18 septembrie 2020, reprezentantul reclamantului a informat Curtea că reclamanții au vrut să retragă cererea. HOTĂRÂREA Având în vedere cele de mai sus, Curtea consideră că această chestiune a fost rezolvată în sensul articolului 37 § (b) din Convenție și respectul drepturilor omului, astfel cum este definit în Convenție și în protocolele lor, nu solicită ca aceasta să continue examinarea cererii în conformitate cu art. FACTS AND PROCEDURE
The first applicant, Mrs Benty Yasmine Chaloub, was born in 1984. She is the mother of the second applicant, Ms Latifa Moussoukoura Camara, who was born in 2013. Both applicants are nationals of Guinea and live in Rotterdam. They were represented by Ms M.M. Polman, a lawyer practising in Rotterdam.
The applicants’ complaint under Article 3 of the Convention that, if they were removed to Guinea, there was a real risk that the second applicant would be subjected to female genital mutilation and that the first applicant would be forced to undergo re-circumcision, was communicated to the Dutch Government (“the Government”).
After the Government had been given notice of the application on 15
December 2017, they informed the Court that on 29 July 2020 they had granted the applicants a residence permit pursuant to Article 8 of the Convention (
verblijfsvergunning conform artikel 8 EVRM
), valid from 12
August 2019 to 15 June 2023. On this basis, the Government requested the Court to strike the case out of the list of pending cases.
On 18 September 2020 the applicant’s representative informed the Court that the applicants wanted to withdraw the application.
In view of the above, the Court considers that the matter has been resolved within the meaning of Article
37 §
1
(b) of the Convention and that respect for human rights as defined in the Convention and the Protocols thereto does not require it to continue the examination of the application under Article
37
§

Accordingly, the application should be struck out of the list.
For these reasons, the Court, unanimously,
Decides
to strike the application out of its list of cases.
