De asemenea, se referă la lipsa de acces la instanță pentru a contesta înregistrarea proprietății în numele autorităților locale în registrul terenurilor pe baza Legii rutiere din 2011. Transferul de proprietate a unei părți a terenurilor deținute de solicitanți către autoritățile locale a fost efectuat pe baza Legii privind drumurile din 2011, în încălcarea dreptului reclamanților la bucurarea pașnică a bunurilor lor, garantat de art. 1 din Protocolul nr. 1 la Convenție?

Reclamanții au acces la instanță pentru a contesta înregistrarea proprietății în numele autorităților locale în registrul terenurilor pe baza Legii privind drumurile din 2011, conform articolului 6 § 1 din Convenție? SUBJECT MATTER OF THE CASE

The application concerns taking of a part of land owned by the applicants and transferring it into the ownership of the local authorities on the basis of the 2011 Roads Act without compensation. It also concerns the lack of access to court to challenge registration of ownership in the name of the local authorities in the land register on the basis of 2011 Roads Act.

QUESTIONS TO THE PARTIES

1. Was the transfer of ownership of a part of land owned by the applicants to the local authorities on the basis of the 2011 Roads Act, in violation of the applicants’ right to the peaceful enjoyment of their possessions, guaranteed by Article 1 of Protocol No. 1 to the Convention? 2.
