Publicat la 8 noiembrie 2021 SECȚIUNE TERZĂ Cerere nr. 44832/17 Galina Mikhaylovna VELMISKINA împotriva Rusiei și alte 11 cereri (a se vedea lista adăugată) comunicată la 19 octombrie 2021 OBIECTUL CAUZEI În prezent se referă la o interferență presupusă disproporționată cu drepturile de proprietate ale reclamanților (bonafide cumpărătorii) din cauza anulării fără compensare a titlurilor lor asupra parcelelor de teren achiziționate de la alte părți private și înregistrate în Registrul statului consolidat al titlurilor și tranzacțiilor imobiliare (mai multe detalii sunt rezumate în apendicele ) . Anularea a fost rezultatul rei vindicatio reclamațiile formulate de autoritățile împotriva reclamanților și bazate pe diferite nereguli în privatizările inițiale care nu le sunt imputabile.

Instanțele au respins motivul faptului că plățile de teren au părăsit posesia statului (sau, dacă este cazul, a municipiului) împotriva voinței sale (în comparație cu Gladysheva c. Rusia , nr. 7097/10 , §§ 77-82, 6 Decembrie 2011; pentru un exemplu recent legat de parcele de teren a se vedea Seregin și alții c. Rusia , nr. 31686/16 și altele 4 §§ 94-111 , cu alte referințe, 16 martie 2021 . Întrebări comune au fost ingerința în drepturile de proprietate ale reclamanților în conformitate cu cerințele articolului 1 din Protocolul nr. În cazul reclamanților, interferența „a fost sub rezerva condițiilor prevăzute de lege”? A fost interpretarea instanțelor interne a articolelor 196, 200 și 302 din Codul Civil, în măsura în care autoritățile au permis să recupereze bunurile imobiliare de la persoanele private indiferent de buna credință și fără nicio formă de recurs, „previzibil”?

(b) În sensul articolului 1 din Protocolul nr. 1 la Convenție, interferența a constituit un interes public (sau general) legitim, în sensul articolului 1 din Protocolul nr. 1 la Convenție?

(c) A avut loc un echilibru echitabil între cererile interesului general și interesele reclamanților în sensul articolului 1 din Protocolul nr. 1 (a se vedea mutatis mutandis, Seregin și alții c. Rusia , nr. 31686/16 și 4 altele, §§ 94-111, cu alte referințe 16 martie )? În special: (i) Autoritățile au acționat în timp util și în mod corespunzător și consecvent (a se vedea, mutatis mutandis Muharrem Güneș și alții c. Turcia , nr. 23060/08 , § 75, 24 noiembrie 2020; Semenov c. Rusia , nr. 17254/15, §§ 60-64, 16 martie 2021)? (ii) Reclamanții au acționat ca bona fide cumpărătorii, având în vedere principiile dezvoltate de Curte în jurisprudența sa (a se vedea Muharrem Güneș și alții , citate mai sus § 80 , Seregin și alții , citate mai sus §§ 108 109 , și compara și contrast cu Belova c. Rusia , nr. 33955/08 , §§ 40-41 , 15 Septembrie 2020) precum și ținând seama de criteriile stabilite în Hotărârea Conjunctivă a Curții Supreme a Federației Ruse și a Curții Înalte Comerciale a Federației Ruse din 29 aprilie 2010 nr. 10/22 (a se vedea Seregin și alții , citat mai sus § 64)? Părțile sunt invitate să prezinte informații privind dacă hotărârile conexe au fost executate, datele executării lor și statutul actual al parcelelor de teren.

SUBJECT MATTER OF THE CASE

The present cases concern an allegedly disproportionate interference with the property rights of the applicants ( bona fide buyers) on account of the annulment without compensation of their titles to the plots of land acquired from other private parties and registered in the Consolidated State Register of Real Estate Titles and Transactions (more details are summarised in the Appendix) . The annulment was the result of rei vindicatio claims brought by the authorities against the applicants and based on various irregularities in the initial privatisations not imputable to them. The courts rejected the applicants’ bona fide plea on the ground that the land plots left the possession of the State (or, where applicable, of the municipality) against its will (compare with Gladysheva v. Russia , no. 7097/10, §§ 77-82, 6 December 2011; for a recent example related to the plots of land see Seregin and Others v. Russia , nos.

31686/16 and 4 others, §§ 94-111, with further references, 16 March 2021).

QUESTIONS TO THE PARTIES

Common questions 1. Was the interference with the applicants’ property rights in conformity with the requirements of Article 1 of Protocol No. 1? In particular: (a) Was the interference “subject to the conditions provided for by law”? Was the domestic courts’ interpretation of Articles 196, 200 and 302 of the Civil Code in the applicants’ cases, insofar as it allowed the authorities to reclaim the real estate property from the private persons irrespective of their good faith and without any form of redress, “foreseeable”? (b) Did the interference serve a legitimate public (or general) interest, within the meaning of Article 1 of Protocol No. 1 to the Convention? (c) Did the interference strike a fair balance between the demands of the general interest and the interests of the applicants within the meaning of Article 1 of Protocol No. 1 (see, mutatis mutandis, Seregin and Others v.
