Publicat la 13 octombrie 2025 CIFTH SECȚIUNE Aplicația nr. 31680/23 Taras Mykhaylovych KYTRYSH împotriva Ucrainei și a altor 5 cereri (a se vedea lista anexată) comunicată la 26 septembrie 2025 OBIECTUL CAZULUI Reclamanții au fost deținuți în timpul detenției preliminare la Kiev, din mai-iunie 2023. Unele dintre ele au fost eliberate în decembrie 2023 și unele sunt încă în detenție. Invocând art. 2 din Convenție, reclamanții se plâng de absența unui adăpost aerian în centrul de detenție, care, în circumstanțele războiului în curs în Ucraina și în vederea eventualelor declanșări, își pune viața în pericol. Reclamanții se plâng, de asemenea, în temeiul articolului 5 §§ 1 și 3 din Convenție pe care judecătorii naționali se presupunea că nu au dat motive relevante și suficiente în timp ce ordonează și prelungește detenția lor și stabilește o cantitate necorespunzătoare de cauțiune. În plus, reclamanții se plâng în temeiul art. 5 § 4 din Convenție că revizuirea ordinilor de detenție de către Curtea de Apel din Kiev nu a fost rapidă. Dreptul reclamanților la viață, asigurat de art. 2 din Convenție, a fost pus în pericol, așa cum au afirmat ei? În special, a luat guvernul măsuri adecvate pentru a salva viața reclamanților? 2. Instanțele interne au furnizat motive relevante și suficiente în sensul art. 5 §§ 1 și 3 din Convenție în timp ce ordonau și extindeau detenția reclamanților? Au luat în considerare măsuri alternative pentru continuarea detenției reclamanților (a se vedea Kharchenko c. Ucraina , nr. 40107/02, §§ 79-81, 10 februarie 2011, și Korban c. Ucraina , nr. 26744/16, §§ 168-76, 4 iulie 2019)? Valoarea cauțiunei a fost determinată în conformitate cu art. 5 § 3 din Convenție (a se vedea Istomina c. Ucraina , nr. 23312/15, §§ 29-32, 13 ianuarie 2022)? 3. Procedura privind examinarea apelurilor reclamanților împotriva ordinelor de detenție enumerate în tabelul adăugat respectă cerințele articolului 5 § 4 din Convenție, în special cele privind viteza (a se vedea Kharchenko c. Ucraina , nr. 40107/02, § 86, 10 februarie 2011)? 4. Derogarea Guvernului în temeiul articolului 15 din Convenție se aplică în prezent în ceea ce privește drepturile reclamanților la art. 5? The applicants have been held in pre-trial detention in Kyiv Pre-Trial Detention Facility since May-June 2023. Some of them were released in December 2023 and some are still in detention.
Invoking Article 2 of the Convention, the applicants complain about the absence of an air-raid shelter in the detention facility, which, in the circumstances of the ongoing war in Ukraine and in the view of possible shelling, puts their lives in danger. The applicants also complain under Article
5 §§ 1 and 3 of the Convention that the domestic courts allegedly did not give relevant and sufficient reasons while ordering and extending their detention and set an unreasonable amount of bail. Moreover, the applicants complain under Article 5 § 4 of the Convention that the review of the detention orders by the Kyiv Court of Appeal was not speedy.
