INFORMAȚII PROCEDURALE
După o examinare preliminară a admisibilității cererilor pe 5 februarie 2026, Curtea a decis, în conformitate cu Regula 54 § 2 (b) din Regulamentul Curții, că notificarea cererilor ar trebui să fie dată Guvernului Rusiei.
Se observă că chestiunea jurisdicției asupra zonei în care s-a produs incidentul pe care se bazează cererea ridică probleme complexe privind aplicabilitatea Convenției în circumstanțele specifice ale conflictului din Ucraina și ocupația unor zone de către Rusia.
Curtea, după o analiză preliminară, constată că aceste cereri ridică chestiuni grave și complexe privind respectarea dispozițiilor Convenției în contextul actual al conflictului din Ucraina. Iar prin urmare, acestea ar trebui să fie examinate de o Cameră a Curții și nu doar de o Comisie.
Prin urmare, notificarea cererilor Guvernului Rusiei va permite Curții să colecteze observațiile Guvernului și să procedeze la o analiză mai amănunțită a chestiunilor procedurale și de fond ridicate de aceste numeroase aplicații colegate.
Reclamantul Valeriy Ivanovych Darnychenko și ceilalți reclamanti susțin că Rusia a violat mai multe articole din Convenție, inclusiv dreptul la viață, dreptul la libertate și siguranță personală, și alte drepturi fundamentale în contextul conflictului armat din Ucraina.
Curtea a hotărât să ia măsuri pentru a asigura o procedură justă și eficace în legătură cu aceste cereri și pentru a facilita o soluție justa în conformitate cu principiile Convenției.

PROCEDURAL INFORMATION
Following a preliminary examination of the admissibility of the applications on 5 February 2026, the Court decided, under Rule
54 §
2
(b) of the Rules of Court, that notice of the applications should be given to the Government of Russia.
It is to be noted that the issue of jurisdiction over the area where the incidents giving rise to the complaints allegedly took place has been examined and decided by the Grand Chamber of the Court in the case of
Ukraine and the Netherlands v.
Russia
([GC], nos. 8019/16 and 3 others, §§ 327-66, 9 July 2025). The Grand Chamber’s finding will then be applied in these individual cases.
In some applications, other complaints were raised. Their examination has been adjourned, or they have been struck out of the Court’s list of cases or declared inadmissible by the Court, sitting in a single-judge formation, assisted by a rapporteur as provided for in Article 24
§
2 of the Convention.
In the enclosed table, whenever an applicant is referred to using initials, this indicates that the Court has authorised anonymity for that person, whose identity will not be disclosed to the public (Rule 47
