Llukacaj și alții împotriva Albaniei

DECIZIA nr. 11220/09 Sadik LLUKAKAJ împotriva Albaniei și a altor trei cereri (a se vedea tabelul anexat) Curtea Europeană a Drepturilor Omului (Secțiunea a treia), care așeză la 20 octombrie 2022 în calitate de comitet compus din: Andreas Zünd , Președintele Darian Pavli , Frédéric Krenc , judecători și Viktoriya Maradudina, grefierul adjunct al secțiunii interioare; Având în vedere cererile depuse mai sus la diferitele date indicate în tabelul adăugat, având în vedere observațiile prezentate de guvernul contestat și observațiile prezentate în răspuns de solicitanți, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDURĂ Lista reclamanților și detaliile relevante ale cererilor sunt prezentate în tabelul adăugat.

Reclamanții au fost reprezentați de dl B. Muslija, un avocat care practică în Shkodër. Plainele reclamanților în temeiul articolului 6 § 1 din Convenție privind durata excesivă a procedurii civile interne au fost comunicate guvernului albanez („Guvernul”). Având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze în comun într-o singură decizie. Curtea reamintește că, în conformitate cu art. 35 alineatul (2) litera (b) din Convenție, nu trebuie să se ocupe de nici o cerere depusă în temeiul articolului 34 care este substanțial același ca o chestiune care a fost deja examinată de aceasta, cu condiția ca noua cerere să nu conțină informații noi relevante.

În ceea ce privește plângerile reclamanților cu privire la durata procedurii civile în fața Curții Supreme care s-a încheiat la 24 aprilie 2014, Curtea a examinat deja aceste plângeri în hotărârea lui Lacej și Alții Albania ([Comitet], nr. 22122/08, 29 septembrie 2022). În această hotărâre și în ceea ce privește aceeași plângere, Curtea a constatat o încălcare în ceea ce privește reclamanții Kisha Orthodokse Autoqefale e Shqipërisë și Komuniteti musulmanan i Shqipërisë, acordându-i doar satisfacții, și a considerat că plângerile nu sunt admisibile ca ratione personae incompatibile Prin urmare, Curtea constată că aceste cereri sunt semnificativ identice în sensul articolului 35 § 2 litera (b) din Convenție cu cel tratat în hotărârea din Lacej și altele, citată mai sus.

Prin urmare, aceste plângeri trebuie respinse ca fiind inadmisibile în temeiul articolului 35 § 4. Din aceste motive, Curtea, în unanimitate, decide să se alăture cererilor; declara cererile inadmisibile. Adoptate în limba engleză și notificate în scris la 10 noiembrie 2022. FACTS AND PROCEDURE

The list of applicants and the relevant details of the applications are set out in the appended table. The applicants were represented by Mr B. Muslija, a lawyer practising in Shkodër. The applicants’ complaints under Article 6 § 1 of the Convention concerning the excessive length of the domestic civil proceedings were communicated to the Albanian Government (“the Government”). JOINDER OF THE APPLICATIONS

Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision. ALLEGED VIOLATION OF ARTICLE 6 § 1 of the Convention The Court recalls that, under Article 35 § 2 (b) of the Convention, it shall not deal with any application submitted under Article 34 which is substantially the same as a matter which has already been examined by it, provided that the new application contains no relevant new information.

As regards the applicants’ complaints about the length of the civil proceedings before the Supreme Court that ended on 24 April 2014, the Court has already examined these complaints in its judgment of Lacej and Others v. Albania ([Committee], no. 22122/08, 29 September 2022). In this judgment and with respect to the same complaint, the Court found a violation as regards the applicants Kisha Orthodokse Autoqefale e Shqipërisë and Komuniteti Musliman i Shqipërisë, awarding them just satisfaction, and found the complaints inadmissible as incompatible ratione personae with the provisions of the Convention as regards the applicants Llukacaj and Ulqinaku. Accordingly, the Court finds these applications are substantially the same within the meaning of Article 35 § 2 (b) of the Convention as the one dealt with by it in the Lacej and Others judgment, cited above.

Therefore, these complaints must be rejected as inadmissible pursuant to Article 35 § 4. For these reasons, the Court, unanimously, Decides to join the applications; Declares the applications inadmissible. Done in English and notified in writing on 10 November 2022.
