Publicat la 6 martie 2023 PRIMEA SECȚIUNE Cerere nr. 10374/22 Joanna PALIשSKA împotriva Poloniei și a altor 33 de cereri (a se vedea lista anexată) comunicată la 15 februarie 2023 OBIECTUL CAUZELOR Reclamanții au fost părți la proceduri civile referitoare la diferite cereri. Toate acestea, după obținerea hotărârilor la două niveluri de jurisdicție, au depus apeluri de casare la Curtea Supremă ( Såd Najwyższy ). La datele specificate în apendice, Curtea Supremă a respins, respins, refuzat să își dispună de apeluri de casă sau a decis altfel împotriva lor pe fond. În fiecare caz, formarea Camerei Civile a Curții Supreme a fost compusă de judecători desemnați la această instanță de către Președintele Poloniei, în conformitate cu recomandarea Consiliului Național al Judiciului ( Krajowa Rada Sādownictwa , „CNJ” , astfel cum s-a stabilit în temeiul Legii de modificare a NCJ și a anumitor alte statute din 8 decembrie 2017 (usawa o zmianie ustawy o Krajowej Radzie Sādownictwa oraz niektórych innych ustaw ; „Legea 2017” ). Reclamanții se plâng că cauzele lor au fost examinate printr-o formare judiciară a Camerei Civile a Curții Supreme, care a inclus judecătorul desemnat pe recomandarea NCJ, în încălcarea dreptului lor la un „progres independent și imparțial instituit prin lege”, astfel cum este garantat de art. 6 § 1 din Convenție. A fost formarea Camerei Civile a Curții Supreme care a abordat cazurile reclamanților un „procediment independent și imparțial instituit prin lege” conform articolului 6 § 1 din Convenție? The applicants were parties to civil proceedings concerning various claims. All of them, after obtaining rulings at two levels of jurisdiction, lodged cassation appeals with the Supreme Court (
Sąd Najwyższy
). On dates specified in the appendix, the Supreme Court dismissed, rejected, refused to entertain their cassation appeals, or otherwise ruled against them on the merits. In each case the formation of the Civil Chamber of the Supreme Court was composed of judges appointed to that court by the President of Poland, pursuant to the recommendation of the National Council of the Judiciary (
Krajowa Rada Sądownictwa
, “the NCJ”) as established under the Amending Act on the NCJ and certain other statutes of 8 December 2017 (
ustawa o zmianie ustawy o Krajowej Radzie Sądownictwa oraz niektórych innych ustaw

The applicants complain that their cases were examined by a judicial formation of the Civil Chamber of the Supreme Court, which included the judge appointed on the NCJ’s recommendation, in breach of their right to an “independent and impartial tribunal established by law”, as guaranteed by Article 6 § 1 of the Convention.
