Kostyuk împotriva Rusiei și alte 11 cereri

Publicat la 27 martie 2023 SECȚIUNE TERZĂ Cererea nr. 21305/20 Aleksandr Andreyevich KOSTYUK împotriva Rusiei și a altor 12 cereri (a se vedea lista adăugată) INFORMAȚII PROCEDURALE În urma unei examinări preliminare a admisibilității cererilor la 2 martie 2023, Curtea a hotărât, în temeiul articolului 54 alineatul (2) litera (b) din Regulamentul de procedură, că ar trebui să fie comunicată Guvernului Rusiei. În cererile marcate de un asterisc, au fost formulate alte plângeri. Această parte din cereri a fost eliminată din lista de cazuri sau declarată inadmisibilă de către Curte, care a stat într-o formă de un singur judecător, asistat de un raportor, astfel cum se prevede la art. 24 § 2 din Convenție.

În lista închisă a cererilor, ori de câte ori un solicitant este referit la utilizarea inițialelor, acest lucru indică faptul că Curtea a autorizat anonimitatea acestei persoane, a căror identitate nu va fi divulgată publicului (art. 47 § 4). La ora 16:32, reclamantul a fost adus la secția de poliție “Obruchevskoye” la Moscova, unde s-a plâns de durere de cap. Ambulanța a fost chemată numai la sosirea reprezentantului său la ora 17:25. Note de descarcare din data 06/08/2019 din dosarul medical nr. 8935-2019 de către Institutul de Chirurgie pediatră de Urgență și Traumatologie de la Moscova (contuzie cerebrală, vânătăi, abraziuni ale capului, gâtului, umărul stâng). La 06/08/2019, plângerea depusă de mama reclamantului la Comitetul investigativ din districtul Tverskoy/ refuzul de deschidere a unei cauze penale la 07/08/2019. La 30/08/2019, Tribunalul din districtul Tverskoy din Moscova a examinat recursul împotriva refuzului și l-a respins ca fiind nesubstanțiat/La 18/11/2019, Tribunalul din orașul Moscova a susținut această decizie în apel.

La 04/12/2019, Comisia pentru minori delincuenți a constatat că reclamantul a fost vinovat de participare la manifestarea neautorizată în temeiul articolului 20.2 alineatul (5) din CAO și a amendat RUB 10.000 21809/20 28/04/2020 Andrey Vitalievich KURGIN 1981 Diana Rashitovna Fayzullina Kazan Pe data de 03/08/2019, la ora 15.30, reclamantul a participat la o manifestare pentru alegerile echitabile la Duma Moscova. În timpul evenimentului ofițerii de poliție l-au bătut cu târcoale de cauciuc, l-au lovit și l-au lovit pe torso, brațe și picioare. Certificat medical din 04/08/2019 de Clinica Orașului Moscova nr. 15 (multiple vânătăi, abrazii pe ambele brațe, vânături pe coapsa dreaptă).

La 06/08/2019 se plânge de către Departamentul de Investigație al Districtului Tverskoy/ la 07/08/2019 refuzul de înregistrare a plângerii, deoarece nu a fost detectată nici o indicație a acțiunilor criminale de către ofițerii de poliție - utilizarea forței împotriva reclamantului a fost justificată (scrisoarea de către șef al departamentului). La 02/09/2019, Curtea de District Tverskoy din Moscova a respins recursul împotriva scrisorii 07/08/2019 din cauza lipsei subiectului: reclamația reclamantului nu a fost înregistrată de autoritățile de aplicare a legii și nu a fost luată nici o decizie de refuzare a deschiderii unei cauze penale/La 11/11/2019 Curtea de Oraș din Moscova a susținut această decizie în apel.

23911/20* 15/06/2020 Aleksandr Vladiimirovich SVIDERSKIY 1979 Yekaterina Vanslova Nizhniy Novgorod Pe data de 03/08/2019, reclamantul a participat la o manifestare pentru alegerile echitabile la Moscova Duma. În timpul aprecierii la eveniment ofițerii de poliție l-au bătut pe torso și extremități. La ora 16:30 reclamantul a fost adus la secția de poliție “Kuntsevo” și eliberat la ora 10:30 la aceeași dată. nr. 13423 din 05/08/2019 de la prima unitate din Clinica Orașului Moscova nr. 115: contuzii, vânătăi în zona pieptului de la stânga, zona lombară de la stânga, abrazii de articulații genunchiului. La 21/08/2019, se adresează șefului Comitetului investigativ rusesc/la 21/08/2019 scrisoarea refuzând înregistrarea plângerii, deoarece nu au fost detectate nici o indicație a acțiunilor criminale de către ofițerii de poliție - utilizarea forței împotriva reclamantului a fost justificată.

La 27/09/2019 se plânge unitatea de investigații interne a Departamentului de Poliție din Moscova/ la 27/09/2019 refuzul de a efectua o anchetă asupra acuzațiilor. La 17/09/2019, Curtea de District Basmanniy de la Moscova a respins recursul împotriva refuzului 21/08/2019 pentru lipsa obiectului: reclamația reclamantului nu a fost înregistrată de autoritățile de aplicare a legii și nu a fost luată nici o decizie de refuzare a deschiderii unui caz penal/La 24/12/2019 Curtea de Oraș de la Moscova a susținut această decizie privind recursul. La 09/10/2019 Curtea de district Presnenskiy de la Moscova a respins recursul reclamantului împotriva refuzului/pentru 16/12/2019 Curtea de oraș din Moscova a susținut această decizie în apel.

Reclamantul a fost condamnat în temeiul articolului 20.2 § 5 din CAO și condamnat la plata unei amenzi administrative de RUB 20.000. Art. 11 alin. (1) - diverse restricții privind dreptul la libertatea de adunare pașnică - manifestarea "Dopuskay" la 08/03/2019. Convicția în temeiul art. 20.2 alin. (5) din CAO, amendă administrativă de RUB 20.000. Final - Curtea orașului Moscova, 26/09/2019.

Art. 6 alin. (1) - lipsa de imparțialitate a tribunalului având în vedere absența unei partide judecătorești în procedurile administrative-offensive - 26/09/2019, Curtea de Oraș din Moscova (a se vedea Karelin c. Rusia, nr. 926/08, 20 septembrie 2016), Art. 5 (1) - detenție ilegală - Reclamantul luat la secția de poliție ca suspect administrativ: fără dovezi/evaluare că nu era posibil, pe loc, să întocmească înregistrarea infracțională (art. 27.2 § 1 CAO) și să îndeplinească obiectivele prevăzute în art. 27.1 CAO, de exemplu, pentru a stabili identitatea suspectului (a se vedea Korneyeva c. Rusia, nr. 72051/17, § 34, 8 octombrie 2019; Ryabinina și alții v. Rusia [Comitetul], nr. 50271/06 și alte 8 cereri, § 35, 2 iulie 2019). 23914/20* 15/06/2020 Mihail Alekseyevich FAYTO 1990 Yekaterina Vanslova Nizhniy Novgorod La ora 14:40, la data de 03/08/2019, reclamantul a participat la o manifestație pentru alegerile echitabile la Moscova Duma.

În timpul atenției sale la evenimentul pe care ofițerii de poliție l-au lovit pe spate în jos și l-au bătut în mână. La ora 16.20 a fost dus la secția de poliție "Pechatniki", unde s-a plâns în zadar de leziunile. Ambulanța a fost chemată numai la sosirea reprezentantului reclamantului la ora 01/08/2019. nr. 908639562 din 04/08/2019 de la Stația Puchkov Ambulance din Moscova: contuzie a pieptului pe dreapta, contuzie a umărului stâng și antebraț, abrazie a țesuturilor moale ale feței pe stânga, daune la ligamentele degetului mânăi stângi. Înregistrarea medicală nr. 14874 din 05/08/2019: abraziuni multiple ale feței, torso și membrelor, daune la ligamentele degetului. La 16/08/2019 se plânge de către Departamentul de Investigații Interne al Poliției din Moscova / refuză să deschidă un caz penal la 06/09/2019 și 20/09/2019.

La 21/08/2019 se plânge către șeful Comitetului de Investigație al Rusiei /În aceeași dată refuzul de a înregistra plângerea. La 04/10/2019, Curtea de district Presnenskiy din Moscova a respins recursul reclamantului împotriva refuzului de a deschide o anchetă penală/La 16/12/2019, Curtea de oraș din Moscova a susținut această decizie privind recursul. La 17/09/2019, Curtea de District Basmanniy de la Moscova a examinat și respins recursul împotriva refuzului de înregistrare a plângerii din 21/08/2019, declarând că „nu a avut consecințe legale pentru reclamant”/La 24/12/2019, Curtea de Oraș de la Moscova a susținut această decizie privind recursul. Reclamantul a fost condamnat în temeiul articolului 20.2 § 5 din CAO pentru participarea la demonstrație neautorizată și condamnat la plata unei amenzi administrative de RUB 15.000.

31751/20 24/07/2020 Dmitriy Aleksandrovich BATURO 1992 Yekaterina Vanslova Nizhniy Novgorod Pe 06/10/2018 reclamantul a participat la manifestarea „Protestă de durată nelimitată” la Moscova, în timpul căreia doi ofițeri de poliție i-au răsturnat armele, l-au lovit și l-au târât la autobuzul de poliție pentru a fi dus la secția de poliție din districtul Tverskoy. În timp ce pe autobuz, un alt ofițer i-a lovit pe solicitant în piept. La ora 9:00. ambulanța a fost chemată la secția de poliție și a dus reclamantul la spital. Listă de verificare a ambulanțelor de la 06/10/2018 de la Stația Puchkov Ambulance din Moscova: starea pacientului a necesitat spitalizarea. Extragerea din dosarul medical nr. 36352-18 din 12/10/2018 de către Institutul Sklifosovskiy de Urgență din Moscova: spitalizată de la 06/10/2018 la 12/10/2018, pancreatită acută și hematom al umărului stâng, care ar fi putut avea loc ca urmare a unui impact traumatic.

Ultrasunetul abdomenului din 13/10/2018 de către clinica privată “Primul Doctor”: indicații ale creșterii dimensiunilor ficatului, biliardului și spleenului. Examinarea forensică a reclamantului la 06/11/2018 de către Institutul Privat al Științei Forensice din Moscova: traumă plictisitoare a abdomenului: cu posibilă ruptură și microdamă la pâncreas ca urmare a impactului traumatic pe 06/10/2018. La 25/10/2018, reclamantul s-a plâns la comitetul de investigație din districtul Tverskoy și la poliția din Moscova/La 04/12/2018, șeful Unității de Investigații Interne a poliției din Moscova a concluzionat că cei doi ofițeri de poliție nu au folosit forța fizică împotriva reclamantului/La 04/03/2019, comitetul de investigație din districtul Tverskoy a informat reclamantul cu o scrisoare că acuzațiile sale au fost verificate fără a efectua o anchetă și nu au fost stabilite încălcări.

La 26/04/2019, reclamantul s-a plâns în legătură cu scrisoarea din 04/03/2019 la Curtea de District Tverskoy din Moscova, susținând că autoritatea nu a deschis o anchetă privind maltraturile sale/La 15/05/2019, instanța a respins-o pentru lipsa obiectului: nu s-a luat nici o decizie procedurală de refuzare a deschiderii unei cauze penale/La 05/08/2019, Curtea de Oraș din Moscova a respins această hotărâre în apel și a trimis cauzele de procedură/la 14/11/2019 Curtea de District Tverskoy a examinat plângerea și a constatat că a fost examinată în mod corespunzător de poliție și că nu au existat motive de deschidere a unei anchete/La 17/02/2020, Curtea de Oraș din Moscova a susținut această hotărâre în apel.

Art. 13 - lipsa unui remediu eficace în dreptul intern în ceea ce privește plângerile de maltrat. 40094/20* 06/08/2020 Andrey Nikolayevich KOCHENOV 1957 Svetlana Anatolyevna Toreyeva Moscova Pe 05/05/2018 reclamantul a participat la manifestarea „El nu este zar pentru noi”, în timpul căreia a fost lovit în fața și bătut pe cap de șase cossacuri (trupte paramilitare care au asistat oficial poliția) cu acquiescența ofițerilor de poliție din jur. Certificat medical de la Institutul Sklifosovskiy pentru îngrijire de urgență din 05/05/2018: leziuni la țesuturile moale ale capului și a feței. La 05/05/2018 se plânge cu departamentul de poliție din districtul Tverskoy, apoi la 24/07/2018 se plânge cu procurorul/Letter Moscova informand despre refuzul de deschidere a unui caz penal din 14/09/2018.

Nici copie a refuzului, nici informații despre organismul care a luat decizia a fost furnizată. La 07/02/2020 Curtea de district Tverskoy de la Moscova a examinat plângerea reclamantului cu privire la eșecul departamentului de poliție din districtul Tverskoy pentru a investiga maltraturile sale și a respins-o ca fiind nesubstanțiată/La 27/04/2020 Tribunalul de oraș din Moscova a susținut hotărârea în apel. Art. 13 - lipsa unui remediu eficace în dreptul intern în ceea ce privește plângerile de maltrat. 317/21 16/12/2020 Aleksandr Sergeyevich GLUSHAK 1984 Crew împotriva Torturii Nizhniy Novgorod Pe 27/07/2019 reclamantul a participat la o manifestare pentru alegerile echitabile la Duma Moscova în timpul căreia un ofițer de poliție l-a lovit pe torso și a folosit o armă stun pe el.

Apoi a fost dus la o secție de poliție și eliberat la 29/07/2019. Certificat medical din 29/07/2019 de Spitalul Moscova City nr. 23 (bruze și abraziuni pe piept). 47/2010-19 din 07/08/2019 de către Biroul Forense din Moscova: croști din abraziuni sau arsuri care ar fi putut fi cauzate de obiecte cu suprafață traumatică, cauzate până la șapte și cincizeci de zile înainte de examinare. Actul de examinare forense nr. 102/2020 din 05/06/2020 de către același birou: expertul a examinat t-shirt reclamantului: defect în formă rotundă cauzat de efectul termic al unui pistol stun. La 21/08/2019, reclamantul s-a plâns la comitetul investigativ Moscova/La 10/09/2019, plângerea sa a fost transferată la Departamentul de Poliție Tsentralniy din Moscova/Nu a urmat niciun răspuns.

La 19/02/20, reclamantul a contestat inacțiunea poliției în fața Curții de district Presnenskiy din Moscova. La 19/02/20, instanța a refuzat să examineze plângerea pentru lipsa obiectului deoarece reclamantul nu a explicat exact ceea ce investigatorul nu a făcut/La 17/06/2020 Curtea Orașului de Moscova a anulat această decizie privind recursul, a examinat plângerea și a respins-o ca fiind nesubstanțiată. Fără condamnare. 9648/21 24/01/2021 Darya Alekseyevna SOSNOVSKAYA 1993 Tatyana Valeryevna Molokanova Moscova Pe 10/08/2019, reclamantul a participat la o demonstrație pentru alegerile corecte la Duma Moscova, în timpul căreia a fost lovită în stomac de un polițist și lovită pe cap cu un truncheon de către altul.

După aceea a fost dusă la secția de poliție din districtul Taganskiy, unde a fost reținută până la 11/08/2019. Certificat medical din 11/08/2019 de Clinica orașului Moscova nr. 219: leziune a țesutului moale de cap la dreapta. Excert din dosarul medical nr. 2019-49262 din 12/08/2019 de Spitalul Clinic oraș nr. 7: trauma craniocerebrală închisă, contuzie cerebrală și leziune a țesutului moale de cap. La 12/08/2019, reclamația către comitetul de investigație din districtul Tverskoy/La 19/09/2019, șeful comitetului de investigație din districtul Basmanniy, în cazul în care reclamația a fost transferată, a informat reclamantul printr-o scrisoare că reclamația a fost transmisă Departamentului Moscova al Serviciului Gărzilor Ruse pentru anchetă internă/Nu au urmat informații suplimentare.

La 16/10/2019, reclamantul s-a plâns la Curtea de District Basmanniy de la Moscova pentru faptul că autoritățile nu au deschis o anchetă asupra maltraturilor ei/La 23/06/2020, instanța a examinat plângerea și a constatat că nu s-a susținut/La 29/07/2020, Tribunalul orașului Moscova a susținut această decizie privind recursul. Art. 13 - lipsa unui remediu eficace în legislația internă în ceea ce privește plângerile de maltrat. 35101/21* 03/07/2021 Dmitriy Sergeyevich YARTSEV 1988 Anton Igorevich Ryzhov Nizhniy Novgorod Pe 19/01/2020 reclamantul a participat la manifestarea LGBTQ la Moscova în timpul căreia a fost bătut de ofițeri de poliție și apoi la ora 15:30 a fost dus la departamentul de poliție de district Arbat.

El a fost acuzat de o infracțiune administrativă în temeiul art. 6.21 din CAO și eliberat la ora 11:00. Certificat medical de 20/01/2020 de Spitalul Oraș Moscova nr. 13: vânătăi la țesutul moale al capului și piept. Raportul neurochirurgului spitalului, nr. MK 2283/20 din 20/01/2020: vânătăi la țesutul moale al capului și palparea dureroasă a coloanei vertebrale. La 23/01/2020, reclamantul s-a plâns departamentul de investigație din districtul Tsentralniy din Moscova/La 02/06/2020, comitetul a informat reclamantul printr-o scrisoare cu privire la decizia lor de a nu efectua o anchetă cu privire la acuzațiile sale de maltratare.

La 09/07/2020, reclamantul a apelat la șeful Departamentului de Investigație împotriva hotărârii de a nu efectua o anchetă/La 23/10/2022, acesta a respins recursul său/Reclamantul a contestat inacțiunea autorităților în fața Curții de district Presnenskiy de la Moscova/La 02/02/2021, instanța a respins recursul/La 12/05/2021, Tribunalul de Oraș din Moscova a susținut decizia. Acuzațiile împotriva reclamantului au fost respinse. Art. 11 alin. (1) - diverse restricții privind dreptul la libertatea adunării pașnice - Reclamantul s-a plâns că, din cauza violenței poliției împotriva lui în timpul dispersării demonstrației, nu putea să își bucure de dreptul, așa cum se prevede la art. 11 din Convenție (a se vedea Zakharov și Varzhabetyan) v. Rusia, nr. 35880/14 și 75926/17, §§ 77-91, 13 octombrie 2020); Art. 13 - lipsa unui remediu eficace în dreptul intern în ceea ce privește plângerile de maltrat.

38349/21* 15/07/2021 Yelena Grigorievna AREFYEVA 1955 Danil Ilnurovich Kazanleyev La 31/01/2021 reclamantul a participat la o demonstrație în sprijinul lui A. Navalnyy din Chelyabinsk, în timpul căreia un polițist a băgat-o pe teren. Ca urmare a căderei, filmată la cameră, o ambulanță a fost chemată și a dus reclamantul la un spital local. Certificat medical 31/01/2021 de Centrul Trauma nr. 8 din Chelyabinsk: fractură a osului umărului stâng. Raportul de examinare forense nr. 1359 din 26/03/2021 de către Biroul Forense Regional Chelyabinsk: fractura osului umărului stâng care ar fi putut apărea ca urmare a unui impact traumatic în circumstanțele descrise de solicitant. i. La 01/02/2021 plângerea de netratament către secția de poliție din districtul Tsentralniy și la 05/02/2021 către comitetul de investigație Chelyabinsk/La 11/03/2021 aceasta a informat reclamantul printr-o scrisoare că nu există motive pentru efectuarea unei anchete asupra acuzațiilor sale.

ii. La 28/10/2021, în conformitate cu hotărârea instanței din 02/04/2021, comitetul de investigație a efectuat o anchetă și a refuzat să deschidă un caz penal. i. La 23/03/2021, reclamantul a interzis împotriva faptului că autoritățile nu au luat măsuri pentru a verifica acuzațiile sale la Tribunalul de District Tsentralniy din Chelyabinsk/La 02/04/2021, instanța a permis plângerea în întregime/ la 14/05/2021, Curtea Regională de Chelyabinsk a susținut această decizie privind recursul. ii. Reclamantul a apelat împotriva refuzului de la 28/10/2021 la Curtea de District Tsentralniy, care la 15/12/2021 a refuzat să-l examineze deoarece refuzul impugat a fost respins de superiorii investigatorilor la 14/12/2021/ Renunțat la recurs de către Curtea Regională de Chelyabinsk la 04/02/2022.

38372/21 15/07/2021 Yegor Viktorovich POPLEVIN 1992 Danil Ilnurovich Nurgaleyev Kazanev Pe 23/01/2021 reclamantul a participat la o demonstrație în sprijinul A. Navalnyy din Sf. Petersburg în timpul cărora a fost bătut cu truncheons de către patru ofițeri de poliție. Bătaia a fost filmată pe camera. Excert din dosarul medical nr. 8078/C2021 din 26/01/2021 de Spitalul Elisavetinskaya din Sf. Petersburg: traumatii scalpului și leziuni ale țesuturilor moale din partea din spate a capului. i. La 02/02/2021 plângerea către departamentul districtului Tsentralnyy al comitetului de investigație/La 06/03/2021 a informat reclamantul prin scrisoare că plângerea sa a fost transmisă poliției pentru verificarea internă/Nu a fost furnizată informații suplimentare.

ii. La 26/02/202, în conformitate cu hotărârea instanței din 05/10/2021, comitetul de investigație a efectuat o anchetă și a refuzat să deschidă un caz penal/La 06/06/022 că hotărârea a fost respinsă de superiorii investigatorilor, dar reclamantul nu a fost informat cu privire la aceasta. iii. La 06/06/2022 a fost emis un alt refuz de deschidere a unei cazuri penale. La 16/03/2021, reclamantul a contestat faptul că autoritățile nu și-au verificat acuzațiile de maltrat în fața Curții de district Smolninskiy din St Petersburg/La 22/03/2021, instanța a refuzat examinarea plângerii/la 04/08/2021, Curtea de oraș din St Petersburg a respins această decizie privind recursul și a ordonat o nouă examinare a plângerii/La 05/10/2021, Curtea de district Smolninskiy a permis plângerea în întregime.

ii. Reclamantul a apelat împotriva refuzului din 26/02/2022 la Curtea de district Smolninskiy, care la 06/06/2022 a permis în parte să constate că investigatorii nu au luat măsuri pentru a verifica plângerea reclamantului din 02/02/2021 a fost ilegală. 38632/21* 15/07/2021 Fedor Nikolayevich KHUDOKORMOV 2002 Danil Ilnurovich Nurgaleyev Kazan La 02/02/2021 reclamantul a participat la o demonstrație în sprijinul A. Navalnyy din Moscova în timpul cărora a fost lovit pe cap cu un trânșeon de un ofițer de poliție. incidentul a fost filmat pe camera.

Certificat medical 03/02/2021 de către Sklifosovskiy Institute of Emergency Care: leziune craniocerebrală închisă, contuzie cerebrală, leziune a țesutului moale din cap. La 04/02/2021, reclamația adresată comitetului de investigație din districtul Tverskoy/La 09/03/2021, aceasta din urmă a informat reclamantul printr-o scrisoare că acuzațiile sale au fost verificate fără a efectua o anchetă și nu au fost utilizate forțe fizice împotriva acestuia. While on the bus, another officer kicked the applicant in the chest. At 9 p.m. ambulance was called to the police station, and it took the applicant to a hospital. Ambulance checklist of 06/10/2018 by the Puchkov Ambulance Station in Moscow: the patient’s condition necessitated hospitalisation.

Extract from medical file no. 36352-18 of 12/10/2018 by the Sklifosovskiy Institute of Emergency Care in Moscow: hospitalised from 06/10/2018 to 12/10/2018, acute pancreatitis and hematoma of the left shoulder which could have occurred as result of a traumatic impact. Ultrasound of the abdomen of 13/10/2018 by private clinic “First Doctor”: indications of the increase in the size of the liver, gallbladder and spleen. Forensic examination of the applicant on 06/11/2018 by the Private Institute of Forensic Science in Moscow: dull trauma of the abdomen: with possible rupture and microdamage to the pancreas as a result of the traumatic impact on 06/10/2018.

On 25/10/2018 the applicant complained to the Tverskoy district investigative committee and the Moscow police/On 04/12/2018 the Head of the Internal Investigations Unit of the Moscow police concluded that the two police officers had not used physical force against the applicant/On 04/03/2019 the Tverskoy district investigative committee informed the applicant by a letter that his allegations had been verified without carrying out an inquiry and no violations were established.

40094/20* 06/08/2020 Andrey Nikolayevich KOCHENOV 1957 Svetlana Anatolyevna Toreyeva Moscow On 05/05/2018 the applicant participated in manifestation “He is not Tsar to us”, during which he was punched in the face and beaten on the head by six Cossacks (para-military troops who officially assisted the police) with the acquiescence of the surrounding police officers. Medical certificate from the Sklifosovskiy Institute of Emergency Care of 05/05/2018: injuries to soft tissues of the head and the face. On 05/05/2018 complaint with the Tverskoy district police department, then on 24/07/2018 complaint to the Moscow Prosecutor/Letter informing about a refusal to open a criminal case of 14/09/2018.

Neither copy of the refusal nor information about the body which had taken the decision was provided. On 07/02/2020 the Tverskoy District Court in Moscow examined the applicant’s complaint about the failure of the Tverskoy district police department to investigate his ill-treatment and rejected it as unsubstantiated/On 27/04/2020 the Moscow City Court upheld the decision on appeal. No charges were brought against the applicant. Then he was taken to a police station and released on 29/07/2019. Medical certificate of 29/07/2019 by Moscow City Hospital no. 23 (bruises and abrasions on the chest). Forensic examination act no. 47Д-19 of 07/08/2019 by the Moscow Forensic Bureau: crusts from abrasions or burns that could have been caused by objects with traumatic surface, caused up to seven-fifteen days prior the examination. Forensic examination act no. 102/2020 of 05/06/2020 by the same bureau: the expert examined the applicant’s t-shirt: round-shaped defect caused by the thermal effect of a stun gun. On 21/08/2019 the applicant complained to the Moscow Investigative Committee/On 10/09/2019 his complaint was transferred to the Tsentralniy Police Department in Moscow/No reply followed.

On 19/02/2020 the applicant contested the police inaction before the Presnenskiy District Court in Moscow. On 19/02/2020 the court refused to examine the complaint for the lack of subject-matter as the applicant had allegedly failed to explain what exactly the investigator had not done/On 17/06/2020 the Moscow City Court quashed that decision on appeal, examined the complaint and dismissed it as unsubstantiated. After that she was taken to the Taganskiy district police station, where she was detained until 11/08/2019. Medical certificate of 11/08/2019 by the Moscow Town Clinic no. 219: injury of the soft tissue of the head to the right. Excerpt from medical file no. 2019-49262 of 12/08/2019 by Town Clinical Hospital no. 7: closed craniocerebral trauma, brain concussion and injury of the soft tissue of the head. On 12/08/2019 complaint to the Tverskoy district investigative committee/On 19/09/2019 the head of the Basmanniy district investigative committee, where the complaint had been transferred, informed the applicant by a letter that the complaint had been forwarded to the Moscow Department of the Russian Guards Service for internal investigation/No further information followed.

On 16/10/2019 the applicant complained to the Basmanniy District Court in Moscow about the authorities’ failure to open an inquiry into her ill-treatment/On 23/06/2020 the court examined the complaint and found it unsubstantiated/On 29/07/2020 the Moscow City Court upheld that decision on appeal. On 09/07/2020 the applicant appealed to the Head of the Investigative Department against the decision not to carry out an inquiry/On 23/10/2022 the latter dismissed his appeal/ The applicant contested the authorities’ inaction before the Presnenskiy District Court in Moscow/On 02/02/2021 the court dismissed the appeal/On 12/05/2021 the Moscow City Court upheld the decision.

The charges against the applicant were dropped. Navalnyy in Chelyabinsk, during which a police officer shoved her on the ground.

As a result of the fall, which was filmed on camera, an ambulance was called and took the applicant to a local hospital. Medical certificate of 31/01/2021 by Trauma Centre no. 8 in Chelyabinsk: fracture of the left shoulder bone. Forensic examination report no. 1359 of 26/03/2021 by the Chelyabinsk Regional Forensic Bureau: fracture of the left shoulder bone which could have occurred as a result of a traumatic impact in the circumstances described by the applicant. i. On 01/02/2021 the ill-treatment complaint to the Tsentralniy district police station and on 05/02/2021 to the Chelyabinsk investigative committee/On 11/03/2021 the latter informed the applicant by a letter that there were no grounds for carrying out an inquiry into her allegations.

ii. On 28/10/2021, in compliance with the court’s decision of 02/04/2021, the investigative committee carried out an inquiry and refused to open a criminal case. i. On 23/03/2021 the applicant appealed against the authorities’ failure to take steps to verify her allegations to the Tsentralniy District Court in Chelyabinsk/On 02/04/2021 the court allowed the complaint in full/ on 14/05/2021 the Chelyabinsk Regional Court upheld that decision on appeal. ii. The applicant appealed against the refusal of 28/10/2021 to the Tsentralniy District Court, which on 15/12/2021 refused to examine it as the impugned refusal had been overruled by the investigators’ superiors on 14/12/2021/ Upheld on appeal by the Chelyabinsk Regional Court on 04/02/2022.

On 26/02/2022 in compliance with the court’s decision of 05/10/2021, the investigative committee carried out an inquiry and refused to open a criminal case/On 06/06/022 that decision was overruled by the investigators’ superiors, but the applicant was not informed thereof. iii. On 06/06/2022 another refusal to open a criminal case was issued. The applicant was not informed thereof. i. On 04/02/2021 complaint to the Tverskoy district investigative committee/On 09/03/2021 the latter informed the applicant by a letter that his allegations had been verified without carrying out an inquiry and no physical force against him had been used. No further information was provided/On 24/05/2021 the applicant was informed that the Russian Guard Service had carried out an internal inquiry which did not disclose any violations of his rights.
