Nikolaou și alții împotriva Ciprului

Publicat la 27 martie 2023 SECȚIUNEA TERZĂ Cererea nr. 37068/18 Maria NIKOLAOU și alții împotriva Ciprului depusă la 31 iulie 2018 comunicată la 8 martie 2023 OBIECTUL CAUZEI Cererea se referă la expropriarea terenurilor reclamanților în 1976 pentru crearea unei zone industriale. Reclamanții au solicitat instanțelor interne să le revină proprietatea susținând că scopul expropriației nu a fost atins. La 2 februarie 2018, Curtea Supremă, cu trei voturi împotrivă două, a respins apelul reclamanților. În baza articolului 1 din Protocolul nr. 1 reclamanții se plâng că proprietatea lor a fost expropriată fără a exista un interes public, că aceasta a rămas nedezvoltată timp de patruzeci și doi ani, în timp ce a fost folosită uneori de alte persoane pentru alte scopuri decât cele prevăzute de expropriare.

În sensul articolului 1 din Protocolul nr. 1 a existat vreo interferență cu bucuria pașnică a reclamanților în ceea ce privește bunurile lor, în sensul articolului 1 din Protocolul nr. 1? Dacă este cazul, interferența în interesul public și în conformitate cu condițiile prevăzute de lege, în sensul articolului 1 din Protocol Nr. 1? În special, s-a constatat un echilibru echitabil între cererile interesului general al comunității și cerințele protecției drepturilor fundamentale ale reclamanților (a se vedea, printre altele, Mifsud și alții v. Malta, nr. 38770/17, §§ 59 și 90, 13 octombrie 2020, și Kececioğlu și alții v. Turcia , nr. 37546/02, §§ 25-28, 8 aprilie 2008)? Guvernul ar trebui să precizeze utilizarea terenului și să producă dovezi relevante.

SUBJECT MATTER OF THE CASE

The application concerns the expropriation of the applicants’ land in 1976 for the creation of an industrial area. The applicants applied to the domestic courts to have the property returned to them claiming that the purpose of the expropriation had not been attained. On 2 February 2018 the Supreme Court, by three votes to two, dismissed the applicants’ appeal. Relying on Article 1 of Protocol No. 1 the applicants complain that their property had been expropriated without there being a public interest, that it had remained undeveloped for forty-two years while it had been used at times by other individuals for purposes other than those prescribed by the expropriation.

QUESTION TO THE PARTIES

Has there been an interference with the applicants’ peaceful enjoyment of their possessions, within the meaning of Article 1 of Protocol No. 1? If so, was the interference in the public interest and in accordance with the conditions provided for by law, within the meaning of Article 1 of Protocol No. 1? In particular, has a fair balance been struck between the demands of the general interest of the community and the requirements of the protection of the applicants’ fundamental rights (see, among other authorities, Mifsud and Others v. Malta , no. 38770/17, §§ 59 and 90, 13 October 2020, and Keçecioğlu and Others v. Turkey , no. 37546/02, §§ 25-28, 8 April 2008)? The Government should specify the use made of the land and produce relevant evidence.
