Rezoluția interimar DH (2000) 86 Cererea nr. 39966/98 De Cantelar împotriva Franței (aprobat de Comitetul de miniștri la 29 mai 2000 la a 709-a ședință a Deputaților Miniștri) Comitetul de miniștri, în conformitate cu art. 32 din Convenția privind protecția drepturilor omului și libertăților fundamentale (denumit în continuare „Convenția”), având în vedere raportul elaborat la 9 septembrie 1999 de Comisia Europeană a drepturilor omului, în conformitate cu art. 31 din Convenția privind aplicarea depusă la 14 decembrie 1997 de către un național francez, dl Robert De Cantelar, împotriva Franței; întrucât, la 14 octombrie 1999, Comisia a transmis raportul menționat la Comitetul de miniștri și întrucât perioada de trei luni a fost decursă fără a fi fost introdusă în instanța Curții Europene de drepturi omului în conformitate cu art. 48 din Convenția respectivă; întrucât în cererea sa, declarată admisibilă de Comisie la 27 octombrie 1998, reclamantul de lungime a unui anumit proces cu privire la obligațiile de munci;

The Committee of Ministers, under the terms of Article
32 of the Convention for the Protection of Human Rights and Fundamental Freedoms (hereinafter referred to as “the Convention”),
Having regard to the report drawn up on 9 September 1999 by the European Commission of Human Rights in accordance with Article 31 of the Convention relating to the application lodged on 14
December 1997 by a French national, Mr
Robert De Cantelar, against France;
Whereas on 14 October 1999 the Commission transmitted the said report to the Committee of Ministers and whereas the period of three months provided for in Article
32, paragraph
1, of the Convention has elapsed without the case having been brought before the European Court of Human Rights pursuant to Article
48 of the Convention;
Whereas in his application, declared admissible by the Commission on 27 October 1998, the applicant complained of the length of certain proceedings regarding civil rights and obligations before labour courts;
Whereas in its report the Commission expressed, unanimously, the opinion that there had been a violation of Article
6, paragraph
1, of the Convention;
Whereas at the 709th meeting of the Ministers’ Deputies, the Committee of Ministers, having voted in accordance with the provisions of Article 32, paragraph 1, of the Convention, and agreed with the opinion expressed by the Commission, held, by a decision adopted on 29 May 2000, that there had been in this case a violation of Article
6, paragraph 1, of the Convention,
Authorises the publication of the report adopted by the Commission in this case;
Decides to pursue the examination of the present case, in accordance with Article
32 of the Convention with a view to adopting the final resolution.
