Ponomarev împotriva Rusiei și alte 44 cereri

Publicat la 30 mai 2023 SECȚIUNE TERZă Cererea nr. 12205/18 Sergey Aleksandrovich PONOMAREV împotriva Rusiei și a altor 44 de cereri (a se vedea lista anexată) INFORMAȚII PROCEDURALE În urma unei examinări preliminare a admisibilității cererilor la 4 mai 2023, Curtea a hotărât, în temeiul articolului 54 alineatul (2) litera (b) din Regulamentul de procedură, că ar trebui să fie comunicată Guvernului Rusiei. În cererile marcate de un asterisc, au fost formulate alte plângeri. Această parte din cereri a fost eliminată din lista de cazuri sau declarată inadmisibilă de către Curte, care a stat într-o formă de un singur judecător, asistat de un raportor, astfel cum se prevede la art. 24 § 2 din Convenție.

În lista închisă a cererilor, ori de câte ori un solicitant este referit la utilizarea inițialelor, acest lucru indică faptul că Curtea a autorizat anonimitatea acestei persoane, a căror identitate nu va fi divulgată publicului (art. 47 § 4). La 12/05/2017, un tribunal a autorizat o vizită pe termen lung, dar administrația SIZO-3 a refuzat să-l furnizeze.

Se pare că din 2016, atunci când cazul a fost transferat în instanța de judecată, interdicția a fost susținută numai în ceea ce privește mama sa: reclamantul a fost refuzat apeluri telefonice și vizitele de la ea, deoarece la un moment dat în timpul procesului, el a transmis o scrisoare, declarând punctul său de vedere asupra urmăririi sale penale. 8739/19 01/02/2019 Aleksandr Dmitriyevich POLKOVNIKOV 1989 Aleksandr Vasilievich Artamonov Moscova SIZO-5 Regiunea Moscova refuzul vizitelor familiale pe termen scurt Pe 04/08/2018 avocatul reclamantului a solicitat o vizită pe termen scurt pentru mama reclamantului. La 20/12/2018, investigatorul a refuzat. Reclamantul a apelat împotriva deciziei. La 22/01/2019, Curtea de District Vakhitovskiy și-a respins cererile. Reclamantul a solicitat o vizită și a apelat de mai multe ori. Ultimul lucru: refuzul investigatorului din 22/03/2019; Curtea de District Vakhitovskiy, 09/04/2019; Curtea Supremă a Republicii Tatarstan, 21/05/2019. Pe 04/10/2019, reclamantul a fost transferat la centrul de corecție, după condamnarea sa. Membrii familiei: soția și fiul. Pe 29/05/2019 Avocatul lui B. a prezentat o cerere de vizită de familie în numele reclamanților. În aceeași zi, investigatorul a refuzat cererea de a declara, printre altele, că B. ar putea folosi vizita pentru a obstrucționa ancheta și că investigatorul are discreția de a autoriza vizite, dar nu a fost obligat să facă acest lucru. La 29/08/2019 Curtea de District Tverskoy din Moscova a respins plângerea reclamanților.

Refuzurile vizitelor de familie pe termen scurt la 04/12/2018, 13/12/2018, 21/12/2018, 31/01/2019. La 27/03/2019 Curtea de District Basmanny din Moscova a respins plângerea reclamantului (renunțată la recurs la 17/07/2019, Curtea de Oraș din Moscova). În momentul în care reclamantul a fost logodnica unui deținut. Ea a fost, de asemenea, martoră în cazul său penal. Vizitele sale la centrul de detenție anterioară au fost refuzate pe baza faptului că comunicarea ei cu acuzatul ar putea influența ancheta. Vizitele au fost refuzate timp de cel puțin un an, ceea ce pare a fi excesiv, chiar dacă ea este martoră în acest caz. Al doilea reclamant a fost în detenție începând cu 04/03/2021. Reclamanții au fost autorizați vizite pe termen scurt la 10/03/2021 și 18/03/2021. Following a preliminary examination of the admissibility of the applications on 4 May 2023, the Court decided, under Rule 54 § 2 (b) of the Rules of Court, that notice of the applications should be given to the Government of Russia. On 29/05/2019 B.’s counsel submitted an application for a family visit on behalf of the applicants. On the same day the investigator refused the request stating, inter alia, that B. could use the visit to obstruct the investigation and that the investigator had discretion to authorise visits but was not obliged to do so. On 29/08/2019 the Tverskoy District Court of Moscow dismissed the applicants’ complaint.

At the relevant time the applicant was a fiancée of a detainee. She was also a witness in his criminal case. Her visits to the pre-trial detention facility were refused based on the fact that her communication with the accused could influence the investigation. The visits were refused for at least a year, which appears to be excessive, even though she is a witness in the case.
