Publicat la 28 august 2023 SECȚIUNE TERZĂ Cererea nr. 1458/23 Ioannis STAMELOS împotriva Greciei și alte 26 de cereri (a se vedea lista anexată) comunicată la 12 iulie 2023 OBIECTUL CAZULUI Cerințele se referă la eficacitatea noului remediu juridic intern în ceea ce privește condițiile de detenție în Grecia introduse în temeiul legii nr. 4985/2022, adăugat la art. 6A din Lege nr. 2776/1999 (Codul penitenciar). Reclamanții se plâng în temeiul articolului 3 din Convenție cu privire la condițiile de detenție ale acestora în închisoarea Korydallos. În conformitate cu art. 13 din Convenție, reclamanții se plâng de lipsa unui remediu intern eficace în ceea ce privește plângerile lor privind condițiile de detenție.

La 4 noiembrie 2022, toate reclamanții au făcut uz de noul remediu juridic în fața Curții de Execuție a sentințelor ( ) solicitând o îmbunătățire a condițiilor de detenție și o compensare pentru daune în ceea ce privește condițiile de detenție ale acestora. Ele susțin că Curtea pentru executarea sentințelor nu a emis o decizie în termenul legal de 30 de zile, astfel cum se prevede la art. 6A din Legea nr. 2776/1999. La 28 aprilie 2023, Curtea pentru executarea sentințelor, prin decizia finală nr. 338/2023, respins cererile lor, unele dintre acestea ca inadmisibile și altele ca nefondate.

Întrebări PENTRU PARTE Face condițiile de detenție a reclamanților constituie un tratament inuman sau degradant în încălcarea articolului 3 din Convenție (a se vedea Muršić v. Croația [GC], nr. 7334/13, 20 octombrie 2016)? Reclamanții au la dispoziția lor un remediu intern eficace în ceea ce privește plângerea în ceea ce privește condițiile de detenție în temeiul articolului 3 conform articolului 13 din Convenție? Ar putea fi considerată eficace remediul juridic intern prevăzut în temeiul legii nr. 4985/2022, adăugat la art. 6A din Legea nr. 2776/1999, în sensul articolului 13 din Convenție? În special, acest remediu ar putea fi considerat ca un remediu preventiv și/sau compensatoriu eficace în sensul articolului 13 din Convenție (a se vedea J.M.B.

și alții c. Franța , nr. 9671/15 și altele 31 , § 208, 30 ianuarie 2020; Ulek c. Croația , nr. 21613/16, §§ 71-74, 31 octombrie 2019; și Ananiev și alții c. Rusia , nr. 42525/07 și 60800/08, §§ 93-99, 210-231, 10 ianuarie 2012)? Guvernul este solicitat să furnizeze exemple de jurisprudența internă relevantă în aplicarea remediului legal prevăzut în temeiul legii nr. 4985/2022, adăugat la art. 6A din lege nr. 2776/1999.

Application no. 1458/23 Ioannis STAMELOS against Greece and 26 other applications (see list appended) communicated on 12 July 2023

SUBJECT MATTER OF THE CASES

The applications concern the effectiveness of the new domestic legal remedy in respect of conditions of detention in Greece introduced by virtue of law no. 4985/2022, as added to article 6A of law no. 2776/1999 (Penitentiary code). The applicants are all prisoners who are currently detained in Korydallos prison. The applicants complain under Article 3 of the Convention about the conditions of their detention in Korydallos prison. Under Article 13 of the Convention the applicants complain of the lack of an effective domestic remedy in respect of their complaints regarding the conditions of detention. On 4 November 2022, all applicants made use of the new legal remedy before the Court for the Execution of Sentences ( Δικαστήριο Εκτέλεσης Ποινών ) requesting an improvement of the conditions of their detention and a compensation for damages in relation to the conditions of their detention.

They submit that the Court for the Execution of Sentences did not issue a decision within the legal deadline of 30 days as stipulated in article 6A of law no. 2776/1999. On 28 April 2023 the Court for the Execution of Sentences, by final decision no. 338/2023, rejected their applications, some of them as inadmissible and others as unfounded.

QUESTIONS TO THE PARTIES

1. Do the conditions of the applicants’ detention amount to inhuman or degrading treatment in breach of Article 3 of the Convention (see Muršić v. Croatia [GC], no. 7334/13, 20 October 2016)? 2. Do the applicants have at their disposal an effective domestic remedy in respect of their complaint regarding the conditions of their detention under Article 3, as required by Article 13 of the Convention? Could the domestic legal remedy provided by virtue of law no. 4985/2022, as added to article 6A of law no. 2776/1999, be considered effective within the meaning of Article 13 of the Convention? In particular, could this remedy be considered as an effective preventive and/or compensatory remedy within the meaning of Article 13 of the Convention ( see J.M.B.
