ADAMICEK v. THE CZECH REPUBLIC

Reclamantul, dl Richard Adamíček, este un ceh care s-a născut în 1964 și locuiește în Napajedla. El a fost reprezentat în fața Curții de către dl I. Juřena, un avocat în Zlín. Guvernul ceh („Guvernul”) a fost reprezentat de agentul lor, dl V.A. Schorm, de la Ministerul Justiției. Faptele cazului, astfel cum au fost prezentate de părți, pot fi rezumate după cum urmează. La 25 februarie 1997, reclamantul a depus o acțiune la Curtea de district Zlín (okresní soud) împotriva unui anumit B.D., cerând plata CZK 352,000 (13,541). The applicant, Mr Richard Adamíček, is a Czech national who was born in 1964 and lives in Napajedla. He was represented before the Court by Mr I. Juřena, a lawyer practising in Zlín. The Czech Government (“the Government”) were represented by their Agent, Mr V.A. Schorm, from the Ministry of Justice. The facts of the case, as submitted by the parties, may be summarised as follows. On 25 February 1997 the applicant lodged an action with the Zlín District Court (okresní soud) against a certain B.D., seeking the payment of CZK 352,000 (EUR 13,541). It appears that the proceedings are still pending. The relevant domestic law and practice concerning remedies for the allegedly excessive length of judicial proceedings are set out in the Court’s decision in the case of Vokurka v. Czech Republic, no. 40552/02 (dec.), §§ 11-24, 16 October 2007).
