În cazul Boljević și alții c. Muntenegru, Curtea Europeană a Drepturilor Omului (prima secțiune), ședința în calitate de comitet compus din: Péter Paczolay , Președintele Gilberto Felici , Raffaele Sabato , judecători și Viktoriya Maradudina, grefierul adjunct al secțiunii interioare, având deliberat în particular la 4 aprilie 2024, emite următoarea hotărâre, care a fost adoptată la data respectivă: PROCEDURA Cazul a fost originar dintr-o cerere împotriva Muntenegruului depusă în temeiul articolului 34 din Convenția pentru protecția drepturilor omului și a libertăților fundamentale („Convenția”) la 10 aprilie 2020. Reclamanții au fost reprezentați de domnul B. Upić, un avocat care practică în Podgorica.
Guvernul Montenegren („Guvernul”) au primit avizul de cerere. FACTE Detaliile reclamanților și informațiile relevante pentru cerere sunt prezentate în tabelul adăugat. Reclamanții se plângeau de neexecutarea deciziilor interne adoptate împotriva societăților deținute de stat/societăți sociale. La 18 iulie 2019 Curtea Constituțională a constatat o încălcare a drepturilor reclamanților în temeiul articolului 6 § 1 din Convenție și al articolului 1 din Protocolul nr. 1 la Convenție din cauza neexecuției. Reclamanții au fost acordate 2.000 de euro (EUR) fiecare în prejudiciu moral. Cu toate acestea, deciziile interne luate în considerare rămân neexecute până în prezent. ÎNCĂLCAREA ALEGATĂ A ARTICOLUL 6 § 1 AL CONVENȚIEI ȘI A ARTICOLUL 1 AL PROTOCOLULUI NR. Reclamanții s-au plâns în principal de neexecutarea deciziilor interne în favoarea lor.
Ele se bazează pe art. 6 § 1 din Convenție și pe art. 1 din Protocol Nr. Curtea reiterează că executarea unei hotărâri din partea oricărei instanțe trebuie considerată o parte integrantă a unei „audieri” în sensul articolului 6. Se referă, de asemenea, la jurisprudența sa privind neexecuția sau întârziarea executării hotărârilor interne finale (a se vedea Hornsby c. Grecia , nr. 18357/91, § 40, Raporturi de hotărâri și hotărâri 1997 II). Prin urmare, Curtea consideră că hotărârile din prezentul caz au ordonat adoptarea unor măsuri specifice, în sensul articolului 1 din Protocolul nr. 10. În principalele cazuri de R. Kačapor și alții c. Serbia (n. 2269/06 și altele 5 §§ 97-99, 106-16 și 119-20, 15 ianuarie 2008) și Mijanović c. Muntenegru (n. 19580/06, §§ 81-91, 17 septembrie 2013), Curtea a constatat deja o încălcare a unor chestiuni similare cu cele din acest caz.
11. După examinarea tuturor materialelor care i-au fost prezentate, Curtea nu a găsit niciun fapt sau argument care să-i convingă să ajungă la o concluzie diferită cu privire la admisibilitatea și meritul acestor plângeri. Având în vedere jurisprudența sa privind acest subiect, Curtea consideră că, în cazul instantaneu, autoritățile nu au desfășurat toate eforturile necesare pentru aplicarea integrală și în timp util a deciziilor în favoarea reclamanților.
12. Prin urmare, aceste plângeri sunt admisibile și dezvăluie o încălcare a art. 6 § 1 din Convenție și a art. 1 din Protocolul nr. APLICAREA ARTICOLULUI 41 AL CONVENȚIUNII 13. Respectând documentele în posesia sa și jurisprudența sa (a se vedea, în special, R. Kačapor și alții , citate mai sus §§ 123-26; Stošić c. Serbia, nr. 64931/10 , § 66-68, 1 octombrie 2013 și Mastilović și alții c. Montenegr , nr. 28754/10, § 52, 24 februarie 2022), Curtea consideră că este rezonabil să nu acorde reclamanților compensații în ceea ce privește prejudiciile morale, deoarece a fost deja acordată la nivel intern (a se vedea punctul 6 mai sus), ci să atribuie suma pentru costurile și cheltuielile indicate în tabelul adăugat.
14. Curtea constată, de asemenea, că statul reclamant are obligația de a aplica deciziile interne care rămân executive.
Pentru aceste motive, TRIBUNALUL, UNANIMOUS, declară cererea admisibilă; susține că această cerere dezvăluie încălcarea articolului 6 § 1 din Convenție și a articolului 1 din Protocolul nr. 1 privind nerespectul punerea în aplicare a deciziilor interne luate împotriva societăților deținute de stat/societăți sociale; deține că statul pârât se asigură, prin mijloace adecvate, în termen de trei luni, executarea deciziilor interne în curs menționate în tabelul adăugat; Deține (a) că Statul pârât trebuie să plătească reclamanților, în termen de trei luni, suma indicată în tabelul adăugat la rata aplicabilă la data decontare; (b) care, de la expirarea celor trei luni menționate mai sus, până la decontarea dobânzilor simple se plătesc pe valoarea de mai sus, la o rată egală cu rata marginală de creditare a Băncii Centrale Europene în timpul perioadei de incumpărare plus trei puncte procentuale.

1.The case originated in an application against Montenegro lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) on 10 April 2020.
2.The applicants were represented by Mr B. Ćupić, a lawyer practising in Podgorica.
3.The Montenegrin Government (“the Government”) were given notice of the application. THE FACTS
4.The applicants’ details and information relevant to the application are set out in the appended table.
5.The applicants complained of the non-enforcement of domestic decisions given against socially/State-owned companies. 6 . On 18 July 2019 the Constitutional Court found a violation of the applicants’ rights under Article 6 § 1 of the Convention and Article 1 of Protocol No. 1 to the Convention on account of non-enforcement. The applicants were awarded 2,000 euros (EUR) each in non-pecuniary damage. However, the domestic decisions under consideration remain unenforced until the present day. THE LAW

7.The applicants complained principally of the non-enforcement of domestic decisions given in their favour. They relied on Article 6 § 1 of the Convention and on Article 1 of Protocol No. 1.
8.The Court reiterates that the execution of a judgment given by any court must be regarded as an integral part of a “hearing” for the purposes of Article 6. It also refers to its case-law concerning the non-enforcement or delayed enforcement of final domestic judgments (see Hornsby v. Greece , no. 18357/91, § 40, Reports of Judgments and Decisions 1997 ‑ II).
9.The Court further notes that the decisions in the present case ordered specific action to be taken. The Court therefore considers that the decisions in question constitute “possessions” within the meaning of Article 1 of Protocol No. 1.
10.In the leading cases of R. Kačapor and Others v. Serbia (nos. 2269/06 and 5 others, §§ 97-99, 106-16 and 119-20, 15 January 2008), and Mijanović v. Montenegro (no. 19580/06, §§ 81-91, 17 September 2013), the Court already found a violation in respect of issues similar to those in the present case.
11.Having examined all the material submitted to it, the Court has not found any fact or argument capable of persuading it to reach a different conclusion on the admissibility and merits of these complaints. Having regard to its case-law on the subject, the Court considers that in the instant case the authorities did not deploy all necessary efforts to enforce fully and in due time the decisions in the applicants’ favour.
12.These complaints are therefore admissible and disclose a breach of Article 6 § 1 of the Convention and Article 1 of Protocol No. 1.
13. Regard being had to the documents in its possession and its own case ‑ law (see, in particular, R. Kačapor and Others , cited above , §§ 123-26; Stošić v. Serbia, no. 64931/10, §§ 66-68, 1 October 2013 ; and Mastilović and Others v. Montenegr o , no. 28754/10, § 52, 24 February 2022) the Court considers it reasonable not to award the applicants compensation in respect of non-pecuniary damage because it has already been awarded domestically (see paragraph 6 above), but to award the sum for costs and expenses indicated in the appended table.
14.The Court further notes that the respondent State has an outstanding obligation to enforce the domestic decisions which remain enforceable. FOR THESE REASONS, THE COURT, UNANIMOUSLY, Declares the application admissible; Holds that this application discloses a breach of Article 6 § 1 of the Convention and Article 1 of Protocol No. 1 concerning the non ‑ enforcement of domestic decisions given against socially/State ‑ owned companies; Holds that the respondent State shall ensure, by appropriate means, within three months, the enforcement of the pending domestic decisions referred to in the appended table; Holds (a) that the respondent State is to pay the applicants, within three months, the amount indicated in the appended table at the rate applicable at the date of settlement; (b) that from the expiry of the above-mentioned three months until settlement simple interest shall be payable on the above amount at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points.
