Alyokhin împotriva Ucrainei

CINTIMEA SECȚIUNE DECIZIE Nr. 26316/09 Stanislav Petrovich ALYOKHIN împotriva Ucrainei și 138 alte cereri (a se vedea lista anexată) Curtea Europeană a Drepturilor Omului (A Cincea Secțiunea), care așeză la 21 februarie 2012 în calitate de comitet compus din: Mark Villiger, președinte, Karel Jungwiert, André Potocki, judecători și Stephen Phillips, secretar adjunct al secțiunii; Având în vedere cererile depuse mai sus la datele specificate în tabelul anexat, după deliberare, hotărăsc după cum urmează: Reclamanții sunt cetățeni ucraineni ai căror nume și date de naștere sunt specificate în tabelul anexat. Ele au fost reprezentate de dl N. Pedan, un avocat practicant la Slovyansk. Guvernul ucrainean („Guvernul”) a fost reprezentat de dna V. Lutkovska, a Ministerului Justiției.

Reclamanții sunt foști angajați ai instalației deținute de stat „Sodovyy Zavod”. La datele specificate în tabelul anexat, Curtea Slovyansk și comisia de litigiu al forței de muncă au ordonat instalației să plătească diverse sume legate de muncă. Deciziile în favoarea reclamanților au devenit finale, dar rămân neexecutate. COMPLAINTS În baza articolelor 4, 6 § 1 și 13 din Convenție și a articolului 1 din Protocolul nr. 1, reclamanții se plângeau de nerespectarea lungă a hotărârilor în favoarea lor. HOTĂRÂREA Curții consideră că, în conformitate cu art. 42 § 1 din Regulamentul Curții, cererile ar trebui să fie afișate, având în vedere contextul lor factual și juridic comun.

Curtea remarcă că plângerile reclamanților cu privire la neexecuția scăde în temeiul articolului 6 § 1 din Convenție și al articolului 1 din Protocolul nr. 1, care se citesc, în măsura în care este relevant, după cum urmează: art. 6 „În determinarea drepturilor și obligațiilor sale civile ... fiecare are dreptul la o audiere echitabilă ... într-un timp rezonabil de [a] ... tribunal ...” art. 1 din Protocolul nr. 1 „Fiecare persoană fizică sau juridică are dreptul la bucuria pașnică a bunurilor sale. Nimeni nu poate fi privat de bunurile sale cu excepția interesului public și sub rezerva condițiilor prevăzute de lege și de principiile generale ale dreptului internațional.

Cu toate acestea, dispozițiile anterioare nu afectează în niciun fel dreptul unui stat de a aplica legile pe care le consideră necesare pentru a controla utilizarea proprietăților în conformitate cu dobânzile generale sau pentru a asigura plata impozitelor sau a altor contribuții sau penalități.” Referindu-se hotărârea pilotă Yuriu Nikolayevich Ivanov (n. 40450/04, CEDH 2009 ... (Extracte)), la 19 iulie 2011, Guvernul a prezentat Curții declarații unilaterale care vizează soluționarea problemelor prezentate în cereri. Prin aceste declarații, Guvernul a recunoscut durata excesivă a executării deciziilor în favoarea reclamanților, a declarat că acestea sunt gata să plătească reclamanților datoriile în curs în temeiul deciziilor și sumelor specificate în tabelul anexat.

Guvernul a invitat Curtea să elimine cererile din lista cazurilor în temeiul articolului 37 § 1 litera (c) din Convenție. Declarațiile prevăd, de asemenea, că sumele de compensare trebuiau să acopere orice prejudiciu material și nepecuniare, precum și costurile și cheltuielile, care urmează să fie convertite în moneda națională a statului contestat la rata aplicabilă la data decontare. Sumele vor fi plătite în termen de trei luni de la data notificării hotărârii luate de Curte în temeiul articolului 37 § 1 din Convenția Europeană pentru Drepturile Omului. În cazul în care aceste sume nu au fost plătite în termenul de trei luni, guvernul s-a angajat să plătească dobânzi simple pentru ele de la expirarea perioadei respective până la decontare, la o rată egală cu rata marginală de creditare a Băncii Centrale Europene în timpul perioadei implicite plus trei puncte procentuale.

Declarațiile prevăd că aceste plăți ar constitui rezoluția finală a cauzelor, fie că reclamanții nu sunt de acord cu declarațiile din motive diferite și au solicitat Curții să continue examinarea cauzelor lor, fie nu au formulat nicio observație. Curtea reiterează că, în orice etapă a procedurii, poate dezbate o cerere din lista cazurilor în care circumstanțele conduc la concluziile menționate la art. 37 alineatul (1) litera (a)-(c) din convenție. În special, în temeiul articolului 37 alineatul (1) litera (c) Curtea poate exclude un caz din lista sa dacă, din orice alt motiv stabilit de Curte, nu mai este justificat să continue examinarea cererii. „Cu toate acestea, Curtea continuă examinarea cererii în cazul în care respectul drepturilor omului, astfel cum este definit în Convenție și protocoalele sale impun acest lucru”.

Curtea reiterează, de asemenea, că, în anumite circumstanțe, aceasta poate încheia o cerere în temeiul articolului 37 § 1 litera (c) pe baza unei declarații unilaterale formulate de un guvern contestat, chiar dacă reclamantul dorește să continue examinarea cazului (a se vedea Tahsin Acar c. Turcia (emisiune preliminară) [GC], nr. 26307/95, §§ 75-77, CEDH 2003-VI).

Curtea reamintește că, în hotărârea sa pilot cu privire la chestiunile neexecuției, a ordonat Ucraina să acorde recurs reclamanților ale căror cereri au fost comunicate guvernului înainte de eliberarea hotărârii sau ar fi fost comunicate în continuare hotărârii și plângerile în cauză cu privire la neexecuția prelungită a deciziilor interne pentru care statul este responsabil (a se vedea Iuriy Nikolayevich Ivanov , citat mai sus § 99 și punctul 6 din partea operativă . După examinarea termenilor declarațiilor guvernamentale, Curtea le înțelege că intenționează să acorde reclamanților recursul în conformitate cu hotărârea pilot . Curtea este convinsă că guvernul recunoaște în mod explicit durata excesivă a executării hotărârilor în favoarea reclamanților și se angajează să pună în aplicare deciziile care nu au fost încă executate.

Prin urmare, Curtea consideră că nu mai este justificat să continue examinarea cererilor, ci este, de asemenea, convins că respectul drepturilor omului, astfel cum este definit în Convenția și în Protocolurile sale, nu necesită să continue examinarea cererilor. În consecință, acestea ar trebui să fie eliminate din listă. Din aceste motive, Curtea hotărăște în unanimitate să se alăture cererilor; ia act de termenii declarațiilor guvernului contestat în ceea ce privește plângerile reclamanților cu privire la aplicarea întârziere a hotărârilor interne în favoarea lor; decide să scoată cererile din lista sa de cazuri în conformitate cu art. 37 § 1 litera (c) din Convenție.

DECISION Application no. 26316/09 Stanislav Petrovich ALYOKHIN against Ukraine and 138 other applications (see list appended) The European Court of Human Rights (Fifth Section), sitting on 21 February 2012 as a Committee composed of: Mark Villiger, President, Karel Jungwiert, André Potocki, judges, and Stephen Phillips, Deputy Section Registrar, Having regard to the above applications lodged on the dates specified in the annexed table, Having deliberated, decides as follows: THE FACTS The applicants are Ukrainian nationals whose names and dates of birth are specified in the annexed table. They were represented by Mr N. Pedan, a lawyer practising in Slovyansk. The Ukrainian Government (“the Government”) were represented by Ms V. Lutkovska, of the Ministry of Justice.

The applicants are former employees of the State-owned plant “Sodovyy Zavod”. On the dates specified in the annexed table the Slovyansk Court and the labour dispute commission ordered the plant to pay the applicants various work-related sums. The decisions in the applicants’ favour became final but remain unenforced. COMPLAINTS Relying on Articles 4, 6 § 1 and 13 of the Convention and Article 1 of Protocol No. 1, the applicants complained about the lengthy non ‑ enforcement of the decisions given in their favour. THE LAW 1. The Court considers that in accordance with Rule 42 § 1 of the Rules of Court, the applications should be joined, given their common factual and legal background.

2. The Court notes that the applicants’ complaints about the non-enforcement fall to be examined under Article 6 § 1 of the Convention and Article 1 of Protocol No. 1, which read, insofar as relevant, as follows: Article 6 “In the determination of his civil rights and obligations ... everyone is entitled to a fair ... hearing within a reasonable time by [a] ... tribunal ...” Article 1 of Protocol No. 1 “Every natural or legal person is entitled to the peaceful enjoyment of his possessions. No one shall be deprived of his possessions except in the public interest and subject to the conditions provided for by law and by the general principles of international law.

The preceding provisions shall not, however, in any way impair the right of a State to enforce such laws as it deems necessary to control the use of property in accordance with the general interest or to secure the payment of taxes or other contributions or penalties.” 3. Referring to the Yuriy Nikolayevich Ivanov pilot judgment (no. 40450/04, ECHR 2009 ‑ ... (extracts)), on 19 July 2011 the Government submitted to the Court unilateral declarations aimed at resolving the issues raised in the applications. By these declarations, the Government acknowledged the excessive duration of the enforcement of the decisions in the applicants’ favour, declared that they were ready to pay the applicants the outstanding debts under the decisions and the sums specified in the annexed table.

The Government invited the Court to strike the applications out of the list of cases pursuant to Article 37 § 1 (c) of the Convention. The declarations also provided that the compensation sums were to cover any pecuniary and non-pecuniary damage as well as costs and expenses, to be converted into the national currency of the respondent State at the rate applicable on the date of settlement. The sums would be payable within three months from the date of notification of the decision taken by the Court pursuant to Article 37 § 1 of the European Convention on Human Rights. In the event of failure to pay these sums within the said three-month period, the Government undertook to pay simple interest on them from expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points.

The declarations provided that these payments would constitute the final resolution of the cases. The applicants either disagreed with the declarations on various grounds and requested the Court to pursue the examination of their cases or did not provide any comments. The Court reiterates that it may at any stage of the proceedings strike an application out of its list of cases where the circumstances lead to the conclusions specified under Article 37 § 1 (a)-(c) of the Convention. In particular, under Article 37 § 1 (c) the Court may strike a case out of its list if for any other reason established by the Court, it is no longer justified to continue the examination of the application. Article 37 § 1 in fine states: “However, the Court shall continue the examination of the application if respect for human rights as defined in the Convention and the protocols thereto so requires”.

The Court also reiterates that in certain circumstances it may strike out an application under Article 37 § 1 (c) on the basis of a unilateral declaration made by a respondent Government even if the applicant wishes the examination of the case to be continued (see Tahsin Acar v. Turkey (preliminary issue) [GC], no. 26307/95, §§ 75-77, ECHR 2003-VI). The Court recalls that in its pilot judgment on the issues of the non-enforcement it ordered Ukraine to grant redress to the applicants whose applications were communicated to the Government before the delivery of the judgment or would be communicated further to the judgment and concerned complaints about the prolonged non-enforcement of domestic decisions for which the State was responsible (see Yuriy Nikolayevich Ivanov , cited above, § 99 and point 6 of the operative part).

Having examined the terms of the Government’s declarations, the Court understands them as intending to give the applicants the redress in accordance with the pilot judgment. The Court is satisfied that the Government explicitly acknowledge the excessive duration of the enforcement of the decisions given in the applicants’ favour and undertake to enforce the decisions which have not been enforced yet. It also notes that the compensation sums offered by the Government are comparable with Court awards in similar cases, taking account, inter alia , of the specific delay in each particular case. The Court therefore considers that it is no longer justified to continue the examination of the applications.

It is also satisfied that respect for human rights as defined in the Convention and the Protocols thereto does not require it to continue the examination of the applications. Accordingly, they should be struck out of the list. For these reasons, the Court unanimously Decides to join the applications; Takes note of the terms of the respondent Government’s declarations in respect of the applicants’ complaints about the delayed enforcement of the domestic decisions given in their favour; Decides to strike the applications out of its list of cases in accordance with Article 37 § 1 (c) of the Convention.
